**Please read all terms before bidding.**
Gold Country Treasures conducts online auctions through LiveAuctioneers. By registering for an auction or placing a bid, each bidder agrees to these terms, the auction-specific notices and lot restrictions, and applicable LiveAuctioneers rules, subject to governing law.
### 1. Merchandise condition as is, where is
All merchandise is offered **AS IS, WHERE IS, WITH ALL FAULTS**, without warranties or guarantees, express or implied, to the fullest extent permitted by law.
Most merchandise is previously owned and may exhibit wear, aging, repairs, alterations, imperfections, missing components, or other conditions that are not specifically described. Gold Country Treasures makes reasonable efforts to provide useful descriptions and photographs, but descriptions, measurements, dates, age estimates, attributions, authenticity opinions, and condition assessments are good-faith opinions rather than guarantees.
Bidders are responsible for evaluating merchandise before bidding. Review every photograph and request additional information or an inspection when a fact is important to your decision.
**All sales are final.** Returns, cancellations, and refunds are not offered for buyer's remorse, change of mind, failure to inspect, or failure to read the listing. Nothing in these terms limits a right or remedy that cannot lawfully be waived.
### 2. Preview and inspection
Previews may be available by appointment. Virtual review or additional photographs may be provided when practical. Questions about identity, condition, measurements, completeness, or fulfillment should be submitted before bidding.
### 3. Buyer's premium and taxes
A **20% buyer's premium** is added to the hammer price of every lot. Applicable sales tax and disclosed packing, shipping, handling, freight, insurance, storage, transfer, or other charges are additional.
Taxes will be collected as required by law and reflected on the invoice. Buyers claiming a valid exemption must provide acceptable documentation within the time required for invoice processing.
### 4. Bidding and no-reserve policy
Gold Country Treasures does not use hidden reserve prices. Each lot's opening bid is the minimum acceptable selling price. After the opening bid is accepted, the lot will sell to the highest accepted bidder when bidding closes, subject to applicable auction rules.
Gold Country Treasures does not place artificial bids or bid on behalf of a consignor to reach an undisclosed reserve. We may reject improper bids, correct catalog or administrative errors, resolve bidding disputes, or withdraw a lot before bidding begins, consistent with applicable law and LiveAuctioneers rules.
Bidders are responsible for reviewing bid amounts before submission. Bid-retraction or cancellation requests are governed by applicable law and LiveAuctioneers rules.
### 5. Payment
Payment is due within **72 hours after the auction closes**. The accepted method may depend on invoice amount, merchandise type, payment history, and transaction risk. Eligible unpaid invoices may be processed through LiveAuctioneers Autopay according to the auction's payment settings and the bidder's authorization.
Special payment and transfer procedures apply to firearms and ammunition. All funds must clear before merchandise is released, shipped, or collected. See the auction's Payment Instructions for complete requirements.
### 6. Shipping and freight
Gold Country Treasures offers nationwide parcel and freight shipping and will ordinarily coordinate fulfillment unless the buyer makes approved independent arrangements. Buyers are responsible for all packing, handling, shipping, freight, crating, insurance, and related charges.
Shipping estimates are not guarantees. Final costs depend on the completed package, destination, service, and carrier. Merchandise will be released only after payment and fulfillment arrangements are complete. See the auction's Shipping Policy for complete requirements.
### 7. Local pickup, removal, and storage
Standard pickup days are **Tuesday, Thursday, and Saturday from 10:00 a.m. to 3:00 p.m.** Pickup at another time may be arranged by appointment. All pickups must be scheduled in advance; please provide at least **24 hours' notice** when requesting an appointment outside the standard pickup windows.
Buyers must supply suitable vehicles, packing materials, equipment, and labor. Loading assistance is not guaranteed. Merchandise not collected on the agreed pickup date, and held without an approved extension, may incur a **$25-per-day storage charge**. After appropriate notice, unclaimed merchandise may be relocated or handled through lawful storage and disposition procedures.
No merchandise will be released until payment has cleared. Third-party pickup requires advance authorization.
### 8. Firearms and ammunition
All firearm and ammunition transactions are subject to applicable federal, state, and local law and to Gold Country Treasures' auction policies.
As a Gold Country Treasures business policy, firearms are not sold to California residents or completed as California firearm sales. Firearms are offered only to eligible out-of-state buyers and must be shipped to a Federal Firearms Licensee legally authorized to receive the firearm and complete the transfer.
Ammunition must be delivered through a recipient legally authorized to receive and process the transaction in the buyer's jurisdiction. Gold Country Treasures does not ship ammunition directly to residential addresses. California ammunition deliveries require an authorized California ammunition vendor, dealer, or other legally exempt recipient; an FFL alone may not establish authorization to conduct the ammunition transfer.
Before bidding, buyers must confirm their eligibility, the legality of the merchandise in the destination jurisdiction, and the receiving dealer's requirements. Buyers are responsible for all dealer, transfer, processing, background-check, shipping, and related fees. No prohibited transaction will be completed, and restricted merchandise will not be released until every applicable requirement has been satisfied.
### 9. Catalog information and estimates
Descriptions, photographs, condition statements, attributions, measurements, and estimates are provided in good faith. Estimates are opinions intended to assist bidders; they do not guarantee authenticity, resale value, or a particular selling price. Actual selling prices may be higher or lower.
### 10. Winning bids and nonpayment
The highest accepted bidder when a lot closes becomes the winning bidder. A winning bid creates a binding purchase obligation, subject to applicable law.
The winning bidder is responsible for the hammer price, buyer's premium, applicable taxes, fulfillment expenses, and other disclosed charges. Nonpayment may result in transaction cancellation, loss of bidding privileges, reporting through LiveAuctioneers, or other lawful remedies.
### 11. Transportation, loss, and damage
Buyers are responsible for arranging timely pickup or shipping. Independent packers and carriers are responsible for their respective services. Shipping loss or damage should be reported promptly so any available carrier or insurance claim can be pursued. Responsibility remains subject to applicable law and the agreed fulfillment arrangements.
Buyers and their representatives must follow reasonable safety requirements at pickup and loading locations.
### 12. Unavailable merchandise
If purchased merchandise becomes unavailable through circumstances not attributable to the buyer, Gold Country Treasures will refund the amount paid for that merchandise and any associated charges that must be refunded under applicable law. This will be the available remedy to the fullest extent permitted by law.
### 13. Auction administration
Subject to applicable law, Gold Country Treasures may reject registrations or bids for legitimate business or security reasons; resolve disputed bids; correct catalog or administrative errors; withdraw merchandise before bidding begins; suspend fraudulent, abusive, or nonpaying bidders; and take reasonable steps to protect auction integrity.
Applicable LiveAuctioneers rules and governing law control any bidding dispute.
### 14. Governing law and disputes
These terms are governed by applicable California law. Buyers should contact Gold Country Treasures promptly so transaction questions or disputes can be addressed in good faith. Any formal proceeding remains subject to applicable law, jurisdictional requirements, and controlling LiveAuctioneers terms.
Nothing in these terms limits consumer rights or remedies that cannot lawfully be waived.
### 15. Communications
Buyers agree to receive communications reasonably necessary to complete the auction transaction, including invoices, payment notices, pickup instructions, shipping information, and order updates. Optional promotional communications may be declined or unsubscribed from where applicable.
### 16. Acceptance
By registering, participating, or bidding, the bidder acknowledges having reviewed and accepted these terms. Auction-specific announcements and lot restrictions may impose additional requirements.
Gold Country Treasures may revise its terms for future auctions. Any material change affecting an active auction will be handled in accordance with applicable notice requirements and LiveAuctioneers rules.
