Buyer's Bidding Contract

Any
bids placed on the SEQUELS website using your bidding number are a contract and
you are responsible for paying all amounts due to SEQUELS. If you cannot pay
for and pick up or arrange shipping of the items during the pickup time, please
do not bid. All Sales Are Final.

will not manipulate the bidding or payment process.

Auction Extension
Rules

Items Close Three Items Per Minute At The Scheduled Date And End Time Of The
Online Auction. Sequels Uses An Automatic Extension Auction Style. This Allows
For A Three Minute Extension To Be Added To The End Of An Item Receiving A Bid
Within The Final Few Minutes Of The Scheduled Bidding Close For That Item. The
Item Will Then Close When Three Minutes Have Passed Without Any Activity.

Item Descriptions

All Items Are Sold As Is - Where Is. When There Are Obvious Faults (Chips,
Cracks, Significant Damage, Etc) We Do Our Best To List The Fault Within The
Description. We Will Provide Descriptions Under The “Condition” Heading Based
On Our Assessment Of An Item. We Do Not Assume That Our Assessment Of Condition
Will Be The Same As Your Assessment Of Condition. We Use A Scale Of Condition
As Follows: Excellent, Very Good, Good, TLC, Handyman Special. Therefore, A
Condition Rating Of Good Is In Our Opinion Halfway Between Excellent And
Handyman Special. We Will Sometimes Use Vintage In The Condition Description Which
Indicates The Item Is Of Vintage Age And Age Related Wear Should Be Expected
Even If Described As Vintage Excellent. Please Preview If You Are Concerned
With An Items Condition Beyond Our Description.

Many Of The Items We
Sell Are Antique, Vintage, Or Used. You Should Expect Signs Of Wear Consistent
With Age And Use. We Will Not List Every Flaw Associated With Each Item.

If You Are Unsure Of
An Items Condition Make Arrangements To Attend The Preview And Please Bid
Accordingly.

Sales Tax

All Sales Are Subject To Appropriate State Sales Tax Laws.

Vendors Should Provide
Their Vendors License Information (State And License #) Prior To The End Of The
Sale. Once We Receive Your Information You Are Not Required To Resend It For
Future Sales Unless It Is Upon Sequels Request. We Will Keep it On File For All
Future Sales.

Product Holding Policy

All Items MUST Be Picked Up During Scheduled Pickup Times. Call With Questions.
Sequels Is Not Responsible For The Protection Of Any Items Paid Or Unpaid After
The Designated Pickup Date & Time. Any Purchases Paid For By The Credit
Card On File Or Called In Will Be Held For 1 Week From The Original Pickup
Date. After 1 Week Without Pickup, Those Paid Items Will Become The Property Of
Sequels And Relisted Or Donated. Any Purchases Not Paid For By The End Of The
Original Pickup Date & Time Will Result In The Bidders Number Being Turned
Off And The Items Will Be Donated Or Disposed Of At Sequels Discretion.
Alternative Arrangements Can Be Made Simply By Contacting Sequels Prior To The
Pickup Date & Time. SEQUELS may, at
its discretion move a paid item to SEQUELS Auction Lounge for a minimum
handling fee of $10. That fee may be
more for items that SEQUELS determines are harder to handle. SEQUELS will
charge your card for the bid amount plus tax plus any handling fee.

Forfeiture Policy

Any items not paid for in accordance
with the SEQUELS Terms and Conditions will be forfeited by you and SEQUELS may, in its sole discretion, resell the items
or donate the items to a charity of SEQUELS choosing. SEQUELS reserves the
right to report your account to collections for the combined total of the
original invoice amount and any moving or disposal charges.

Failure to Pick-Up Paid Items.

IF YOU FAIL TO PICK-UP
ANY ITEMS WITHIN SEVEN (7) CALENDAR DAYS OF THE CLOSE OF BIDDING YOU WILL BE CONSIDERED
TO HAVE FORFEITED THE ITEMS AND TITLE WILL REVERT TO SEQUELS. SEQUELS MAY, IN ITS
ABSOLUTE AND SOLE DISCRETION, RESELL THE ITEMS OR DONATE THE ITEMS TO A CHARITY
OF SEQUELS CHOOSING. SEQUELS RESERVES THE RIGHT TO CHARGE THE CREDIT CARD ON FILE
FOR ANY MOVING OR DISPOSAL CHARGES.\

Payment Forms Accepted

Sequels Accepts Cash, Visa, MasterCard, Discover & American Express With No
Convenience Fee Up To $500. If Your
Total Is Over $500, We Will Charge A 2% Convenience Fee For Any Credit Card
Charges.

Collection Procedures

Collection Procedures
Any Purchases Not Paid For During The Pickup Time Will Result In The Buyer's Account Being Turned Over To Collections. If a check is declined for any reason, the account holder has 2 days to satisfy the invoice amount plus a $30 returned check fee. If the invoice is not satisfied, the account will be turned over to the local authorities. The Collection Amount Shall Total The Winning Bid Amount Plus The Total Cost Of Collection Procedures

Bidding Errors:

Many bidders purposefully
increase their own bid to price an item out of reach of other bidders. Sequels
bidding system will ask you to review significant increases in bids after
placing them to make sure you did not enter an amount in error. Also, please note that if you place a bid in the
“Minimum Bid” box instead of the “Maximum Bid” box the bid will immediately
increase to the amount you entered (unless another bidder had a higher maximum
bid). If you make a mistake more than 24 hours before the sale close you can
submit a request to have your error corrected by phone at 513-407-1406, or if
not during office hours, by emailing SequelsAuctions@zoomtown.com .
If the mistake is made within 24 hours of the auction closing the bid will
stand as entered. The bid you placed may prevent other bidders from placing
competing bids. SEQUELS cannot be responsible for individuals increasing their
own bids and therefore eliminating other potential bidders.

Shipping Requests

If You Have Won An Item And Would Like To Have It Shipped, We Work With Safe
Ship, A Local Shipping Company To Complete Your Request. Please e-mail
Kim@safeshipnewport.com for shipping requests of any item on our site. NOTE:
Safe Ship is a specialty shipper capable of shipping all of our items to
anywhere in the world.

Winning Bidders Wishing To Use This Service Please Email Prior
To The Pickup Date To Arrange The Shipping And Payment.

Merchandise removal

Buyer shall be responsible for making arrangements for merchandise removal
within the date and hours of the pickup described. You must bring your own
packing supplies and moving help.

Transference

No items will be released until full payment has be received. Merchandise
becomes the full responsibility of buyer at the close of the sale, and buyer
assumes all risk of loss and damage to property until removed from sale
premises.

Limit of liability

You
agree that SEQUELS is not responsible for the acts or omissions of any carriers
in packing or shipping of purchased lots, whether or not such carrier is
recommended by SEQUELS.

YOU ALSO AGREE AND UNDERSTAND
THAT SEQUELS WILL NOT BE LIABLE FOR ANY DAMAGES EVEN IF SEQUELS HAS BEEN ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT PERMITTED BY LAW, SEQUELS’s TOTAL
LIABILITY TO YOU FOR ANY REASON AND UPON ANY CAUSE OF ACTION WHATSOEVER, WHETHER
IN CONTRACT, WARRANTY OR TORT, SHALL BE LIMITED TO THE AMOUNT OF MONIES PAID BY
YOU TO SEQUELS HEREUNDER IN THE PRECEDING THREE (3) MONTH PERIOD.

Alternate Pickup

Alternate pickup

If you are unable to pick up your items during the scheduled removal date and
time you must contact us 24 hours prior to the scheduled removal date and time
to determine if alternate arrangements can be made. This should only be
considered as a last resort. SEQUELS may transport the items to SEQUELS AUCTION
LOUNGE in SEQUELS BOUTIQUE for a fee in addition to your purchase price. You
Must notify Sequels prior to the pickup date. Payment for items to be picked up
at SEQUELS AUCTION LOUNGE must be made by providing a Visa or MasterCard number
prior to the original scheduled removal and payment date. The card number must
be provided to us by calling 513-407-1406. Credit cards will be placed on file
in association with your bidder number in the event of future alternate pickup
requests. Your card will be charged the combined total of the purchase amount,
associated taxes, and handling charges. Items which can not be moved will be
forfeited and may be subject to disposal charges in addition to the original
invoice amount.

1. Do all items end at exactly 8 pm? No, Items end at a rate of 3 items per minute. The first three items will end at 8 pm, items 4-6 end at 8:01 and so forth. HELPFUL HINT: Don’t forget to press the “refresh” on the right side of the screen under the time left. Your computer time may be different than Sequels Auction timer.

2. Do I Need To Pick Up On The Scheduled Pick Up Date? Yes, but Sequels understands life is not entirely predictable. If a situation arises that causes you to miss the pick up, Sequels asks that you call to arrange pick up and prepay via credit card. Your items may be moved to our Beechmont Location, if your items qualify, for an additional fee. These items and fee MUST be paid prior to the end of the pick-up. They can only be stored when paid for 2 weeks. If unpaid without a call, your credit card on file will be charged and your bidder number will be suspended.

3. Do you always charge the card on file for the invoice amount? No, you can pay with Cash or a different credit card during the scheduled pick up time. We only use the card on file if you do not pick up during the scheduled time.

4. How Can I See Only The Items I Am Interested In? You can easily view just the items you are bidding on by clicking the “review bids” button at the bottom of the page. You just need to enter your bidder number and password and then click the “review bids” button.

5. Are All Sales Final? Yes, because of the nature of our auctions, all sales are final. Please attend a preview if you have questions about condition or any other concerns.
