ESTATE SALE – TERMS AND CONDITIONS
By entering the property and/or making a purchase, you agree to the following terms and conditions. Please read carefully.

Assumption of Risk & Liability Waiver
Enter at Your Own Risk: All visitors enter any portion of the property/premises at their own risk.
Purchase at Your Own Risk: All purchases are made at the buyer’s sole risk.
Hazard Notice: Surfaces may be uneven, slick, or hazardous. Risks include but are not limited to slipping, tripping, falling, lifting injuries, and vehicle incidents.
Liability Waiver: The homeowner, seller, estate, estate company, employees, agents, representatives, heirs, assigns, and volunteers are not responsible for any injuries, accidents, losses, theft, or damages occurring anywhere on the property/premises boundaries, including the yard, driveway, garage, home interior, and parking areas.
Hold Harmless & Indemnification (Florida): By entering, you agree to release, waive, discharge, defend, indemnify, and hold harmless the homeowner, seller, estate, estate company, employees, agents, representatives, heirs, assigns, and volunteers from any and all claims or expenses (including attorney’s fees) arising from your presence on the property/premises or your purchase and removal of items. This provision is intended to be as broad and inclusive as permitted under Florida law.

1. Purchase and Item Condition
“As-Is, Where-Is, With All Faults” Condition: All items are sold in their present condition with no guarantees, warranties, or authentication implied or expressed.
Final Sale: All sales are final. No refunds, returns, exchanges, or chargebacks.
Inspection: Buyers are responsible for thoroughly inspecting items prior to purchase.

2. Payment and Pricing
Payment Method: Cash only.
Discounts: Prices may be reduced as the sale progresses.
Sales Tax: Applicable state and local sales tax will be added to all purchases where required.

3. Site Rules and Safety
Adults Only: Entry is limited to individuals 18 years or older. No children or minors permitted anywhere on the property/premises.
No Pets: Pets are not permitted.
No Bags: Purses, large bags, and/or backpacks or are not permitted inside. A hold table will be available while shopping. We are not responsible for unattended items.
Respect the Home:
No lounging, smoking, eating, or drinking inside the home.

No restrooms available under any circumstances.

Do not enter rooms, cabinets, or closets that are taped off or marked closed.
Access Control: The seller reserves the right to limit entry, implement line control, or restrict access to any area. Disruptive or unsafe behavior will result in removal from the property.
Security Notice: Security cameras and/or staff may be monitoring and recording the sale.

4. Pickup and Handling — Buyer Sole Responsibility
Removal of Items: Buyers are solely and completely responsible for lifting, packing, loading, securing, and transporting all purchased items.
No Assistance: The homeowner, seller, estate, estate company, and staff will not provide help under any circumstances.
Bring Supplies: Buyers must bring their own labor, tools, dollies, vehicles, and packing materials, etc. None will be provided.
Risk During Removal: Buyers assume all risk of damage or injury to themselves, others, vehicles, floors, walls, and purchased items during removal.
Same-Day Removal Required: All items must be removed the same day of purchase or will be forfeited unless prior written arrangements are approved.
No Holds Without Payment: Items generally will not be held without full payment.

5. Parking and Neighborhood Rules
Do not block driveways, mailboxes, fire hydrants, or neighbors’ property.
This home is located in a cul-de-sac; street parking may be limited.
Park and maneuver at your own risk.
We are not responsible for vehicle damage, theft, towing, citations, or incidents occurring in the parking area or nearby streets.
Please be respectful, as this sale is in a residential neighborhood.

6. Other Policies
Early Sales: Items are typically not sold before the scheduled start time; however, serious offers to purchase entire collections may be considered.
Right to Refuse Service: We reserve the right to refuse service or entry to anyone for any lawful reason.
Weather / Acts of God: The seller is not responsible for weather conditions or other events beyond our control that may affect access, safety, or availability.

Entering the property/premises constitutes full, voluntary, and legally binding acceptance of these terms.
