By placing a bid with Armanis Inc online, you agree to be bound by the following terms and conditions. Armanis Inc may amend or modify these conditions at any time at its sole discretion.
1) Condition of Items
All property is sold as is and all sales are final. Neither Armanis Inc nor its consignors make any warranties or representations regarding authenticity, authorship, condition, age, or provenance. Descriptions and photos are provided for reference only. Normal wear consistent with age is expected, particularly for antique items.
Armanis Inc is not responsible for any errors, omissions, or variations in online images. Buyers are encouraged to inspect items or request additional information before bidding.
2) Bidding
The highest bidder acknowledged by the auctioneer is the buyer. Armanis Inc reserves the right to reject any bid, resolve disputes, withdraw lots, or reoffer any item at its discretion. The auctioneer?s record of sale is final and conclusive.
3) Reserves
Unless stated as without reserve, each lot may carry a confidential minimum price. Armanis Inc or its representatives may bid on behalf of consignors to meet reserves. No ?buy? bids are accepted.
4) Internet Bidding Disclaimer
By using third-party bidding platforms, bidders agree to indemnify and hold Armanis Inc and its consignors harmless from any claims, losses, or damages resulting from use of such services. Armanis Inc is not liable for lost profits, technical issues related to online bidding, transmission failures or failure to execute bids.
5) Title & Liability
Title to each lot passes to the winning bidder when the auctioneer?s hammer falls. Armanis Inc?s liability to any purchaser will not exceed the purchase price actually paid.
6) Buyer?s Premium & Taxes
A 28% buyer?s premium will be added to all purchases. Sales tax will apply unless a valid resale certificate is provided. Out-of-state internet buyers are exempt unless items are picked up in person.
7) Payment
Invoices must be paid in full within 3 business days of auction close. Accepted payment methods include Visa, Discover, and American Express, as well as wire transfer or check.
For security, credit card payments are limited to $3,000 per invoice. Balances above this amount require payment by wire transfer or check. Items may not be released until full payment clears.
8) Shipping & Storage
Buyer Pays Shipping Cost.
Buyers arrange shipping with LiveAuctioneers.
Armanis Inc will store purchased items free of charge for up to 7 business days after the auction. After this period, storage fees start at $15 per lot per day, depending on the size and handling requirements of the item. If an item remains uncollected for 30 days after the auction, it will be considered abandoned. Armanis Inc reserves the right to relist, or resell without further notice, and no refunds will be issued.
9) Default
If the buyer fails to comply with these terms, Armanis Inc may hold the buyer liable for the total purchase price, retain any deposits, or resell the property at the buyer's expense.
10) Arbitration
Any disputes or claims arising from participation in this auction must be resolved by final and binding arbitration under California law. By bidding, the buyer waives the right to bring claims in court or request a jury trial. The prevailing party may recover reasonable attorney's fees and costs.
