The conditions listed for this sale are dependent upon how you participate. If you participate through Lloyd Ralston Gallery directly by attending the auction or mail or phone bidding, you will find the Conditions of Sale on our website. If you participate in the auction through Live Auctioneers, Invaluable, Auction Zip you will find the Conditions of Sale at that website. Please make sure you read fully the Conditions which will apply to you. We will hold to them completely.
Live Auctioneers and Invaluable bidders: Please do not wait until the auction has started to register to bid. We cannot process your registration during the auction as it frequently interferes with the auction program resulting in delays. If you want to participate during the auction and haven't registered before hand, you must phone the gallery (203) 924-5804 and set up a phone or mail bid.
- The auctioneers have endeavored to correctly catalog and describe the property being sold, but all property is sold as is. The auctioneers reserve the right to make verbal corrections and provide additional information from the block at the time of sale. All trains and toys are sold as untested and are not
guaranteed to run unless otherwise noted in the lot description. Play sets and games are only guaranteed to be complete if stated as so in the description.
- Lego Sale notes: Open boxes are assumed to be complete unless otherwise noted. If you discover a missing brick after the sale, please contact us.
- The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, the auctioneers shall have absolute discretion as to who was the successful bidder or he may re-offer the disputed item for sale, if he so wishes. Please be aware that because of the bidding system that Live Auctioneers uses, you can lose a lot for the amount you have bid. If the auctioneer accepts a bid from an attending bidder or phone bidder before the internet bid, even if it is for the same amount, the item will sell to the attending bidder as Live Auctioneers cannot bid more than you authorized. Also, Lloyd Ralston Gallery has absolutely no access to your internet bid until it comes up on the screen as the item is being auctioned. We do not know who is bidding on a lot and cannot manipulate or run your bid. Live Auctioneers only supplies your bid's next increment as it is needed. If you participate with us directly by mail bidding, we will bid one more increment for you only if you are going to lose the item for the exact amount of your bid. In the event of bids that tie with other bids the computer selects first bidder to enter the amount. Be aware multiple platforms are participating and the first bid to come through is always excepted.
- All bidders must pay in full by the due date on your e-mail invoice. If you have no intention of paying for any lots purchased, please don't bid. We will file a dispute with Live Auctioneers which could affect your ability to bid in any future auctions with both us and other Live Auctioneers sellers. Auctioneers do check with other auctioneers regarding disputes and non-payments.
- The auctioneers will accept a US Money Order for US dollars, a US check for US dollars, PayPal, or a credit card paid directly to us (Visa, MasterCard, Discover or American Express) or a bank wire transfer as payment of each purchaser's account. There is a 22% Buyer's Premium for Live Auctioneers buyers no matter what the payment method is. If you participate through us directly, the buyer's premium is 20% for payments made by credit card or Paypal. The buyer's premium is a fee charged to the buyer on each lot that is purchased. This fee exists because we are a brick and mortar company that sells items taken in on consignment - we do not own the items for sale. We charge the owner a fee for selling the items for them just as we charge the buyer. The buyer's premium is arrived at by factoring in the fees charged to us by Live Auctioneers, PayPal and our credit card service.
- Internet bidders who live in Connecticut and attending bidders are subject to the Connecticut .635% sales tax unless the bidder possesses a Sales Tax Exemption Number from any US state.
- All sales are final. There will be no refunds issued beyond 30 days after the auction. We pay our consignors 30 days after the auction which means that if you have a legitimate problem with an item, you must let us know beforehand. Please bear this in mind when bidding on and paying for any items. Internet bid refunds will be at the discretion of the auctioneers. Refunds will not be given because of the condition of the original box. In the case of a refund due because of damage during shipping, the buyer will be refunded only when the auctioneers have been reimbursed by the professional shipping company. Return shipping will not be refunded. In cases where your package is damaged by the carrier please photo document damage ASAP so we can process a claim. All packages are required to have insurance, this may increase your shipping cost.
- Invoices for US buyers will be sent by e-mail through Live Auctioneers to internet bidders the Sunday or Monday after the auction. The shipping fee for US buyers will be an estimate of postage and insurance and a $5 handling fee per shipped box - not per lot purchased. We will pack as many lots as is reasonable in a box. We ship UPS ground with signature required at delivery. Also, we ship items out in a first-pay, first-ship basis. US shipping usually begins on the Wednesday after the auction. We strive to get everyone's purchases to them as soon as possible, but we cannot guarantee that your items will be shipped immediately upon receiving payment.
- International buyers will receive an invoice of your purchases from us on the Monday or Tuesday after the sale through Live Auctioneers. We send a complete invoice with the shipping fee after we have packed the parcel to get an exact mailing fee. Because of Live Auctioneers & Paypal policies, we will only ship parcels internationally through a shipping service which provides a tracking number. The US Post Office Express Mail service is the cheapest available with a tracking number. However, if you prefer UPS or Fed Ex International, please let us know so that you are charged properly. Insurance will not be included in your shipping fee. If you want your parcel insured, you must let us know so we can adjust the invoice. We will not change our shipping policy based on the value of the item purchased.
- Live Auctioneers invoices are sent to the e-mail address that you provide when registering for the auction. If that is no longer your current address, and we cannot get a message to you, you are responsible for contacting us. If you participate through us directly, your invoice will be mailed to you on
the Monday after the auction.
- The auctioneers are not responsible for typographical errors or omissions. If you are an attending bidder, it is understood that you have viewed the item. There are no returns unless an auction worker damages the item before you take possession.
- The computer bidding process is not a perfect one. While we endeavor to execute the internet bidding as perfectly as possible, we are not responsible for missed internet bids caused by computer slowness or other variables such as tied bids. Also, please bear in mind that we are a brick and mortar company running a live auction with attending bidders. Please ask any questions or express any concerns before you decide to participate.
