GENERAL LIABILITY WAIVER & ASSUMPTION OF RISK
Hodl Secure LLC (Operating and referred to as “CouchEx”) – Estate Sale Style Retail

1. Acceptance of Terms
By entering and/or participating in any sale, event, or activity at CouchEx (“Store”), you (“Customer”) agree to the following terms and conditions.

2. Assumption of Risk
Customer acknowledges and understands that:
• Items offered for sale may be pre-owned, vintage, antique, or otherwise sold “as-is” with no warranties or guarantees expressed or implied.
• The Store environment may include uneven flooring, steps, cords, stacked merchandise, or other potential hazards inherent to estate sale-style events.
• Customer may handle, lift, or move items at their own risk, and such actions may involve potential for injury, damage to property, or other loss.

3. Release of Liability
To the fullest extent permitted by law, Customer hereby releases, waives, and discharges CouchEx, its owners, employees, agents, and contractors from any and all claims, demands, damages, losses, expenses, liabilities, or causes of action arising from:
• Personal injury, illness, or death;
• Damage to or loss of personal property;
• Any incident occurring on Store premises or in connection with purchase, transport, or use of Store merchandise, whether such claims arise from negligence or otherwise.

4. Indemnification
Customer agrees to indemnify and hold harmless CouchEx from any claims or expenses (including attorney fees) brought by third parties related to the Customer’s actions on the premises or in relation to purchased goods.

5. No Returns or Warranties
All sales are final. All items are sold “as-is” and “where-is”. The Store makes no representations or warranties as to the condition, safety, or fitness of any item.

6. Photography & Media Release
Customer consents to being photographed or recorded while on premises for marketing or security purposes without further permission or compensation.

7. Severability
If any portion of this Waiver is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

By entering the premises, Customer acknowledges they have read and understood this Waiver, and voluntarily assume all risks associated with visiting and shopping at CouchEx.
