These Conditions of Business for auctions conducted by After Market Capital consist of:

Information for Buyers
Terms of Consignment (for Sellers)
Terms of Sale (for bidders and buyers)

By registering to bid or placing a bid in any After Market Capital auction, whether in person, online, or by other means, you agree to the following terms.

CONDITIONS OF SALE

These Conditions of Sale, together with any Important Notices and Catalog Descriptions, set forth the terms under which lots are offered for sale.

Unless specifically stated otherwise in the catalog listing, After Market Capital acts solely as agent for the seller. This means After Market Capital is providing services to assist sellers in offering property for sale. When acting as agent, the contract of sale is formed directly between the buyer and the seller, and not between the buyer and After Market Capital.

CONDITION OF LOTS

The condition of lots offered in auction may vary widely due to factors such as age, prior use, damage, restoration, repair, and normal wear.

All lots are sold ?AS IS, WHERE IS?, with all faults and imperfections. Neither After Market Capital nor the seller makes any warranty or representation regarding the following, unless explicitly stated in the auction details:

authenticity
attribution
provenance
age
origin
quality
or completeness

While we strive to describe items accurately, catalog descriptions, condition reports, photographs, and other information are provided for guidance only and represent opinions rather than guarantees.

Prospective buyers are strongly encouraged to inspect items in person or through a qualified representative prior to bidding.

Condition reports may be available upon request but are not a substitute for personal inspection and may not note every flaw or restoration.

VIEWING

Public viewing or preview opportunities may be offered prior to the auction. Buyers are encouraged to inspect lots during these preview periods.
It is the bidder?s responsibility to determine the condition, authenticity, and suitability of any lot prior to bidding.

ESTIMATES

Pre-sale estimates provided in catalogs or listings are opinions only and are based on market conditions, rarity, condition, and comparable auction results.

Do not include the buyer?s premium
Are not guarantees of selling price or value

WITHDRAWAL OF LOTS

After Market Capital reserves the right to:
Withdraw any lot prior to or during the auction
Combine or divide lots
Change the order of lots
After Market Capital shall not be liable for any withdrawal.

BIDDER REGISTRATION

All bidders must register prior to participating in the auction.
After Market Capital may require:
Government-issued photo identification
Proof of address
Credit card verification
Financial references or deposits
After Market Capital reserves the right to approve or deny any bidder registration at its sole discretion.
Failure to provide required documentation may result in denial of bidding privileges or cancellation of a winning bid.

BIDDING METHODS

Bids may be accepted through:
Online bidding platforms (including LiveAuctioneers)
Absentee bids
Telephone bids (if offered)
In-person bidding (when applicable)
These services are offered as a convenience and After Market Capital is not responsible for errors, interruptions, or failures in internet or telephone bidding systems.

BIDDING ON BEHALF OF ANOTHER PERSON

If bidding on behalf of another individual or entity:
Written authorization may be required
The registered bidder assumes full financial responsibility for payment unless otherwise approved in advance

CONDUCT OF THE AUCTION

The auctioneer has full discretion to:
Reject any bid
Advance bidding increments
Resolve bidding disputes
Reopen bidding if necessary
Determine the successful bidder
The auctioneer?s decision is final.

RESERVES

Unless otherwise stated, lots may be offered subject to a reserve price, which is the confidential minimum price agreed upon between the seller and After Market Capital.
The auctioneer may bid on behalf of the seller up to the reserve price.

SUCCESSFUL BIDS

When the auctioneer?s hammer falls (or the online equivalent closes), a binding contract of sale is created between the buyer and the seller.
The winning bidder assumes full responsibility for payment and collection of the lot.

BUYER?S PREMIUM AND TAXES

A buyer?s premium will be added to the hammer price of each lot. The buyer?s premium rate will be published on the auction listing and may vary depending on the platform used.
Additional charges may include:
Applicable sales tax
Online platform fees
Shipping, handling, and insurance
Storage fees (if applicable)
Buyers are responsible for complying with all applicable tax laws.

PAYMENT TERMS

Payment is due within the time period stated on the invoice (typically within 72 hours of the auction unless otherwise stated).
Accepted payment methods may include:
Wire transfer
Credit card
Approved electronic payment methods
Cash upon pickup

After Market Capital reserves the right to refuse certain payment methods for high-value transactions.

TRANSFER OF OWNERSHIP

Ownership of the lot does not transfer to the buyer until full payment has been received and cleared.
Risk of loss passes to the buyer when the lot is collected or when the designated pickup period expires.

FAILURE TO PAY

If the buyer fails to pay within the required timeframe, After Market Capital may:
Cancel the sale
Resell the lot
Charge interest on overdue balances
Retain deposits
Ban the bidder from future auctions
Pursue legal action for recovery of damages
Any costs associated with resale or collection efforts may be charged to the defaulting bidder.

COLLECTION AND STORAGE

Buyers must arrange collection of purchased lots within the specified pickup period.
If lots are not collected within the allotted time, After Market Capital may:
Charge storage fees
Move the lot to a third-party storage facility at the buyer?s expense
Resell the lot to recover costs

SHIPPING

Shipping arrangements are the responsibility of the buyer unless otherwise arranged with After Market Capital.
After Market Capital may recommend or facilitate third-party shipping services but is not responsible for the actions or performance of those companies.


EXPORT AND IMPORT

Buyers are responsible for complying with all laws regarding export or import of purchased property.
After Market Capital is not responsible for delays, seizures, permits, or licensing issues related to international shipping.

LIMITATION OF LIABILITY

To the fullest extent permitted by law:
After Market Capital shall not be liable for any indirect or consequential damages.
Liability, if any, shall not exceed the purchase price paid for the lot.

RECORDINGS

After Market Capital may photograph, record, or livestream auctions for security and marketing purposes.
By participating in an auction, bidders consent to such recordings.

COPYRIGHT

All catalog text, photographs, and images produced by After Market Capital remain the intellectual property of After Market Capital and may not be reproduced without written permission.

GOVERNING LAW

These terms shall be governed by the laws of the State of California unless otherwise stated.
Any disputes arising from an auction shall be resolved in the appropriate courts of California.
