1. Licensing and Platform Identity: In compliance with Florida Statute Chapter 468, all online auctions are conducted by Next Bid Auctions (Florida License No. AB4232) and Auctioneer Shelly Earp (Florida License No. AU5619). These auctions are hosted electronically via the HiBid bidding platform.
2. Buyer’s Premium & Calculations:
A non-refundable 18% Buyer’s Premium is added to the final internet hammer price of every lot sold. Calculation Example: A winning online bid of $100.00 will incur an $18.00 buyer's premium, resulting in a $118.00 subtotal before applicable sales tax.
3. "As-Is, Where-Is" Condition & Preview Policy:
All property is sold "AS-IS, WHERE-IS" with all faults. No Warranties & No Refunds: Next Bid Auctions and its sellers make no guarantees, warranties, or representations, expressed or implied, concerning the correctness, authenticity, condition, quality, or fitness of any item. All sales are final. No refunds, returns, exchanges, or chargebacks will be issued under any circumstances. Definition of Item Preview: Because this is an online-only auction, "previewing" items consists entirely of carefully reviewing all provided photos and thoroughly reading the item descriptions. Bidders are solely responsible for conducting this digital preview and making their own determinations of condition prior to bidding.
4. HiBid Platform Bidding & "Soft Close"
To maintain a fair marketplace and prevent last-second bid-sniping, all lots utilize HiBid’s automated Soft Close feature: Bidding Extensions: If a bid is placed within the final 3 minutes of a lot's closing time, the bidding window for that specific lot automatically extends for an additional 2 minutes. Extensions will continue automatically until a full 3-minute period passes with no further bids. Max Bidding: Bidders may utilize the HiBid "Max Bid" feature to allow the system to automatically bid on their behalf using the lowest standard increments up to their specified limit. Account Liability: Bidders are 100% legally liable for all bids placed under their HiBid user credentials. Bids cannot be canceled, retracted, or modified.
5. Two-Phase Automatic Credit Card Billing & Tax Exemptions:
By registering for this auction through HiBid, you explicitly authorize Next Bid Auctions to automatically charge your credit card on file in two distinct phases using your current profile details:
Phase 1 (Immediate Close): Charged immediately following the close of the auction. This charge includes the hammer price, 18% buyer's premium, and 7.5% Florida sales tax. Sales Tax Exemptions: Tax-exempt buyers must have a valid resale certificate on file with Next Bid Auctions prior to the close of the auction to avoid sales tax. Please email your tax exemption documentation to shelly@nextbidauctions.info.
Phase 2 (Shipping & Logistics): Charged automatically to your credit card on file once your specific shipping fees, handling fees, and shipping insurance fees are calculated. Account Maintenance: Bidders are solely responsible for ensuring that their HiBid credit card billing profile information is completely up to date to prevent processing errors. Payment Default: If your card on file is declined or payment fails for either Phase 1 or Phase 2, you will forfeit the items, your account will be reported to HiBid, and you will face a permanent platform ban.
6. Local Pickup & Abandonment Rules Gallery Location:
Local pickups are conducted at the Next Bid Auctions Gallery, located at 1706 N. Magnolia Ave Ste 303, Ocala, FL 34475.Offsite Pickup Locations: Certain items or specialized auctions may be located at an "Offsite" location (private residence, business, or third-party facility) rather than the main gallery. These locations will be clearly marked in the auction description. Because offsite locations are often private property, there is no access to the site after the scheduled pickup window concludes. Offsite Auction Pickup Deadline: Items must be picked up during the set pickup date and hours. If you are unable to pick up items during the specified date and time, you must call us at 352-285-7197 to make alternative arrangements prior to the deadline (small items only). (Please note that furniture or heavy items being auctioned offsite must be picked up during the specified pickup date and time) Fees: If items are not picked up on the scheduled pickup date, a flat $25.00 storage fee will be automatically added to the total invoice. Final Forfeiture: Items left after 3 business days from the designated pick up date will be considered permanently abandoned. Next Bid Auctions will take ownership of the property to discard or resell without further notice, refund, or credit to the buyer.
7. Loading and Removal Responsibilities:
Buyer’s Sole Responsibility: The Purchaser is solely responsible for the disassembling, packing, moving, and loading of all purchased items. Labor and Equipment: Next Bid Auctions does not provide moving labor, lifting equipment (such as forklifts or dollies), or packing materials (such as boxes, bubble wrap, or tie-downs). Buyers must bring sufficient personal assistance and appropriate equipment to safely remove their items. Damage and Injury Liability: Any damage to items, premises, or injury to persons occurring during the loading process is the sole responsibility of the Buyer. By participating, the Buyer agrees to hold Next Bid Auctions and the property owner completely harmless from any incidents.
8. Shipping, Packaging, and Insurance Structure:
For buyers requesting shipping, fulfillment is handled strictly according to the following framework:
* Combined Shipping: We pack multiple items together in one box whenever it is safe and possible to minimize your shipping costs. We always seek the most affordable, economical rates available among our carriers for your package.
* Carrier Selection: We ship utilizing USPS, UPS, and FedEx to find the most secure and efficient method for your package.
* Items will only be shipped to the verified billing address listed on your HiBid profile.
* Handling Fee Table:
- Coins & Currency: Available + $3.00 handling fee
- Small / Flat Packages (Jewelry, small items): Available + $5.00 handling fee
- Medium Boxes (Glassware, toys, home decor): Available + $5.00 handling fee
- Large / Heavy Boxes (Tools, box lots up to 50 lbs): Available + $10.00 handling fee
- Furniture / Fragile Neon (Oversized items, large decor): No In-House Shipping Available (Local Pickup Only)
Mandatory Shipping Insurance: Carrier insurance will be automatically applied to your Phase 2 shipping invoice if any item in the shipment is deemed fragile/breakable, or if the total invoice value is greater than $50.00. This insurance fee typically runs between $1.50 and $2.50 per hundred dollars of value.
Shipping Payment Disputes: If your Phase 2 shipping payment is canceled, declined, or disputed in any way, the purchased items will be considered abandoned. The items will be forfeited within 3 business days, and Next Bid Auctions will take ownership of the property. No refunds will be given for the initial Phase 1 payment.
9. Waiver of Liability and Assumption of Risk: All persons attending an auction pickup window, whether at the Next Bid Auctions Gallery or any designated offsite location, do so at their own risk. Auction sites can be hazardous environments (containing heavy items, moving vehicles, or uneven terrain); you voluntarily assume all risks of loss, damage, or injury. Indemnification: Next Bid Auctions, LLC, its owners, employees, agents, and property owners shall not be held liable for any accidents, personal injuries, or property damage sustained by any person while on the premises. Registered bidders are entirely responsible for the safety and actions of any minor children or guests accompanying them.
10. Legal Venue:
These terms and conditions are governed by the laws of the State of Florida. Venue for any legal action arising from any auction conducted by Next Bid Auctions shall be located exclusively in Marion County, Florida.

Storage Fees: If you fail to pick up your items during the dedicated pickup date and time, a flat $25.00 storage fee will be automatically added to your invoice unless alternative arrangements were made. Strict 3-Day Forfeiture: All items must be removed, or shipping fees paid in full, within 3 business days of auction close. If left past 3 business days, items are legally deemed abandoned. Next Bid Auctions takes ownership to resell or discard; no refunds will be given for your initial item payment.
📦 4. SHIPPING & MANDATORY INSURANCE Fulfillment:
- We ship via USPS, UPS, and FedEx to your verified billing address.
- Combined shipping is used whenever safe.
- Handling Fees:
Coins: $3.00 | Small/Medium: $5.00 | Large Boxes (up to 50 lbs): $10.00.
No Shipping: Furniture and extremely fragile neon items are Local Pickup Only.
- Mandatory Insurance: Automatically applied to fragile items or any invoice over $50.00 (approx. $1.50–$2.50 per $100 of value).
- Payment Decline: If your Phase 2 shipping payment declines or is disputed, items are forfeited within 3 business days without a refund.

- Labor & Supplies: Buyers are solely responsible for packing, lifting, and loading. Next Bid Auctions does not provide labor, tools, carts, or packing materials. Bring your own help!
- Waiver: Entering the gallery or any offsite location is done at your own risk.
