YOUR BID IS A CONTRACT WITH ALL COUNTRY ESTATE SALES, LLC (“ACES”)
BY PLACING A BID IN THE AUCTION, YOU AGREE TO BE BOUND BY THE
TERMS AND CONDITIONS OF SALE SET FORTH HEREIN.
1. ALL PROPERTY IS SOLD “AS IS” - ALL SALES FINAL - and neither ACES nor any consignor makes any warranties or representation of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, of description, genuineness, authorship, attribution, provenance, period culture, source, origin or condition of the property and no statement made at the sale, or in the bill of sale, or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability.
2. SALE – Each lot for sale within the auction is associated with a unique lot timer. At the expiration of the lot timer, the highest bidder shall be the purchaser. In the event of a technical malfunction, service failure or outage, ACES reserves the right to cancel, postpone, or reschedule the auction and its associated lots and timers to a new closing time.
3. SOFT CLOSE – Bids placed in the last few minutes of any item’s lot timer will add more time (a few minutes) to that item’s lot timer, extending the items time to close. This will continue extending until the extended time has run out without new bids being placed. This is done to ensure transparency and fairness of bidding, and to enable the highest bidder to win.
4. BUYER’S PREMIUM - a premium equal to 18% of the final bid price will be applied to each lot sold, to be paid by the buyer as part of the purchase price.
5. PAYMENT – Following the close of the auction, unless prior arrangements have been made, All Country Estate Sales, LLC will automatically charge the purchasers credit card on-file in the Bid Next Door system for their full invoice amount within 24 hours of the auction closing. Your credit card information is never shared with, nor stored by ACES, but is handled by a third-party payment processor, Stripe. You can read more about credit card security at https://stripe.com/docs/security. In the event that the purchaser’s credit card on-file does not process the transaction successfully the purchaser agrees to pay their invoice in full within 48 hours of the auction closing. ACES accepts Credit Cards, Cash, Cashier’s Checks, Wire Transfers, and “Zelle” transfers. ACES may require payment by Cash, Check or Wire Transfer for invoices totaling over $2,000, for invoices containing jewelry or silver, for international buyers, or for any other reason in ACES sole and absolute discretion. Any invoice not paid within 48 hours may result in the purchaser forfeiting their merchandise, losing the privilege of participating in ACES future sales, and potentially being suspended or permanently banned from ACES and ACES partner websites, including www.bidnextdoor.com.
7. COLLECTION, PICKUP RULES - Merchandise must be collected in-person according to the conspicuously posted Pickup Rules associated with this auction. Packing and loading within the posted timeframes for pickup is the responsibility of the buyer. ACES may offer additional services, at additional cost to the buyer, to pack, move, store, ship, deliver or otherwise handle items that buyers are not able to pick up within the time frame specified in the Pickup Rules. Unless other arrangements been made and agreed to by ACES in writing, as outlined in items 8 and 9 below, Merchandise remaining after the pickup times described in the Pickup Rules will be considered abandoned and shall be forfeited by the Buyer with no refunds. Abandoned Merchandise may be disposed of or resold by ACES to offset handling costs without further notice to the purchaser. Your bid placed in this auction is proof that you have read and agreed to the conspicuously posted Pickup Rules.
8. TRANSPORT – For a fee, ACES may offer to transport Merchandise to another location for purchasers to collect by appointment outside of the timeframe posted in the “Pickup Rules.” This service must be requested by the purchaser and agreed to by ACES in writing before the end of the timeframe posted in the Pickup Rules. ACES will not transport Merchandise without this request. Merchandise left with ACES longer than seven (7) calendar days will accrue storage fees of 50% of the original Transport Fee per-week.
9. SHIPPING - Shipping, if desired, is the responsibility of the purchaser. Upon request, our staff will provide a list of shippers who deliver to destinations within the United States and overseas. Shippers can either collect merchandise from ACES according to the Pickup Rules for this auction or, for an additional fee, ACES may offer to deliver items from the auction location to certain shippers. Some property that is sold at auction can be subject to laws governing exports from the U.S., such as items that include material from some endangered species. Import restrictions from foreign countries are subject to these same governing laws. Granting of licensing for import or export of goods from local authorities is the sole responsibility of the buyer. Denial or delay of licensing will not constitute cancellation or delay in payment for the total purchase price of these lots.
10. STORAGE - ACES is not a storage provider. Unless prior arrangements have been made and agreed to by ACES in writing, merchandise left longer than fourteen (14) calendar days will be considered abandoned and re-offered at auction to offset storage costs or disposed of at the purchaser’s expense. ACES is not obligated to notify the purchaser that the abandoned item(s) will be resold or disposed of.
11. RETURNS - Bidders are encouraged to ask questions and request additional information or pictures before bidding. Merchandise that is damaged, incomplete, or not as described in the lot listing may be refused (returned) by the Buyer (or Agent for the Buyer) at the time of pickup. Photographs are part of the of lot listing and are considered part of the description, if an issue with a lot is plainly visible in the lot photographs then the lot is "as described." Any person employed by the Buyer, including shippers, jobbers, movers, friends, and relatives, acts as Agent for the Buyer in accepting merchandise from ACES. After the item has been inspected by the Buyer (or Agent for the Buyer) and has been released by ACES to the buyer (or Agent for the Buyer), typically evidenced by the Buyers' (or Agent for the Buyers) signature, the sale is final and ACES is no longer liable for the merchandise in any way. In any event, ACES will not accept returns, refunds, or exchanges after 14 days from the auction close.
12. BREACH - If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, ACES may exercise all of its rights and remedies under the law including, without limitation, (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser’s breach, and/or (b) offering at public auction, without reserve, any lot or item for which the purchaser has breached any of its obligations, including its obligation to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale.
10. LIABILITY - In no event will the liability of ACES to any purchaser with respect to any item exceed the purchase price actually paid by such purchaser for such item.
11. SALES TAX - All purchases are subject to applicable Sales Tax. Sales Tax is determined by the location of the auction and is conspicuously posted in the auction description. Sales tax may be waived by keeping a validated Resale Certificate on file within the Bid Next Door system.
12. ACCEPTANCE OF TERMS - Bidding on any item constitutes your acceptance of these Terms & Conditions of Sale, Pickup Rules, and all other terms printed, advertised, or otherwise posted conspicuously.
13. LEGACY – ACES and its consignors make no warranty or representation, expressed or implied that the purchaser will acquire any copyright or reproduction rights to any lot sold. ACES expressly reserves the right to reproduce any image of the lots sold in this catalog. The copyrights in all images, illustrations and written material produced by or for ACES relating to a lot, including the contents of this catalog, is, and shall remain at all times, the property of ACES and shall not be used by the purchaser, nor by anyone else, without prior written consent.
14. VALIDITY - No invalidity or partial invalidity or unenforceability of any provision provided herein shall affect or impair the validity or enforceability of any other provision hereof.
