1. General Terms
By participating in this auction, all bidders agree to be bound by these Terms & Conditions. These terms govern all items offered for sale through LiveAuctioneers and define the responsibilities of the Seller, Auctioneer, and Buyer.
2. Registration to Bid
Registration at the auction finalizes each bidder?s agreement to the terms and conditions of sale as stated in the Contract and any Addenda, all of which are incorporated by reference into your bidding. Do not bid until you have read and fully understand the terms and conditions.
To participate in the auction, each bidder must sign up and register through LiveAuctioneers.
By bidding, you represent to Hammer Drop Auction Company (Auctioneer) and the Seller that:
- You have read and agree to be bound by all terms and conditions stated herein.
- You accept all disclosures and responsibilities associated with bidding.
If you do not agree with any of the terms and conditions stated: DO NOT BID.
3. Before Placing a Bid
It is essential that you are familiar with all terms and conditions, as all sales are final. The terms of sale are non negotiable.
The Buyer is responsible for all costs and fees associated with the purchase, removal, and shipping of items. There are no refunds.
4. "As Is, Where Is" Condition
All items are offered and sold "as is, where is", with no warranties or guarantees expressed or implied. The Seller and Auctioneer make no representations regarding condition, authenticity, age, provenance, value, or suitability for any purpose.
5. Buyer Due Diligence
Buyers are solely responsible for conducting their own due diligence, inspection, research, and investigation of any item prior to bidding.
- Buyers must rely exclusively on their own examination and judgment, not on any information, descriptions, or photographs provided by the Seller or Auctioneer.
- Failure to be fully informed about an item?s condition will not constitute grounds for any claim, adjustment, refund, or cancellation of sale.
6. Bidding & Buyer Responsibility
Placing a bid is a legally binding commitment to purchase the item if the bid is accepted.
- All bids are final.
- The Buyer assumes full responsibility for payment, pickup, and shipping arrangements.
7. Binding Contract Notice
YOU ARE ENTERING INTO A BINDING CONTRACT. THERE ARE NO REFUNDS OR BID CANCELLATIONS.
The registered bidder is personally responsible?legally and financially?for all auction items bid upon, whether bidding for oneself or acting as an agent.
An online bid accepted at public auction constitutes a legal and binding contract to purchase.
Any bidder who fails to follow through with a purchase will be:
- Banned from bidding at all future Hammer Drop Auction Company events
- Subject to potential civil and/or criminal action

8. Auctioneer Program Control
The sale will be controlled by the LiveAuctioneers. Hammer Drop Auction Company is not responsible for malfunctions, connectivity issues, or system errors that cause a bid or bidder to fail to be recognized or registered.
In the event of a dispute, the Auctioneer may re open bidding at the Auctioneer?s sole discretion, serve as the sole arbiter in determining bidder eligibility and/or make all final decisions regarding bid acceptance.
9. Payment
Payment must be completed in accordance with LiveAuctioneers? payment policies. Non-payment may result in cancellation of the sale, negative feedback, or additional actions permitted by LiveAuctioneers and Hammer Drop Auction Company.
10. Shipping & Pickup
LiveAuctioneers offers shipping services through LiveShip. Buyers may select LiveShip at checkout for packing and shipping. Buyers are responsible for all shipping fees.

11. Pickup of Items
Local pickup available by appointment.
Item(s) MUST be completely removed from the auction site on the specified pickup day.
Buyers must bring all necessary means to safely load and haul their purchases. Hammer Drop Auction Company will not provide labor, tools, or loading assistance.
Abandonment Policy
Any item(s) not picked up on the specified day will be considered "ABANDONED."
Buyers who fail to appear for scheduled load outs and fail to communicate with Hammer Drop Auction Company will have all winning lots deemed "ABANDONED WITHOUT REFUND."
Abandoned items may be disposed of, resold, or retained at the sole discretion of Hammer Drop Auction Company.
12. Liability
The Seller and Auctioneer are not liable for:
- Damage occurring during shipping or transport
- Misinterpretation of item descriptions
- Failure of the Buyer to inspect or investigate items
- Any indirect, incidental, or consequential damages
13. Final Sale
All sales are final. No returns, refunds, exchanges, or cancellations will be accepted under any circumstances.

These Terms & Conditions are governed by the laws of the state in which the auction is held.
