Barton & Co Terms and Conditions
All items must be picked up or have shipping arranged for within 14 days of auction ending. Storage fees will be incurred for items left over the two week period. Items not claimed will be considered forfeit.
We offer in house shipping for non furniture pieces. You will be invoiced for this SEPARATELY from the Live Auctioneers platform. Please contact us with your paid invoice via email at BARTONNCO@GMAIL.com requesting shipping if you would like our in house shipping services. If you need help with your shipments of furniture we can offer a list of valued trucking/shipping companies. All items must be claimed and removed from our warehouse within 14 days from the end of auction. If they are not picked up or claimed, the items will be considered forfeit, or charged a storage fee of $50 per week until the item has been picked up.
Prior to bidding, please read our terms and conditions detailed below. Barton & Co. requires each and every bidder, whether bidding in person, on the phone, by absentee bid, or through an online bidding venue, accept the terms and conditions of the sale as follows:
1. Sold As Is: The lots listed in all catalogs will be offered by Barton & Co as owner or as agent for consignor(s) subject to the following terms and conditions. All property IS SOLD AS IS, where is and without recourse with all faults and all sales are final. Written and oral descriptions are the opinions of Barton & Co. and should in no way be construed as a guarantee of any kind. Neither the consignor(s) nor Barton & Co makes any representation or warranties, express or implied, with respect to size, count, weight, style, authenticity, provenance, period material, manufacturer, artist, origin copyright or reproduction right or any other warranty except as specified below on any lot sold. Barton & Co. believes to the best of its knowledge information presented in any auction has come from reliable sources. However, such information is presented solely for the convenience of the prospective purchasers. All measurements and weights are approximate. All glassware is sold as is; we cannot check every piece for chips. Barton & Co is not responsible for damage of glass covering paintings, drawings, and other works or frames, regardless of cause. Barton & Co will not guarantee the authenticity of any signature unless so stated at the time of auction. We will only guarantee the medium in which the particular work is executed. We are not responsible for typographical errors of descriptions either in the catalog or on the internet. Barton & Co. attempts to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog or other descriptions in lot.
2. Warranties: Prospective bidders should inspect the property before bidding to determine its condition, size, and whether or not it has been repaired or restored. The consignor and Barton & Co disclaim any and all warranties expressed or implied including but not limited to the implied warranty, merchantability, or fitness for any particular purpose. No warranties are made that any of the merchandise complies with any applicable governmental rules, regulations or guidelines of any kind or nature whatsoever. Neither Barton & Co as agent nor the consignor is responsible for any faults or defects in any lot nor to the correctness of any statement as to the authorship of any origin, authorship, date, age, attribution, genuineness, provenance or condition of any lot.
3. Barton & Co reserves the right to withdraw, combine, or divide any lot at its sole discretion prior to the commencement of bidding.
4. Highest Bidder: All lots are sold to the highest bidder. The auctioneer has the right to not accept any bid! Bidding may be reopened at the auctioneer's discretion. The auctioneer reserves the right to withdraw any item and to re-offer the item at any other time. The auctioneer may execute bids on behalf of absentee bidders and on behalf of consignors up to a reserve price. In the event of a dispute between bidders, the auctioneer has the final discretion to determine the successful bidder or to re-offer the lot in dispute. If any dispute arises after a sale, the Barton & Co sale record shall be conclusive.
5. Buyer?s Premium: A buyer's premium of 25% on any amount bid will be added to the purchase of all lots in the sale. This premium is payable by the purchaser as part of the total purchase price. All bids placed and all payments made must be in U.S. Dollars drawn on a U.S. Bank. If no payment is received 72hrs after the sale, winning bid will be canceled and an unpaid dispute will be sent. Buyers who are subject to unpaid invoices will be suspended/blocked for future auctions.
6. Payments: Must come from the invoiced party only- We reserve the right to decline payments from anyone other than the invoiced party. All sales not paid within 72 hours will be cancelled.
7. Sales Tax: All purchases are subject to NY State sales tax except for (a) the buyer is an out of state resident and the lot is being shipped out of state by a certified shipper, (b) the buyer has a valid tax resale number on file with Barton & Co. Resale tax numbers from all states are accepted, but the resale tax form must be completely filled out and received prior to time of purchase. If you pick up your item at our location and you do not have a valid resale certificate you will be subject to NY Sales Tax.
8. Reserve Price: A small percentage of lots may have a reserve price, which is the confidential minimum price below which such lots will not be sold. No reserve will exceed the low estimate of the lot. Reserves are agreed upon between consignors and Barton & Co.
9. Refunds and Exchanges: Under the terms of this agreement, the buyer acknowledges that there are no refunds of exchanges. If the buyer needs an exception, he/she must write to Barton & Co. within 5 business days of delivery. Barton & Co. has the sole discretion to approve a return.
10. Restocking Fee: In the event Barton & Co. approves a refund, the buyer will be responsible for a 15% restocking fee based on the items hammer price, all shipping costs, and buyer?s premium. The restocking fee, shipping costs and buyer?s premium will be deducted from the refund. Sales tax will also be adjusted based on the refund. The refund will be processed within 5 business days of the products return and the product must be delivered in the same condition as sent to buyer. Unauthorized returns will be rejected.
11. Shipping and Handling: All shipping and handling will be done by Barton & Co. via third-party licensed shippers. Shipping charges are the responsibility of the purchaser. Barton & Co will provide purchasers with a list of recommended shippers upon request.
12. Condition Of Delivery: If for any cause a purchased lot cannot be delivered in the condition it was in at the time of sale, or should any purchased lot be stolen or lost prior to delivery/pick-up, Barton & Co shall not be liable for any amount in excess of that paid by the purchaser. We are not responsible for the acts of omissions of carriers or packers of purchased lots, whether or not recommended by us. Packing and handling of purchased lots by us is at the entire risk of the Purchaser and Barton & Co will have no liability for any loss or damage to such items.
13. Right To Refuse Service: As a private business Barton & Co reserves the right to refuse, deny, cancel, or terminate any/all sales without excuse or reason. Sales that are not completed will be refunded and then terminated.
14. Neglected Items: Any and all items that are either paid or unpaid which are not picked-up, not paid for storage, and/or paid to be shipped within 10 days of the auction will become property of Barton & Co.
