The following together with or as amended by any posted notices or verbal announcements made during an auction constitute the entire terms and conditions on which property shall be offered for auction sale by HUEY Interiors referred to as Auctioneer or Auction House and any consignor of such property referred to as Seller collectively referred to as WE and or US for whom we act as agent. Registering to bid or attending the auction indicates full understanding and acceptance of these terms and agreement to be bound by them. GOVERNING AUTHORITIES These terms control this auction in all regards. Auctioneer is acting solely as agent for the Seller. This agreement is governed by the laws of the State of California. REGISTRATION Bidders must register and provide proper identification. Auctioneer reserves the right to refuse registration or require removal from the site for any disruptive or illegal conduct including bid rigging or tampering with lots. BUYERS PREMIUM A Twenty five Percent 25 percent Buyers Premium is in effect. A surcharge of 25 percent will be added to the hammer price to determine the final selling price. WARRANTIES AND AS IS STATUS Each lot is sold AS IS WHERE IS with all defects and faults. In accordance with California Civil Code there are no warranties of merchantability or fitness for a particular purpose. Good condition denotes a status expected for the items age and use and does not imply perfection. All measurements are approximate. NO REFUNDS All sales are final. No refunds no returns no exchanges. BIDDING The highest bidder recognized by the Auctioneer will be the Buyer. A contract is formed immediately upon the fall of the hammer. We reserve the right to withdraw any lot or determine minimum bid increments. SALES TAX The current sales tax rate for San Diego CA currently 7.75 percent will be added to all purchases. Sales tax will be waived only if a valid California Resale Certificate CDTFA 230 is provided and verified prior to payment. SHIPPING AND REMOVAL Packing and shipping are the sole responsibility of the Buyer. Lots remaining on premises 10 business days after the auction will incur a storage charge of 10 dollars per lot per day. Items remaining after 30 days may be sold to settle storage debts. LIABILITY Persons attending the auction assume all risks of injury or damage. HUEY Interiors and the Seller have no liability for injury death or loss of property at the auction site. DISPUTE RESOLUTION AND VENUE Exclusive venue for any controversy or claim shall be in the County of San Diego California. All claims must be resolved by final and binding arbitration in San Diego. The parties voluntarily waive their rights to a trial by jury. The prevailing party shall be entitled to recover costs and reasonable attorney fees. BID RIGGING In accordance with Title 15 Section 1 of the US Code any agreement among bidders to dampen the bidding process is a felony. Any such conduct will be reported to the US Attorney and the Department of Justice.
