Terms and Conditions of Sale These Terms and Conditions of Sale are made by and between Norton's Art ("We") and Bidders ("Buyers" or "Purchasers"). We reserve the right to make changes to the Terms and Conditions of Sale at any time. By participating in any sale, you acknowledge to be bound by these terms and conditions.ALL SALES ARE FINAL! By Bidding, buyer acknowledges and agrees the policy of "absolutely no returns" on any sold and paid purchased lot(s). Norton's Art offers all property for sale at auction "as is", with no guarantees or warranties, meaning that the property is sold with all existing faults and imperfections. Buyers must satisfy themselves as to each and every aspect of the quality of the lot, including (without limitation) its authorship, attribution, authenticity, age, condition, provenance, suitability and origin. Lots are sold on an 'as is' basis but the actual condition of the lot may not be as good as indicated by its outward appearance. In particular parts may have been replaced or renewed and lots may not be authentic or of satisfactory quality. It's bidder's responsibility as a prospective buyer to ask question about the item and inquire as to the condition of a specific lot before bidding. Upon request, condition report can normally be made available within two business days. Any condition information made available is done so as a courtesy. It is only an opinion and refers to the physical condition and should not be considered to be a statement of fact. Norton's Art accepts no responsibility for any error or omission. When bidder requests to register with Norton's Art, bidder acknowledges and is willing to accept the term of "sold as is" and will not use "item is not as described" as a reason to open dispute case to against Norton's Art. Norton's Art reserves the right to withdraw any property at any time before the actual sale. We reserve the right to reject a bid from any bidder prior or during the sale. Bidder agree to accept the fact if the won bid items could not be delivered after sale due to any reason, an example may be a mistake of posting a wrong picture of an item which is no longer available. Some lots offered may be subject to a reserve price which is a confidential minimum price agreed upon by the consignor and Norton?s Art. Norton's Art will act on such reserves by bidding for the consignor. Reserve price may allow exceed the high estimate and if bidding ends before the reserve is reached, the property will not be sold.The highest bidder deemed to have purchased the offered lot in accordance with all of the terms and conditions and will pay the purchase price in full plus a buyer's premium and any applicable taxes. A buyer's premium of 28% is added to the sold price of each individual lot purchased as part of the total purchase price.All purchases (including buyer's premium) will be subject to a New York State Local sales tax to buyer whose account is registered as a New York State resident unless a valid tax exempt certificate is provided. Payment is due no later than Five (5) business days from the end of the auction. Accepted forms of payment are PayPal, major credit (Visa, Master Card, American Express or Discover), bank wire transfer. We also take money order, cashier's or personal check, (Note, we don't take check from international bidder). Purchased items paid by personal check may be removed from the premises once the check has cleared the bank. Payment is not received within this time frame will be reported to the online bid platform provider. Norton's Art has the right to resale or return items to consignor if the buyer exceeds the payment period. Norton?s Art reserves the right to start the collection process ten (10) business days after sale. Norton?s Art does not keep customer?s credit card information on file, therefore, all credit card payments either paid by bidder via Paypal secreted payment processor or bidder authorized Norton's Art to charge his/her credit card by calling us or provide credit card information via secured email. Therefore, bidder agrees that he/she will not open a dispute case of "unauthorized charge" at PayPal and/or card issued bank / institution. We offer in house packing and shipping services, domestic & international, at the buyer's expense. Estimated shipping costs are given within the description of the lot. The final shipping cost will be calculated after sale to include a full insurance coverage if under the insurance allowed limitation. Buyers can use outside packer and shipper of their own choosing. No property purchased will be released until payment is made in full on the item(s) and has cleared the bank (it may take days for bank to complete the process checks). Normally the item will be shipped within 5 working days after payment is cleared. Please note: All items will be shipped via UPS/USPS/LOCAL CARRIERS. We will provide buyers with tracking information and purchased insurance details, if any, after the item(s) is shipped out. Buyers agrees, whether or not you use our shipping service, that it is the buyer's responsibility to contact the shippers directly for any shipping issue and insurance, including reimbursement for damage or loss. Buyers will not hold Norton?s Art liable for any damage or loss after merchandise has been released from our possession. If buyer submitted a claim due to any damage or lost during the shipping, in some situations that shipper will send the insurance's reimbursement which was decided by shipper, to Norton's Art, We will give the exactly the reimbursement amount back to buyer. Buyer acknowledges and agrees that buyer will not request any more dollar amount beyond the insurance's reimbursement nor request for the premium. It is buyer/s responsibility to arrange the returned shipment at buyer?s cost. International Bidders: You are responsible for meeting all customs/import-export regulations. You are the sender of the item. Norton's Art just assists in packing and shipping items according to your request but cannot be held liable for international laws affecting the delivery of your items. Please be aware that if you purchase low insurance coverage or claim lower value that it is your risk w/o corresponding insured full coverage if any damage or loss during the delivery.Insurance: We always purchase full insurance of the hammer price if purchasable. International bidder, please be aware that the max purchasable insurance could be lower than the true value. We will inform you the purchasable insurance if lower than the true value and you may always find your own shipper. If you select our in-housing shipping, it?s all your responsibility to file a claim, to deal with custom issue and to take the risk of lower insurance coverage. You are aware and agree that 1) you will not hold Norton's Art liable for any damage or loss after merchandise has been releas?ed from our possession. 2) it?s shipper?s decision to reimburse buyer for damaged / lost item. 3) Norton?s Art will refund buyer the EXACTLY amount on the reimbursed check from shipper 4) Buyer will not ask Norton's Art for any additional amount beyond the reimbursement back from shipper. All lots must be removed from our premises at the buyer's expense, no later than ten (10) days post sale when buyer use 3rd party for shipping. Purchaser will incur a $5 per day fee per lot until the sold property is removed. In addition, we reserve the right to transfer non-removed property to a storage facility at the Purchaser's risk and expense.Unless specify in the description, all display wood-stands are not included with the sold items.
