1. BINDING TERMS

The lots listed in this catalogue will be offered by Harbor Auction Inc as owner or as agent for the consignor, subject to the following terms and conditions. Where Harbor Auction Inc is agent, the contract is between the seller and the buyer. These Conditions of Sale and Terms of Guarantee constitute the entire agreement with the purchaser regarding the property listed in this catalogue. By bidding at auction, you agree to be bound by these terms.

2. AS IS

All lots are sold ?AS IS? and without recourse. Neither Harbor Auction Inc nor its consignor makes any warranties or representations, express or implied, except as expressly stated in the Terms of Guarantee.

Except as otherwise specifically provided, Harbor Auction Inc and its consignor make no warranty regarding merchantability, fitness for a particular purpose, correctness of catalogue descriptions, physical condition, size, quality, rarity, importance, medium, material, genuineness, attribution, provenance, period, culture, origin, exhibition history, literature, or historical significance.

The absence of reference to a lot?s condition does not imply that it is perfect or free from wear, imperfections, or aging. References to certain defects do not imply the absence of others. All statements in the catalogue or condition report are opinions, not statements of fact.

Harbor Auction Inc makes no warranty that the buyer acquires copyright or reproduction rights. Harbor Auction Inc reserves all rights to images and catalogue content.

3. WITHDRAWAL

Harbor Auction Inc reserves the right to withdraw any lot at any time prior to bidding and shall have no liability for doing so.

4. RESERVES

The auctioneer may reject an opening bid below the lot?s value. Unless stated otherwise, all lots are subject to a reserve (a confidential minimum price). No reserve shall exceed the low estimate.

The auctioneer may bid on behalf of the seller up to the reserve. Seller bidding through Harbor Auction Inc is not permitted unless noted.

5. ESTIMATES

Catalogue estimates represent a fair auction range in Harbor Auction Inc?s opinion. Estimates may change based on further research or market conditions. Actual prices may fall above or below estimates. Estimates do not include the buyer?s premium.

6. BIDDING

Harbor Auction Inc reserves the right to refuse admission, participation, or any bid. The highest bidder acknowledged by the auctioneer is the purchaser.

The auctioneer may:

advance bidding at their discretion,

withdraw or divide lots,

combine lots,

resolve disputes at their sole discretion.

In case of dispute after the sale, Harbor Auction Inc?s records are conclusive.

7. PURCHASER?S RESPONSIBILITY

Title passes upon the fall of the hammer. The buyer assumes full risk and responsibility thereafter. Harbor Auction Inc is not responsible for errors in absentee or telephone bids.

8. REMEDIES AVAILABLE TO HARBOR AUCTION INC

If payment is not made as required, Harbor Auction Inc may impose:

interest at 1.5% per month;

storage fees of $5 per lot per day after two business days;

delivery of property to a warehouse at the buyer?s expense.

Harbor Auction Inc may also:
a) charge interest;
b) hold the buyer liable and pursue legal action;
c) cancel sales and retain payments as liquidated damages;
d) resell the property and hold the buyer liable for deficiencies and expenses;
e) set off outstanding debts;
f) apply payments at its discretion;
g) reject the buyer?s future bids;
h) take other necessary actions;
i) or any combination of the above.

The buyer grants Harbor Auction Inc a security interest in any property or money held by Harbor Auction Inc.

9. LIMITED LIABILITY

If a purchased lot cannot be delivered in the same condition as at sale, or is stolen, mis-delivered, or lost before delivery, Harbor Auction Inc is liable only up to the amount paid.

Harbor Auction Inc is not responsible for acts of carriers. Packing and handling are at the buyer?s risk.

10. WAIVER OF CONDITIONS

Any condition may be waived or modified at Harbor Auction Inc?s sole discretion.
Announcements during the sale supersede printed catalogue descriptions.

All measurements and weights are approximate. Harbor Auction Inc is not responsible for damage to glass or frames, regardless of cause.
