Liability Disclaimer

Please be advised that by placing a bid, you are entering into a legally binding contract with Maison de Beaubigonne. If you are the successful winning bidder, you have a legal obligation to purchase the item(s) won from Maison de Beaubigonne. Furthermore, a bidder acknowledges that proper and careful due diligence has been conducted prior to placing any bid, and that the bidder knowingly and willfully placed a legally binding bid. Any questions prior to bidding should be emailed to Maison de Beaubigonne Customer Support (support@beaubigonne.com). Maison de Beaubigonne reserves the right to withdraw or combine any lots listed in the auction at any time with no liability. Furthermore, Maison de Beaubigonne LLC reserves the right to cancel or replace an order post auction if (a) it does not successfully pass and meet our quality control standards prior to shipping, (b) is no longer available because our products may be offered simultaneously on multiple platforms, or (c) it was sold in error by our Auctioneer. In the event this occurs, Maison de Beaubigonne LLC will refund the winning bidder any funds paid. The successful winning bidder is the highest bidder acknowledged by our Auctioneer. Please note, the buyer's premium is a nonrefundable fee so please bid responsibly. Maison de Beaubigonne LLC and its Auctioneers will have final discretion in determining the winning bidder and in resolving any disputes between bidders. If any dispute arises after the sale, the Maison de Beaubigonne LLC sale record shall govern. Winning bidders must pay for the entire invoice before the items are removed from our inventory or any other online platforms. Many items are consigned to Maison de Beaubigonne LLC and may be simultaneously offered for sale on multiple online platforms. If a listed item becomes unavailable, Maison de Beaubigonne LLC will attempt to remove the item from the auction on a best efforts basis. Consequently, at Maison de Beaubigonne LLC's sole discretion, Maison de Beaubigonne LLC will contact the winning bidder and offer the same or similar item at no additional charge to the winning bidder, or Maison de Beaubigonne will provide a full refund if a similar item is not available or the bidder should request as such upon notification the item is no longer available.

Items may be purchased before or after any auction for a 'buy-now' price. Please email Maison de Beaubigonne LLC Sales Team (info@beaubigonne.com) for 'buy-now' pricing inquiries. We have tried to accurately describe every item. Conditions and substantial defects that are disclosed and/or photographed are done as a courtesy to Buyer. Though care is taken to inspect items and portray them accurately, not all defects may be photographed, known, or disclosed. Buyer is aware that unless Maison de Beaubigonne LLC discloses an item as brand new, items are pre-owned and that wear and defects can to be expected. Please review images carefully as all items are ?sold as is?. Keep in mind that on certain monitors, photos and light may depict slight color variations.


Contractual Acknowledgement and Bidding Commitment

By acknowledging and agreeing to this contract, the Buyer affirms their eligibility to participate in Maison de Beaubigonne?s exclusive auctions. The Buyer?s acceptance of these Terms which acceptance shall be deemed by online acknowledgement, together with the authorization of their credit card, shall constitute sufficient consideration to enter into this formal agreement and acceptance of Maison de Beaubigonne?s offer to participate in the auction.
This contractual relationship is ongoing and is renewed with each individual bid. Each bid placed shall be deemed a re-entry into this agreement, incorporating the latest version of Maison de Beaubigonne?s Terms & Conditions in effect at the time of the bid.
By placing a bid, Maison de Beaubigonne is offering the opportunity to purchase the listed item, and the Buyer, in submitting a bid, accepts that offer and provides consideration by assuming responsibility for the purchase. Each bid is therefore a separate binding contract obligating the Buyer to purchase the item at the bid price.
As all items offered are unique and available to only one successful bidder, which will be deemed to be the highest able buyer who properly placed a bid, each individual bid represents a firm and enforceable commitment to purchase under the current Terms of Auction.


Sales Tax

Maison de Beaubigonne LLC is based in the State of Delaware and therefore does not collect sales tax. Buyer acknowledges and agrees that they are solely responsible for complying with all applicable federal, state, municipal, and local government tax, tariff or alike. Buyer agrees to indemnify and hold harmless Maison de Beaubigonne LLC against any tax obligations.

Buyer's Premium

Each lot sold in our auction is subject to a twenty-five percent (25%) Buyer's Premium, unless specified otherwise in auction's terms. (For example: A $100 Hammer (bid) will equate to $100 Hammer + $25 Buyers Premium for a total of $125.) Reserves are a courtesy to our bidders, and to ensure flexibility during our auctions, Maison de Beaubigonne LLC does not list reserve prices. Should a bid come close to a reserve amount, Maison de Beaubigonne LLC may decide to sell the item below its set reserve. Please note, Maison de Beaubigonne LLC auctions may contain a 'Hidden Reserve'. This means that if the lot does not meet its designated reserve, the lot will either be 'passed' or; should there be existing bids on said lot, be 'sold to the floor' (meaning item was not sold). If an auction is displayed as 'No Reserve', this means that any of the lots in this specific auction do not need to reach a specified 'reserve' amount above the starting price.

Payment

Payments for purchases totaling $1,999 USD or less may be made by credit card. However, purchases totaling $2,000 USD or more must be paid via Zelle, ACH transfer, or bank wire transfer.
Credit cards provided at registration will be authorized (funds held) for the total invoice amount immediately following the auction, but items will not be shipped or released until payment has been received and cleared in full through one of the accepted payment methods listed above.
For security and fraud prevention, buyers paying by credit card must complete Maison de Beaubigonne?s in-house identity verification process before items will be released.


Shipping

At Maison de Beaubigonne, we strive to make shipping as affordable and seamless as possible. Shipping costs are calculated after the auction based on your location and the value of your item. We want you to know that we never profit from shipping?every dollar goes directly to the courier. In fact, we personally absorb the cost of all packaging, shipping supplies, and the time it takes to carefully prepare your order. Our priority is to ensure your items arrive safely, securely, and at the best possible price.

We?ve partnered with trusted couriers to provide competitive rates, passing those savings directly to you. Please note that all luxury items require insurance for shipment; this protects both you and Maison de Beaubigonne by ensuring your valuable items are fully covered from the moment they leave our hands until they reach yours.

Returns & Chargebacks

Returns

BUYER?S RIGHT TO RETURNS OF DESIGNER AND LUXURY BRAND ITEMS

ALL DESIGNER AND LUXURY BRAND ITEMS MAY BE RETURNED under the following terms: Within 72 hours of receipt of the product [item(s) marked as delivered], the buyer must contact Maison de Beaubigonne via email at returns@beaubigonne.com to initial return process. A shipping label will be provided by Maison de Beaubigonne for the buyer?s convenience. The buyer must use the original packaging and send out the merchandise within 2 business days of receiving the label.

Condition: The item must be returned in the same condition in which it was originally shipped, with all packaging, documentation, and accessories included.
Approval: All returns are subject to Auctioneer?s inspection and approval. Unauthorized, late, incomplete, or non-compliant returns will be refused and may be deemed abandoned without refund.

Upon receipt and satisfactory inspection of the returned item by Maison de Beaubigonne, the buyer?s refund rights are fully vested. The buyer?s refund right is an entitlement to either the ?return refund? or credit for any future auctions, buy-it-now sales, website purchases, or in-person purchases from Maison de Beaubigonne or affiliates. This credit shall not expire. It is the buyer?s sole discretion which option will be chosen in light of the returned item. Given Maison de Beaubigonne's shipping and handling of the item, and the cost of the auction platform, the refund return will be the full amount less a 5% restocking fee.

Any and all other items (ie art, d?cor please see return policy), except designer and luxury brand items, do not have a right of return. However, Maison de Beaubigonne may accept returns at its own discretion under any terms it offers to the buyer. Risk of loss during return transit remains with Buyer until the item is received and accepted by Auctioneer.

Delivery, Proof of Receipt & Risk of Loss

Ship-To Address. Lots are shipped to the address provided at checkout. The buyer is responsible for ensuring the address is accurate and secure for delivery.

Proof of Delivery. Carrier tracking that shows ?Delivered? to the buyer?s address is conclusive proof of delivery to the buyer. Risk of loss and title pass to the buyer at that point.

Signature Policy. For orders over $1000, Maison de Beaubigonne LLC may require an adult signature. If the buyer requests no signature or delivery instructions (e.g., ?leave at door?), the buyer assumes all risk of theft or loss after the carrier marks the package delivered.

Freight Forwarders / Doormen / Concierge. Delivery confirmation to a third party designated by the buyer (e.g., concierge, doorman, parcel locker, freight forwarder) constitutes delivery to the buyer.

Non-Receipt Claims. If you believe you did not receive a package that shows as delivered, you must notify Maison de Beaubigonne within 48 hours of the delivery scan and cooperate in any carrier investigation, which may include a police report for suspected theft. Maison de Beaubigonne may assist with a carrier claim at its discretion, but is not obligated to replace or refund items once the carrier confirms delivery.

Refusal to accept merchandise delivered by Maison de Beaubigonne LLC to the winning bidder constitutes an unauthorized return in direct violation of these Terms and Conditions. In the Refusal to accept merchandise, Buyer remains liable for: (1) the buyer?s premium as posted for the sale, which is non-refundable in all events; and (2) a restocking fee equal to five percent (5%) of the hammer price, in addition to any shipping, insurance, or processing charges. Any refund, if issued, will exclude the buyer?s premium and include the restocking deduction.


Payments, Final Sale, and Credit Card Chargebacks

Binding Sales. All winning bids are binding. Invoices are due within 24 hrs. All sales are final unless Maison de Beaubigonne offers a written exception.

Chargeback Agreement. The buyer agrees not to initiate a credit card chargeback for: (a) orders showing carrier ?Delivered,? (b) delivery to a location or third party the buyer authorized, or (c) condition disputes covered by our written descriptions/photos and any stated return policy. If a chargeback is opened contrary to these Terms, you authorize a flat, non-refundable dispute administration fee of $300 per transaction to cover investigation, evidence preparation, processor assessments, and handling, to the extent permitted by law.
? If the chargeback is reversed in our favor, you remain responsible for: (i) the invoice amount, (ii) shipping/insurance, (iii) the $300 dispute administration fee, and (iv) any processor-imposed fees actually incurred.
? If the chargeback is not reversed, Maison de Beaubigonne reserves all remedies at law and in equity, including collections.

Dispute Procedure First. The buyer must contact Maison de Beaubigonne within 3 business days of delivery (or the delivery scan) to raise any issue. We will make a good-faith effort to resolve promptly.

Contesting Chargebacks. If a chargeback is filed, Maison de Beaubigonne will submit evidence (tracking, photos, correspondence, terms) to the processor. If the chargeback is reversed in our favor, the buyer agrees to reimburse: (i) the invoice amount, (ii) shipping and insurance, and (iii) reasonable third-party fees actually incurred to contest the chargeback, to the extent permitted by law.

Account Remedies. We may suspend bidding privileges, cancel future orders, and/or require bank transfer or wire for future purchases where a buyer has initiated a chargeback contrary to these terms.

Processor Terms. Payments are processed by third-party processors; the buyer also agrees to their terms and policies.

Indicators of Bad-Faith Chargebacks (non-exhaustive)

Opening a chargeback may be deemed bad faith where any of the following apply: (i) carrier tracking shows Delivered to the checkout address; (ii) buyer did not contact us within the stated window; (iii) buyer requested ?no signature/leave at door? or used a third party (concierge/locker/forwarder); (iv) buyer refuses to provide reasonable information for an investigation; or (v) claims conflict with AVS/3-D Secure/processor verification data.

Remedies, Collections & Deterrents

Payment Method Restrictions. We may suspend bidding privileges and require wire transfer or certified funds for current or future orders.

Late Amounts. Unpaid balances (including fees) accrue interest at 1.5% per month (18% APR) or the maximum permitted by law, whichever is lower.

Costs of Collection. The buyer agrees to pay reasonable third-party collection costs and attorneys? fees actually incurred in recovering amounts owed, to the extent permitted by law.

Identity & Address Verification. We may require government-issued ID, address verification, and delivery with adult signature on present or future orders?especially where a chargeback has been attempted.

Fraud Referrals. Suspected fraudulent disputes or false loss claims may be reported to the carrier?s fraud unit, relevant card networks, and law enforcement, and may be pursued as mail/insurance fraud where applicable.

Recordkeeping. We record serial numbers, movement/bracelet IDs (where applicable), tamper-evident packaging, and photo documentation to support evidence submissions.


Bid Corrections (If You Made a Mistake)
We understand mistakes happen. If you place a bid in error, email support@beaubigonne.com immediately with: (i) the lot number, (ii) the erroneous bid amount, (iii) the time of the bid, and (iv) a brief explanation of the error. Bids may be retracted at Maison de Beaubigonne?s sole discretion and are not guaranteed to be withdrawn. Requests received after a lot closes or without sufficient detail may not be honored. We may require identity/account verification and may limit bidding if retraction requests are excessive or appear abusive. Nothing here limits any right you may have under applicable law.

Bids Are Binding, Irrevocable Offers (and Backup Commitment)
By placing a bid, you make a binding, irrevocable offer to purchase the lot at your bid amount plus any buyer?s premium, taxes, shipping/insurance, and applicable fees. Bids are not retractable except as permitted by Maison de Beaubigonne in writing or where required by law.
If you are the highest bidder at close (and any reserve is met), your offer is accepted and you must complete the purchase. If you are an underbidder, your highest bid remains a binding backup offer for [7] calendar days after close, which Maison de Beaubigonne may accept (e.g., if the leading bidder fails payment or is disqualified, or due to post-auction audit/error correction). Whether or not you are immediately shown as ?winner,? your bid is a binding agreement that may be accepted within this backup window.
Winning Status, Delayed/Corrected Notices, and Conclusive Records
On-screen, email, or SMS results are courtesy notifications only. Maison de Beaubigonne?s internal records are conclusive as to the winning bidder, hammer price, and reserve status. We may audit and correct results after close to address ties, reserve logic, time extensions, platform latency, or suspected abuse. You may be designated the winning bidder after close (including as a backup winner) even if you were not immediately notified. If designated the winner, an invoice will follow and payment is due under the invoice terms. A delay, omission, or correction in notification does not nullify your obligation once your bid is accepted.
Chargebacks, Dishonored Payments & Anti-Fraud
Definitions. ?Company? means Maison de Beaubigonne LLC. ?Buyer? means any approved bidder who wins a lot. ?Amounts Due? include hammer price, buyer?s premium, shipping/handling, taxes/duties, storage/insurance (if any), administrative/processor fees, and reasonable collection costs and attorneys? fees.
Card on File; Continuing Authorization.?As a condition of bidding, Buyer must maintain a valid credit/debit card on file (the ?Card?). By registering and/or providing Card details, Buyer authorizes the Company and its PCI-compliant processor to place verification holds, capture charges, re-present declined charges, and split charges into multiple partial captures for all Amounts Due. This standing authorization continues until Buyer?s account is closed and all obligations are paid in full.
Verification Holds & Status Checks.?Buyer acknowledges the Company may place temporary authorization holds at registration and from time to time thereafter to confirm the Card is active and has available credit. Holds are not charges but may reduce available credit until released by Buyer?s bank.
No Alternative Remedy by Chargeback.?Chargebacks are not an alternative dispute process. If Buyer disputes a charge, Buyer must notify the Company in writing within [3] days of the charge; the parties will cooperate in good faith to resolve the issue under this Agreement?s return/inspection policies (if any). Improper chargebacks are a material breach.
Dishonored/Returned Payments; Title & Possession.?Title to any lot does not pass until the Company receives irrevocable, cleared funds for all Amounts Due. Any chargeback, reversal, return, stop-payment, or other dishonor after delivery or pickup means title never passed; Buyer holds the goods as a wrongful possessor/constructive trustee for the Company and must immediately return the goods on demand.
Suspension; Cure.?Upon any dishonor or chargeback, the Company may suspend or revoke bidding privileges and/or cancel undelivered lots. Buyer will have [3] business days from notice to cure by paying all Amounts Due by a method acceptable to the Company (e.g., wire or certified funds).
Return, Reclamation & Shipment Recall.?If possession has transferred, Buyer shall promptly: (a) return the goods (unused and in the same condition with all accessories, tags, certificates, boxes, and serial/identifier labels), or (b) make them available for pickup/reclamation as directed by the Company. The Company may recall shipments, instruct carriers to hold or return packages, and schedule reasonable access to retrieve goods if Buyer fails to cooperate.?(a) Designated Returns Address; RMA. Buyer must follow the Company?s written return instructions, including use of the Designated Returns Address stated in the RMA or on a Company-issued label. Returns sent to any other address, locker, drop-box, or third-party concierge/mailroom are not valid returns.?(b) When Possession Reverts; Signature Required. For purposes of Sections 5?7, possession is not deemed returned to the Company, and risk of loss remains with Buyer, until (i) the parcel is delivered to the Designated Returns Address and (ii) a Maison de Beaubigonne, LLC authorized representative signs for and acknowledges receipt. A carrier ?delivered? scan, scan to building staff, unattended drop-off, or delivery to a third party does not constitute a return. Hand deliveries likewise are not deemed returned until signed for by a Company-authorized representative.?(c) Method; Tracking; Adult Signature. Buyer must use a trackable carrier and select adult signature required service, and shall provide tracking details to the Company upon shipment.?(d) Insurance (Default Rule). Buyer must insure the shipment for not less than the greater of (i) the Amounts Due or (ii) the item?s fair market value (declared value/insurance). Buyer bears all risk of loss, theft, or damage in transit until the Company?s authorized representative signs for receipt under Section 7(b).?(e) Company-Provided Label (Optional) . At the Company?s option, the Company may issue a prepaid, insured return label. If provided, Buyer shall use that label exclusively; the cost of the label and insurance may be charged to Buyer as an Authorized Charge. Risk of loss still remains with Buyer until the Company?s authorized representative signs for receipt under Section 7(b).?(f) Inspection on Receipt; Non-Conforming Returns. All returns are subject to inspection. If the item is missing components, shows wear or tampering, or otherwise fails to match outbound records (including photos/serials), the return may be rejected, or the Company at its sole digression may accept it with an appropriate adjustment, restocking charge, or claim offset.
Resale & Deficiency.?If goods are not returned as required, the Company may resell them at public or private sale (with or without reserve) and apply proceeds to Amounts Due. Buyer remains liable for any deficiency, plus reasonable resale, storage, shipping, insurance, administrative, processor, and collection costs.
Fees, Interest & Costs.?Buyer shall pay: (a) any bank/processor assessments arising from a dishonor or improper chargeback; (b) administrative fees of [up to $ 300 per incident; (c) interest on past-due balances at [the lesser of 1.5% per month or the maximum lawful rate]; and (d) reasonable attorneys? fees and costs for enforcement (e) is liable for the contracted.
Equitable Relief.?The Company may seek injunctive and other equitable relief (including replevin/claim-and-delivery) to recover Company property and prevent transfer or dissipation of goods or proceeds.
Anti-Fraud; Reporting to Law Enforcement.?Buyer acknowledges that payment instrument fraud, identity fraud, chargeback fraud, and theft by deception may be crimes. Without limiting civil remedies, if the Company reasonably suspects fraudulent or criminal conduct related to a transaction, it may refer the matter to law enforcement and/or the card network/payment processor and share information and records as permitted by law. Nothing herein is a promise to refrain from reporting, and nothing constitutes a threat or demand for payment in exchange for non-reporting. Buyer agrees to cooperate in good-faith fraud reviews (including reasonable identity/document verification).

High-Value Safeguards .?For first-time or high-risk transactions and/or orders over $[5,000], the Company may require: (a) cleared funds (wire or certified funds) before release; (b) shipment only to a verified address with adult signature; and (c) government ID verification consistent with applicable law. Failure to satisfy safeguards may delay shipment or result in cancellation.

Security & Processing.?Card data is transmitted and stored through a PCI-compliant processor. The Company may maintain a tokenized profile of the Card for the purposes described above and will not intentionally store full primary account numbers on Company systems.
Limitation of Liability.
To the maximum extent permitted by law, the Company is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, even if advised of the possibility. By accepting the terms of this agreement, Buyer agrees to limit the aggregate liability of total damages in any claim against Maison de Beaubigonne LLC to the winning hammer price of the item of dispute.
Governing Law & Venue (Delaware; State Courts in New Castle County)
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. The parties agree that the exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms or any lot shall be the state courts located in New Castle County, Delaware. Each party irrevocably submits to the personal jurisdiction of such courts and waives any objection based on forum non conveniens or improper venue.
Miscellaneous.
Headings are for convenience only. If any provision is unlawful or unenforceable, it is severed and the remainder remains in effect. These Terms (together with any posted sale conditions and the invoice) are the entire agreement regarding the purchase of lots and supersede prior agreements on that subject, or any descriptions on auction listing. The Company may update these Terms prospectively by posting revisions.
Severability
If any provision is found unenforceable, the remainder remains in effect. We may update these Terms prospectively by posting a revised version. In the event of conflict between these Terms and any listing, these Terms control.
