These Terms and Conditions ("Terms") govern all online purchases made by buyers ("You" or "Buyer") through the Specialty Home Services ("Company", "We", "Us") online platform (the "Platform"), including but not limited to our website, third-party sales accounts, and associated social media channels. By registering, bidding, offering, or purchasing items, you agree to be bound by these Terms.
1. General Provisions
Acceptance: By using the Platform and participating in a sale, you agree to these Terms and any specific conditions announced for a particular sale.
Capacity: You must be at least 18 years old and capable of forming a binding contract to use this service.
Modification: We reserve the right to change these Terms at any time. Changes will be posted on the Platform and become effective immediately. Your continued use of the Platform constitutes acceptance of the modified Terms.
2. Item Description and Condition
"As-Is, Where-Is": All items are sold "AS-IS, WHERE-IS" with no guarantees, warranties, or refunds of any kind, express or implied.
Due Diligence: It is the sole responsibility of the Buyer to inspect or inquire about the condition, authenticity, size, and completeness of an item before purchasing.
Descriptions: Descriptions and photographs are provided as a guide only. They are based on opinion and are not a statement of fact. The Company is not responsible for errors or omissions in the descriptions.
Condition: Items are often antique, vintage, or pre-owned and may show signs of wear consistent with age and use. The absence of a condition statement in the description does not imply that the item is in perfect condition.
3. Pricing, Bidding, and Purchases
Pricing: Items may be offered at a fixed price, subject to offers, or via an online auction/bidding process.
Bidding/Offering: By placing a bid or making an offer, you are entering into a legally binding contract to purchase the item if your bid/offer is accepted.
Winning: In an auction format, the highest bid confirmed by the Platform at the close of the sale is the winning bid.
Payment Requirement: You are required to pay the full purchase price, plus any applicable taxes and fees (e.g., Buyer's Premium, if noted).
4. Payment
Currency: All payments must be made in US Dollars (USD).
Accepted Payment Methods: Payment must be made using the methods specified by the Platform credit card, Venmo, Zelle.
Time Limit: Payment is due immediately upon the close of an auction or acceptance of an offer/purchase commitment from the time of purchase notification.
Failure to Pay: If payment is not received within the specified time, the Company reserves the right to deem the sale void, relist the item, and pursue all available legal remedies against the Buyer, including banning the Buyer from future sales.
5. Sales Tax
Sales Tax: Applicable local and state sales tax will be collected on all purchases unless the Buyer provides a valid, current resale certificate prior to payment.
6. Pickup and Shipping
Transfer of Title: Title and risk of loss pass to the Buyer upon full payment for the item, regardless of when the item is collected or shipped.
Pickup (If offered):
Schedule: Pickup must be completed by the Buyer or their agent on the date(s) and time(s) specified for the sale.
Responsibility: Buyers are solely responsible for the safe and efficient removal of their purchased items, including providing necessary labor, tools, and transportation.
Shipping (If offered):
Arrangement: Shipping is not handled directly by the Company unless explicitly stated. The Buyer is responsible for arranging and paying for all packing, shipping, and insurance.
Third-Party Shippers: We may provide a list of recommended third-party shippers, but we assume no responsibility for their services, costs, or any damage incurred during packing or transit.
7. Remedies for Non-Compliance
Breach: If the Buyer breaches any of these Terms, the Company may, in addition to any other remedies:
Cancel the sale and retain all payments made.
Resell the item to another party without notice to the original Buyer.
Charge the Buyer a minimum 25% restocking fee on the purchase price.
Prohibit the Buyer from participating in future sales.
8. Limitation of Liability
The Company's liability to the Buyer for any claim arising out of a sale shall not exceed the purchase price actually paid for the item. The Company shall not be liable for any incidental, consequential, special, or indirect damages.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of [Insert State of Company Operation], without regard to its conflict of law provisions.
Buyer Acknowledgement
By proceeding with a purchase, you acknowledge that you have read, understand, and agree to abide by all of the Terms and Conditions set forth herein.
