Terms & Conditions
These Terms & Conditions apply to all auctions conducted by Blackwell Auction Group, Inc. d/b/a R & T Coin and Busted Gavel Auctions (Auction House). By registering for an auction and/or placing a bid, each bidder acknowledges that they have read, understood, and agreed to these Terms & Conditions, the Auction House’s Payment Terms and Shipping Terms, and all applicable Live Auctioneers terms.
BINDING BIDS
All bids are binding and cannot be withdrawn or canceled after acceptance. The highest bidder acknowledged by the Auction House will be the purchaser. The Auction House reserves the right to reject any bid, resolve bidding disputes, reopen bidding when appropriate, or withdraw any lot before completion of the sale, subject to applicable law.
BUYER’S PREMIUM
A buyer’s premium will be added to the hammer price of each successful lot at the percentage disclosed for the auction. The buyer’s premium is part of the total purchase price and is payable by the successful bidder.
PAYMENT
Payment is due in accordance with the Auction House’s posted Payment Terms. Buyers are responsible for the hammer price, buyer’s premium, applicable taxes, payment processing fees, shipping and handling, and all other applicable charges. Failure to make payment when due constitutes default.
SALES TAX
Applicable sales tax will be collected as required by law unless the buyer provides a valid and applicable resale or tax-exemption certificate that is accepted before completion of the transaction.
ALL PROPERTY SOLD AS-IS, WHERE-IS
ALL PROPERTY IS SOLD AS IS, WHERE IS? AND WITH ALL FAULTS. All sales are final unless otherwise required by applicable law.
Descriptions, photographs, measurements, dates, attribution, authorship, origin, condition, provenance, materials, signatures, markings, and other information are provided in good faith for identification and informational purposes. Such information represents the Auction House’s opinion based upon the information reasonably available at the time of cataloging and is not a guarantee or warranty unless expressly stated otherwise in writing.
Bidders are responsible for reviewing photographs, descriptions, condition information, and requesting additional information before bidding.
CONDITION
Condition reports and statements regarding condition are offered as a courtesy and may not identify every defect, restoration, alteration, repair, replacement, scratch, chip, crack, stain, loss, or other condition issue. The absence of a condition statement does not imply that an item is free from defects or wear.
AUTHENTICITY & ATTRIBUTION
Unless expressly stated as guaranteed by the Auction House in writing, statements regarding maker, artist, manufacturer, age, period, origin, attribution, authenticity, materials, signatures, markings, or provenance constitute opinions and are not warranties.
Bidders should conduct their own research and obtain independent professional advice or authentication when authenticity, attribution, condition, or value is material to their decision to bid.
COINS, JEWELRY & PRECIOUS METALS
Descriptions of coins, currency, jewelry, gemstones, watches, precious metals, and related collectibles are opinions unless accompanied by an independent grading or laboratory report expressly identified in the listing.
Grades, weights, measurements, metal content, gemstone identification, treatments, and estimated characteristics may be approximate. Third-party grading information, when provided, is reported as shown on the applicable holder or documentation. Buyers are responsible for conducting their own evaluation before bidding.
PHOTOGRAPHS
Photographs form part of the lot description but may not accurately reproduce color, scale, texture, condition, or other characteristics due to lighting, photography, screens, or other factors.
SHIPPING
Buyers are responsible for shipping, packing, handling, insurance, and related costs in accordance with the Auction House’s posted Shipping Terms. No property will be released or shipped until all required payments have been received and cleared or verified when applicable.
NONPAYMENT & DEFAULT
Failure to pay all amounts when due constitutes default. Subject to applicable law and Live Auctioneers policies, the Auction House may withhold property, cancel the sale, report the bidder as a nonpaying bidder, restrict future bidding, resell the property, and pursue any other remedies available by law.
FAILURE TO TAKE POSSESSION
Buyers are responsible for completing required shipping or pickup arrangements within the time specified by the Auction House. Property not timely claimed may be subject to reasonable storage, handling, relocation, or other charges, where permitted by law. The Auction House reserves all rights and remedies permitted by applicable law regarding property that remains unclaimed.
INTERNET & PLATFORM BIDDING
The Auction House is not responsible for bids that fail to transmit or are delayed because of internet outages, software or platform failures, equipment problems, connectivity issues, or other technical circumstances outside the Auction House’s reasonable control.
Live Auctioneers operates independently of the Auction House, and use of the Live Auctioneers platform is also subject to Live Auctioneers applicable terms and policies.
ESTIMATES
Any auction estimates or values provided are opinions only and are not guarantees of selling price, market value, resale value, or future value. Property may sell above or below any estimate.
RESERVES
Lots may be offered subject to a reserve when permitted and disclosed as required by applicable law. The Auction House may execute bids on behalf of the seller up to the reserve, where permitted by law and applicable auction-platform rules.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, the Auction House shall not be liable for indirect, incidental, special, consequential, or speculative damages arising from participation in an auction or purchase of property. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
GOVERNING LAW
These Terms & Conditions and transactions with the Auction House shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles.
SEVERABILITY
If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.
ENTIRE AGREEMENT & ACCEPTANCE
These Terms & Conditions, together with the applicable lot description, auction-specific notices, Payment Terms, Shipping Terms, and applicable platform terms, constitute the terms governing participation in the auction.
By registering and/or placing a bid, the bidder acknowledges that they have read, understood, and agreed to be bound by these Terms & Conditions.
