1. PROPERTY SOLD AS-IS & AUTHORSHIP GLOSSARY

"As-Is, Where-Is": All property is sold "AS-IS, WHERE-IS" without warranty or guarantee as to condition, age, or authenticity. We present and describe all merchandise as honestly and accurately as possible.

Expression of Opinion: All catalog descriptions, titles, dates, signatures, and condition details are statements of qualified scholarly opinion only and do not constitute a legal warranty of authorship. Bidders must rely entirely on their own inspection and expertise prior to bidding.

Fine Art Terminology: Where an artist?s name is listed without qualification , it represents our opinion that the work is by the artist. Where listed as "Attributed to..." or "Circle of...", it designates a work of the period which may be in whole or in part by the artist, but is explicitly not guaranteed as such.

Authenticity Disputes & Deadline: To challenge the catalog description or authenticity of a lot, the buyer must submit written notice along with conclusive, formal written evidence from two recognized, independent fine art experts within fourteen (14) days of the auction close. Verbal claims or personal opinions do not qualify for a return. After 14 days, all sales are final, and no returns, refunds, or cancellations will be issued under any circumstances.

Condition Requests: Additional condition reports and photos are available by request via phone or e-mail and must be submitted no later than 12:00 noon the day preceding the sale.Contact: Please contact us directly at marc@avraart.com for questions or condition reports.

2. SHIPPING, PICKUP, & STORAGE

In-House Shipping: We provide in-house shipping for most lots. Large or oversized items, such as furniture, will need to be handled by a professional third-party shipper.

Oversized Items: WE ARE NOT RESPONSIBLE FOR SHIPPING OVERSIZED ITEMS. Bidders must check with us before bidding to verify if an item is oversized. Oversized items must be picked up locally.

Flat Rate Shipping: We offer flat rate shipping on most items. If you do not see a shipping price on a lot, please contact us for a quote. We combine shipping when possible and can normally fit two similar-sized paintings in a single box without affecting the base cost.

High-Value Insurance: For high-value items, a line item for shipping insurance will be added to the invoice. Insurance is calculated at approximately $20 for every $1,000 of the claimed value. If you are unsure, please ask for an exact quote. Please not that Fed Ex & UPS limit insurance amount on artwork. You may want to use a 3rd party if you want full coverage on high value items.

Frames & Glass: We are not responsible for minor cosmetic damage to frames during transport; the primary value of the lot resides in the artwork itself. Please do not request insurance claims unless frame damage is major, results in a total loss, or requires extensive restoration. We reserve the right to remove heavy glass prior to transit if we determine it safer to transport without it.

Shipping Timelines & Tracking: Items are shipped strictly in the order payment is received. Please allow up to 2 weeks post-payment for items to ship (standard delivery is normally within one week). Tracking numbers will be generated and emailed automatically once your label is printed. Please do not contact us to request tracking updates unless a full two (2) weeks have passed from your payment date. The faster you pay, the faster your items will ship.

Pickup & Storage Fees: Local pickup is available post-sale by appointment. Because we do not maintain standard retail business hours, pickups must be scheduled at least 48 hours in advance. Any items not picked up or shipped out within three (3) weeks post-sale will incur a storage fee of $10 per day, per item.Abandoned Property: ANY ITEM NOT PICKED UP OR SHIPPED OUT WITHIN 90 DAYS POST-SALE WILL BE CONSIDERED ABANDONED PROPERTY and will be resold or disposed of without further notice or refund. We are not a storage facility and appreciate clear communication regarding your items.

3. BIDDING CONDITIONS

Discretion: We reserve the right to reject any and all bids. The highest bidder acknowledged by the auctioneer will be the successful winner.Bidding Disputes: In the event of any dispute between bidders, or if we harbor doubt as to the validity of any bid, the auctioneer maintains absolute discretion to either determine the successful bidder or re-offer and re-sell the article in dispute. If any dispute arises after the conclusion of the sale, our official sale record is final and conclusive.

Bidding Formats: We accept absentee bids and internet bids executed through our approved online platforms. We no longer accept or execute telephone bids. At our discretion, we will execute standard online absentee bids as a convenience to clients who cannot actively take part in the live sale. We are not responsible for any platform errors, connectivity drops, omissions, or technical failures. Our sales are virtual, and we require all customers to utilize LiveAuctioneers.


4. SALES TAX

Tax Administration: Sales tax will be added to invoices where applicable. LiveAuctioneers is solely responsible for collecting, calculating, and administering sales tax. If you possess a valid resale certificate or tax ID, you must file it directly with LiveAuctioneers. We do not process, alter, or handle sales tax adjustments.

5. BUYER'S PREMIUM

Premium: A buyer's premium of 25% will be added to the hammer price of all catalog purchases and forms part of the total purchase price.

6. PAYMENT TERMS

Forms of Payment: Accepted forms of payment include PayPal, Visa, Mastercard, Discover, certified checks, or money orders.

Credit Card Fees: There is a 3% credit card processing fee added to all invoices paid via LiveAuctioneers. Bidders may waive this fee by electing to pay directly via Zelle or Venmo.

Payment Due Date: Complete payment is required immediately upon receipt of a successful bid notification. Items must be paid for no later than 72 hours following invoice receipt. First paid, first shipped.

Auto-Billing & Non-Payment: Invoices will be charged automatically to the credit card on file three (3) days post-sale. If an invoice remains unpaid after seven (7) days, we retain the right to cancel the sale. We automatically open unpaid item disputes on ALL unpaid items after 7 days, without exception.
