If you prefer to pay a different way, you must make arrangements prior to the opening of the next weekly auction. Buyer's Premium: 18% Credit Card Fee: 3. 5%. Currently, we do not ship.
Sellers: Treasure Brokers Auctions & Estate Sales will be agent for the Seller and will sell listed items to the highest bidder by public-internet online auction at the commission as listed or typically 35% (some may vary) of gross total of the winning bid amount from the highest bidder for all items sold at the internet online auction. Additionally, there is a $5.00 per lot entry fee, regardless of if the item sells. For "Home Lotters" call the office for details. Treasure Brokers Auctions & Estate Sales will arrange advertising and mailings as it deems advisable to obtain the maximum results. Treasure Brokers Auctions & Estate Sales, will conduct the auction, furnish assistants and clerks as may be necessary, make all collections and finalize billing details directly connected with the auction.
All payments for purchases at the auction shall be made payable and delivered to Treasure Brokers Auctions & Estate Sales who will furnish a complete accounting and settlement within 14 banking days after the auction. SELLER agrees to allow Treasure Brokers Auctions & Estate Sales to use its discretion and make the final decisions as to how items are to be sold, whether individually or lotted in a group. SELLER agrees to allow Treasure Brokers Auctions & Estate Sales to dispose of any item if deemed unsaleable, broken, or incomplete, without notice to the seller. SELLER will furnish Treasure Brokers Auctions & Estate Sales, with a complete descriptive list of the items to be sold at auction, including serial numbers and any pertinent information which will appear in the advertising literature. SELLER will deliver all the listed items and titles, if applicable, to the auction site no later than 7 DAYS prior to the auction date. The items must arrive in the cleanest, most functional condition practical. Any misrepresentation by the SELLER as to description or condition will allow Treasure Brokers Auctions & Estate Sales, to increase their agreed upon commission percentage on the items sold at Treasure Brokers Auctions & Estate Sales
SELLER will maintain insurance and holds Treasure Brokers Auctions & Estate Sales, harmless for any damage or liability claims resulting from involvement of equipment or property at the site until SELLER has been paid by Treasure Brokers Auctions & Estate Sales. SELLER will be liable for any theft, damage, fire damage or vandalism that may occur while on auction premises or while being handled by Treasure Brokers Auctions & Estate Sales. SELLER agrees NOT to bid on their own items. IF SELLER IS DISCOVERED TO HAVE VIOLATED THIS PROVISION AND WINS THEIR OWN ITEM (items with stated reserves notwithstanding), A FULL FEE WILL BE DUE. SELLER MAY BE BANNED FROM FURTHER BUSINESS. on all lots, SELLER agrees to pay a minimum of $5 lot fee. In the rare instance when a reserve is assigned, $10.00 per lot fee will be collected.
ITEMS RELISTED will incur a $5/lot fee and 35% commission. ASSEMBLY, DIS-ASSEMBLY or REPAIR Services are billed at $50/hr, with a $25 minimum. Auctioneer research is billed at $75/hr.
SELLER agrees to pay an additional $5 per lot or $50/hour if seller does not sort, inventory, or pre-lot their items to be sold at auction. SELLER agrees to pay $10 No-Sale fee for items with reserves not met or items that did not receive any bid.
Shipping: In the future, Treasure Brokers may ship small items (shoe box or smaller) & may help arrange shipping of large items at the buyer's expense. For large items please contact us for approval, prior to bidding. We must be notified that shipping will be required within 24 hours of the auction close.

CONDITIONS OF SALE: Buyer agrees to indemnify and hold harmless Treasure Broker Auction & Estate Sales LLC, its affiliates and their respective employees, contractors, agents, officers, licensors, managers and directors, from and against any and all claims, damages, suits, proceedings, investigations, actions, demands, obligations, losses, damages, settlement amounts, fines, penalties, costs, expenses and any and all other liabilities (including but not limited to reasonable attorneys' fees and court costs) arising from or related to the following:

1. All items are sold "AS IS, WHERE IS" with all faults. Absolutely NO RETURNS OR EXCHANGES. ALL SALES ARE FINAL. There are no warranties or representations of merchantability, fitness, nor of any other kind, express or implied. All items are available for your examination prior to bidding. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind.
Treasure Brokers Auctions & Estate Sales attempts to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog or other descriptions of the lot. We highly recommend prospective bidders examine all items in which they have an interest prior to bidding for a condition report or to express concerns with the description.
By placing a bid, either in person, by phone, absentee or via the Internet, you signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you have an expert examine the lot for you or do not bid on the item in question.
If your item(s) are damaged in shipping, you will need to contact the shipper to file a claim. If your item(s) are being shipped and there is a condition problem upon receipt, you are expected to notify us immediately by phone at 603-801-5380. Refunds or adjustments will be handled on an individual basis.
2. The successful bidder is the highest bidder acknowledged by the auction. In the event of any dispute between bidders, or in the event of doubt on Treasure Brokers Auctions & Estate Sales part as to the validity of any bid, the auction house will have the final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, Treasure Brokers Auctions & Estate Sales record is conclusive.
3. The purchaser assumes full responsibility for items at the fall of the internet hammer. 4. There will be a buyer's premium for all bidders added to the hammer price of each lot and it will be considered part of the total purchase price. 5. All purchases will be subject to a 6.5% Florida sales tax unless the purchaser possesses a valid State of Florida Department of Revenue tax-exempt certificate. You must include your Tax-Exempt documentation in the notes section of the registration and Bring a copy to the Auction Pick Up Time, to be kept on hand for the year. Out of state internet bidders are not subject to Florida sales tax. Treasure Brokers Auctions & Estate Sales must have a valid exemption certificate with resale certificate number and signature to be tax free.
6. PAYMENT - All credit cards on file of the winning Bidders will be charged at the conclusion of the auction. All winning internet bidders will be notified after the auction ends via email. This email will contain the information for the 1-day pick-up schedule. IF YOU CANNOT PICK UP YOUR ITEMS DURING THIS WEEKLY PICK-UP TIME, PLEASE DO NOT BID. THANK YOU. All items must be picked up During the pick-up scheduled time. It is not the auction house's responsibility to contact the winning bidder from this point forward. If the winning bidder does not PICK-UP during Pick Up Time, the winning Bidders will be charged a storage fee of $5 per lot . Items that are not picked up within 7 days of the auction Pick Up date, will become the sole property of TREASURE BROKERS AUCTIONS & ESTATE SALES, for them to do with what they will. This may include the item being resold in auction, donated to charity, or thrown away etc. If the buyer bids on items and does not pay for the winning lots, this buyer will be banned from bidding again on future auctions. The auction house has a responsibility to pay consigners within a certain time frame and will not waste resources by having the staff track down bidders. It is the high bidder's total responsibility to communicate with the auction house.
7. SHIPPING - Although at this tim e Shipping is not an option, if it is in the future , these are the terms. Any purchases made that need to be shipped will be at the sole expense of the purchaser and will be added to the hammer price. Shipping of small items (size of a shoe box or smaller) will be handled in house at an additional cost to the buyer. These items may be sent through the USPS, Fed Ex, UPS, etc. You may contact shippers for quotes on larger items. Winning bidders that require shipping must notify us within 24 hours of the close of auction.
8. If we are prevented by fire, theft, or any other reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid, by the purchaser for such property. 9. Treasure Brokers Auctions & Estate Sales reserves the right to withdraw any lot at any time before the auction without liability. 10. The auctioneer reserves the right to reject any bid not commensurate with the value of the property offered. 11. A range of estimates may be given on a lot with either a low and/or high estimate. Estimates should not be relied on as a prediction of the actual selling price; estimates are simply an opinion. 12. If any applicable conditions herein are not complied with by the purchaser, Treasure Brokers Auctions & Estate Sales at its option may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) resell the property at public auction without reserve or minimum selling price, and the purchaser will be liable for any deficiency and costs, including handling charges, expenses of both sales, the commission on both sales at regular rates, all other charges due hereunder and incidental damages. 13. Technology Disruptions. Auctioneer will not be responsible for technology disruptions, errors, or failures (including disruptions to bidding or the failure to execute, recognize, or record online bids), whether caused by (i) loss of connectivity, breakdown, disruption, or failure of the Online Auction Platform, (ii) errors in programming or set-up of the online Auction, (iii) breakdown, disruption, or failure of a Bidder's internet connection, computer, or system, or (iv) otherwise. Auctioneer may, but will not be required to, continue, suspend, delay, extend, reschedule, close, re-set, or re-start the Auction because of disruptions caused by technology failures or errors, even after bidding has commenced.
8. If arrangements are made for Treasure Brokers to pick up sellers items, the items must be in the garage to allow for a “one-man” pick up. The fee will be determined on an individual basis.. The seller agrees that Treasure Brokers Auctions & Estate Sales of SWFL LLC. will not be held responsible for any dents, damage or items that incur breakage during the pickup process and transportation of the Sellers items.
