1. Item Descriptions and Condition
All items are sold AS IS, WHERE IS, with no warranties or guarantees, expressed or implied, unless otherwise specifically stated in writing by M & M Auction Services.
M & M Auction Services makes every reasonable effort to provide accurate descriptions and photographs of auction items. However, descriptions, photographs, condition statements, estimated values, and other information are provided for informational purposes only and are not guarantees of an item's condition, authenticity, functionality, or value.
Bidders are responsible for reviewing all available descriptions and photographs, asking questions before bidding, and determining whether an item meets their expectations. Bidders accept responsibility for their own research and purchasing decisions.
All sales are final. No refunds or returns will be accepted due to a bidder's dissatisfaction, a difference of opinion regarding an item's condition or value, or a bidder's failure to review the listing carefully.
2. Bidding and Buyer Responsibilities
Bidders are responsible for understanding the items on which they place bids and ensuring that their bids are intentional and accurate. Bidders should contact M & M Auction Services before bidding if they have questions about an item.
Once a bid is placed, it may not be withdrawn unless M & M Auction Services authorizes its cancellation. Winning bids constitute binding purchase agreements, and bidders are expected to complete their purchases.
M & M Auction Services reserves the right to reject bids, remove items from an auction, correct listing errors, cancel bids, or suspend bidding privileges when deemed necessary to protect the integrity of the auction.
3. Payment Terms
All winning bidders are responsible for paying their invoices in full within three (3) days of the auction closing, regardless of when items are scheduled to be picked up, unless otherwise specified in the auction listing.
An 18% buyer’s premium will be added to the winning bid amount. Applicable sales tax and any other disclosed charges will also be added to the invoice.
Failure to pay within the required period may result in cancellation of the purchase, forfeiture of the items, resale of the items at M & M Auction Services’ discretion, and suspension or restriction of future bidding privileges, subject to applicable law.
4. Item Pickup and Removal
All purchased items must be picked up and removed within the timeframe specified in the individual auction listing. Unless otherwise stated in the auction listing, all items must be removed within three (3) days of the auction closing.
Winning bidders are responsible for arranging transportation, providing adequate labor and equipment, and safely removing their purchases. Bidders purchasing large, heavy, or bulky items should bring sufficient help and appropriate equipment.
Items may not be removed until payment has been received in full.
Items not removed within the deadline specified in the auction listing may be considered abandoned and forfeited, subject to applicable law. M & M Auction Services reserves the right to arrange for the disposal or resale of abandoned items as permitted by law.
M & M Auction Services is not responsible for damage to property or personal injury resulting from a bidder’s removal activities, except where responsibility cannot legally be excluded.
5. Shipping
Unless specifically stated in an auction listing, shipping is not available. Bidders should review the pickup and removal requirements before placing a bid.
6. Responsibility for Purchased Items
Responsibility for purchased items transfers to the winning bidder upon completion of the sale, subject to applicable law. Bidders are responsible for ensuring that their purchases are properly secured, transported, and removed.
M & M Auction Services will make reasonable efforts to safeguard items while they remain in its custody but does not assume responsibility for loss or damage beyond its legal obligations.
7. Online Auction Procedures
Online auctions operate according to the opening and closing times stated in the applicable auction listing. Bidders are responsible for monitoring their bids and ensuring that their account information is accurate.
M & M Auction Services is not responsible for technical difficulties experienced by bidders, including internet outages, device malfunctions, or interruptions in a bidder's ability to access the auction platform.
M & M Auction Services reserves the right to extend, pause, cancel, or otherwise modify an auction when circumstances warrant, including technical problems or errors that could affect the fairness or integrity of the sale.
8. Sales Tax and Legal Compliance
Applicable Arizona and other legally required taxes will be charged as required by law. Bidders are responsible for providing accurate registration, billing, and tax-exemption information when applicable.
All bidders must comply with applicable federal, state, and local laws governing the purchase, possession, transportation, and use of auction items.
9. Auction Changes and Errors
M & M Auction Services reserves the right to correct typographical errors, clarify item descriptions, withdraw items, or make reasonable changes to auction procedures when necessary.
If a material error occurs that could affect the validity or fairness of a sale, M & M Auction Services reserves the right to take appropriate corrective action, subject to applicable law.
10. Limitation of Liability
To the extent permitted by law, M & M Auction Services shall not be liable for indirect, incidental, or consequential damages arising from participation in an auction or the purchase, possession, use, or transportation of an item.
Nothing in these Terms and Conditions excludes or limits liability that cannot legally be excluded or limited under applicable law.
11. Governing Law
These Terms and Conditions shall be governed by the laws of the State of Arizona. Any legal proceedings shall be brought in a court of competent jurisdiction as permitted by applicable law.
