MONTEVEX AUCTION TERMS AND CONDITIONS
Effective October 26, 2026

These terms apply to every lot Montevex offers on LiveAuctioneers, in a live or timed sale and in any Buy Now or Make Offer listing that follows it. By registering for a Montevex sale or placing a bid, you agree to them. LiveAuctioneers' own terms of use also apply to your use of its site.

1. WHO WE ARE AND WHAT WE SELL
1.1 Montevex, a California corporation based in Los Angeles ("Montevex", "we"), offers the lots in its sales. These terms apply to every lot, whatever its source, and each lot's description says what it is.
1.2 Each lot's condition is stated in its description. A lot described as new has not been worn.
1.3 Laboratory-grown diamonds and gemstones are always described as laboratory-grown (or lab-grown). They have essentially the same physical, chemical, and optical properties as mined stones, but they are not mined. A stone described without that word is natural.

2. BIDDING
2.1 Bids are placed through LiveAuctioneers. When a lot closes, the highest bid we accept is a binding contract to buy that lot on these terms.
2.2 Montevex may refuse any bid or bidder, withdraw a lot before it closes, and correct an error in a description before the lot closes. A correction is posted on the lot before it closes.
2.3 Lots may carry a confidential reserve, the lowest price at which we will sell. A lot that does not reach its reserve is not sold.
2.4 Montevex, its owners, employees, and their households do not bid on Montevex lots, and no one bids on our behalf. We do not announce or accept bids that no bidder made.
2.5 If two bidders dispute a winning bid, Montevex decides, using LiveAuctioneers' bid records, and may re-offer the lot.

3. BUYER'S PREMIUM, TAX AND PAYMENT
3.1 A buyer's premium of 20% of the hammer price is added to each lot's invoice.
3.2 For purchases paid through LiveAuctioneers, LiveAuctioneers calculates, collects, and remits sales tax for the buyer's destination where it does so. Tax may apply to the hammer price, shipping and handling, and in some states the buyer's premium.
3.3 Payment is made only through LiveAuctioneers. Montevex does not take payment by any other means and will never ask you to pay outside LiveAuctioneers.
3.4 Payment is due within 3 business days of the invoice. If payment is not made, Montevex may cancel the sale, offer the lot to the next bidder or in a later sale, report the non-payment to LiveAuctioneers, and refuse future bids from the buyer.
3.5 Title passes to the buyer when payment is received in full.

4. WHAT MONTEVEX GUARANTEES
4.1 We stand behind our descriptions. We guarantee that each lot matches its description in these respects (the "Montevex Guarantee"):
(a) Metal: the metal and karat or fineness stated, within the tolerances of the National Gold and Silver Marking Act.
(b) Stones: the identity of each stone, whether it is natural or laboratory-grown, and any treatment we state.
(c) Weights: a carat weight stated without "approximately" is accurate to its last decimal place. Weights stated as "approximately" are not exact: they are estimates, for example, of many small stones set together, and the actual total weight is within 5% of the stated weight.
(d) Maker: a maker or signature stated as fact (for example, "signed") is correct; "in the style of" or "attributed to" is an opinion.
4.2 Other statements are our opinion, made in good faith: grades of color and clarity for stones that are set (which cannot be graded exactly while mounted), estimates, and descriptions of style. A grading report from a laboratory named in the description is that laboratory's opinion, not ours.
4.3 Where a description shows a "Retail price", it is the price at which Montevex has regularly offered that design for sale at retail. Where it shows a "Comparable retail price", it is the price at which other retailers have regularly offered the same or an essentially similar piece. Montevex keeps a record of the basis for each figure. Either figure is given for comparison only and is not a guarantee: it is not an appraisal or a statement of what the piece is worth, and it does not predict what the piece will bring at auction; many lots sell well below it.
4.4 Appraisals and lab reports. Each laboratory-grown diamond over 1 carat comes with a grading report from IGI (International Gemological Institute), at no charge. On request, Montevex also provides, at no charge, a written appraisal of a purchased lot for insurance purposes, prepared by an independent qualified gemologist named on the appraisal. An appraisal states an estimated retail replacement value for insuring the piece. It is not the price the piece would bring at auction or on resale, it is not part of the lot's description, and it does not extend the Montevex Guarantee. Appraisals and lab reports are the opinions of the appraiser and the laboratory, not of Montevex.
4.5 Photos show the design. The photos may show another piece of the same design, and pieces of one design may differ in size (for example, ring size, length, or total carat weight) even though they look alike. Each lot's description gives that piece's own size and weights; where it differs from what a photo suggests, the description governs.
4.6 If a lot does not match the Montevex Guarantee, tell us within 30 days of delivery. Once we receive the piece back as delivered, we refund the full amount paid for it, including the buyer's premium, shipping, and tax, or, if you prefer, replace it.

5. WORKMANSHIP
For one year after delivery of a lot described as new, Montevex will repair or replace, at its choice and cost, a piece with a defect in materials or workmanship (for example, a failed clasp or a stone loosened in normal wear). This does not cover wear, damage, loss, resizing, or work done by anyone other than Montevex.

6. NO OTHER WARRANTIES
Except for the Montevex Guarantee and the workmanship promise above, Montevex makes no other express warranties. Any implied warranty, including the implied warranty of merchantability and of fitness for a particular purpose, is limited in duration to the period of the workmanship promise, to the extent the law allows.

7. RETURNS
7.1 Apart from the Montevex Guarantee, the workmanship promise, and damage in transit (section 8), all sales are final.
7.2 Montevex may accept another return at its sole discretion. To ask, write to us through LiveAuctioneers or at montevex2026@gmail.com within three (3) days of delivery, saying why. If we accept, we refund the hammer price and buyer's premium less a restocking fee of 20% of the hammer price; shipping both ways is not refunded.
7.3 Every return needs our written authorization first and must be sent insured, with signature required, to the address we give. A return we did not authorize is refused and sent back at the sender's cost.
7.4 A returned piece must arrive as it was delivered: unworn, unaltered, not resized, with its tags, packaging, and any grading report. Otherwise, we send it back at the buyer's cost.
7.5 Refusing a delivery is an unauthorized return.
7.6 Please contact us before disputing a charge with your card issuer; we answer every request within 2 business days.

8. SHIPPING, INSURANCE, AND RISK OF LOSS
8.1 We ship within 5 to 7 business days after payment clears, by UPS, FedEx, or LiveAuctioneers' LiveShipping, insured, with a signature required on delivery.
8.2 We ship only to the address on the buyer's LiveAuctioneers account and may refuse to change it after payment.
8.3 Each shipment is insured for the full amount paid for its pieces. Shipping and insurance are charged at our actual cost.
8.4 The piece is at Montevex's risk until it is delivered and signed for. If it is lost or arrives damaged, report it within 2 days of delivery and keep all packaging. We refund the full amount paid or replace the piece; we do not make you wait for the carrier's claim.
8.5 If we ship outside the United States, the buyer pays all import duties, taxes, and brokerage fees, is responsible for their country's import rules, and accepts that carriers may limit insurance to some destinations.

9. BUY NOW AND MAKE OFFER AFTER A SALE
A lot that does not sell may be offered on LiveAuctioneers for 14 days afterward at a Buy Now price, or by Make Offer. These terms apply to those sales; the price and any buyer's premium are as shown on the listing.

10. LIMIT OF LIABILITY
Montevex's liability for any lot is limited to the amount the buyer paid for it. Montevex is not liable for indirect or consequential losses, except where the law does not allow this limit.

11. GENERAL
11.1 These terms are governed by the laws of the State of California, and disputes are heard in the courts of Los Angeles, California.
11.2 If any part of these terms is unenforceable, the rest stands.
11.3 Montevex may change these terms for future sales. Any change for a sale is posted before that sale starts.
11.4 Photos and descriptions are Montevex's and may not be reused without our permission.
