West Coast Auction Company & Gallery 41
By registering for or participating in any auction conducted by West Coast Auction Company or Gallery 41 by West Coast Auction Company (?Company?), whether online or in person, you (?Bidder?) agree to be bound by these Conditions of Sale. All items are sold as-is, where-is without any guarantee unless stated by the Auctioneer at the time of sale. All auction purchases are final; we will not accept order cancellations.
All announcements made on sale day supersede any written or implied terms; check individual sales for supplementary terms, updates, or exceptions that may apply.
1. Registration
LiveAuctioneers Registration
To bid on any of our auctions through the LiveAuctioneers platform, you must have a completed account and an approved auction registration. Please register before the auction begins; once the auction has begun, the Company?s approval may be slow or unavailable.
Other Online Registration
Bidders must complete an account and register for the auction before their bid will be accepted. The platform may require proper identification and credit card information. Once a Bidder completes an online account and registers, approval is typically automatic.
On-Site Registration
Anyone wishing to bid on items in person at the gallery must register and obtain a bidding card. Registration is free and requires a state-issued ID, current address, phone number, and email address. Bidding numbers may not be shared.
General Registration Terms
The Company reserves the right to refuse to register any prospective Bidder for any reason.
2. Bidding
Platform Disclaimers: Our auctions run on multiple platforms; you may be the high Bidder on one platform but not on other platforms. Please pre-bid with your best and highest offer.
Internet Speed: Internet speed varies, and waiting to bid may result in the Auctioneer selling an item the Bidder intends to bid on?don?t wait; waiting in a simulcast auction offers no advantage.
Absentee/Phone Bidding: To make an absentee bid, please call 941-468-7815 or email ray@westcoastauctionco.com at least 24 hours before the auction starts.
Auctioneer Discretion: The Auctioneer has the final say on the highest Bidder.
3. Payment and Buyer?s Premium
Wire Transfer Requirement: ALL PURCHASES OVER $5,000.00 MUST BE MADE VIA WIRE TRANSFER. All international buyers must pay via bank wire transfer; there are no exceptions.

Bidders Premium: 23%
Credit Card Surcharges: A surcharge is added on all credit card transactions to cover the cost of acceptance. Processing fees are as follows: Credit Cards: 3.99% + $0.25 per transaction; ACH: 2.00% + $0.25 per transaction.
Autopay: We utilize the LiveAuctioneers Autopay system. If you bid from out of state or online, we will charge the credit card on file. If you do not make payment arrangements within 3 days (72 hours) of the invoice being sent, Autopay will automatically charge the total invoice amount.
Failure to Pay: We allow 3 days (72 hours) to pay in full. If we do not hear from you, we will email you a final notice, after which we will file an unpaid case on all accounts without exception unless arrangements are made.

ACH Discount: We offer a discount on the Buyer?s Premium for payments made by ACH/e-check, reducing the premium to 18%.
Credit Card Surcharges: A surcharge is added on all credit card transactions to cover the cost of acceptance, consistent with the rates disclosed under LiveAuctioneers Payment Details above.
Payment Deadline: Payment terms are governed by the specific platform?s payment policy. Where no platform-specific deadline applies, payment is due within 3 days (72 hours) of invoice.
Failure to Pay: The Company reserves the right to file an unpaid case and pursue collection on any account not paid within the applicable deadline, unless otherwise arranged in advance.
In-Person Payment Details
Bidders Premium: 18%
Cash/Check Discount: We offer a 3% discount on the Buyer?s Premium for in-person payments made by cash or check, reducing the premium to 15%.
4. Sales Tax
Applicable Sales Tax: Unless you present a valid exemption certificate, all purchases remain subject to sales tax. The local Charlotte County, Florida rate of 7% applies to on-site pickups and in-person transactions. For orders completed via LiveAuctioneers, LiveAuctioneers collects and remits tax directly as a marketplace facilitator, following its Tax Policy and destination state requirements. Sales tax for items bought through alternative online platforms is collected under each platform's legal tax obligations or processed directly by the Company when required.
Calculation: For sales where the Company is the collecting party, sales tax is calculated as: (Hammer Price + Buyer?s Premium) x Sales Tax Rate = Total Due.
Tax Exemption: To be tax-exempt, you must provide a copy of an active and verifiable Resale Certificate to the Company during registration or upload it to your LiveAuctioneers profile before bidding. Send copies to ray@westcoastauctionco.com.
5. Pick-Up, Shipping, and Storage
On-Site & Local Collection: Buyers must retrieve all purchased items on the day of the auction or by the designated pickup deadline specified in the event details. If you need local transport services, we can provide recommended moving vendor contacts at the front desk or via email.
Shipping via LiveAuctioneers/LiveShipping: Contact packaging@liveauctioneers.com for shipping inquiries.
Buyer-arranged Shipping: Shipping arrangements, merchandise pickup, and costs are the purchaser?s sole responsibility. The Auction Gallery is not staffed at all times. If you are arranging shipping on your own, please confirm a pickup time, which may require an off-hour/day pickup fee of up to $50.
Liability: The Company is not responsible for any denied claims or damages from the shipping offices or carrier the buyer chooses. Please refer to our Shipping Policy/LiveAuctioneers/LiveShipping Policy for further information.
Storage and Abandoned Property: Items not claimed within 7 days of the auction close date will be subject to a storage fee of $10.00 per day. Items remaining after 30 days will be considered abandoned and forfeited without refund, and may be resold by the Company.
6. Conditions of Sale
?As-Is, Where-Is?: All items are sold ?as-is, where-is? without guarantees or warranties of any kind unless explicitly stated by the Auctioneer at the time of sale. We are not an authentication service. Condition reports are matters of opinion, not statements of fact. The Auctioneer is not liable for errors or omissions.
Inspection: The absence of a condition statement does not imply perfect condition or freedom from wear, tear, or aging. Please inspect all items and photographs carefully before bidding; request further information if needed.
Catalog Accuracy and Descriptions: Catalogs, brochures, internet descriptions, and printed materials are guides only, based on sources believed to be reliable, but their accuracy is not guaranteed. The Auctioneers do not warrant the accuracy, genuineness, authenticity, condition, description, weight, count, or measure of any lots. We declare work as attributed based on the factors mentioned in the specific lot listing.
No Refunds: All sales are final. The Company does not offer refunds, returns, or exchanges on any purchased lot, as items are sold ?as-is, where-is? per this Section 6. Buyers who believe a transaction was processed in error should contact the Company directly at ray@westcoastauctionco.com before initiating a dispute with their card issuer, so the Company may investigate and resolve the matter directly.
Consigned Property: The Company sells consigned property as a sales agent for individuals, estates, trusts, public and private institutions, and other entities.
Specific Item Guarantees and Disclaimers
Coins and Fine Jewelry: The Company guarantees coins and fine jewelry to be authentic as listed, except for weight, which is guaranteed to be within a 1% margin of error. If proven otherwise, the Buyer must provide appropriate third-party documentation and return shipping at the Buyer?s sole expense.
Rugs: The Company does not guarantee the names or patterns of any rugs. All rug dimensions are approximate.
Jewelry: All weights, grades, sizes, and metal contents are approximate.
Clocks and Watches: All clocks and watches are sold as not working, even if they may be functional.
Antiques: Due to age, antiques have wear reflecting their years of use.
7. Firearms Policy
Sales: We do not sell firearms or ammunition via LiveAuctioneers.
Age Requirements: You must be over 21 years of age to purchase handguns and long guns.
Identification: A valid, government-issued ID is required at checkout.
Transfers: If you purchase a firearm and reside out of state, we will arrange for a local Federal Firearms Licensee (FFL) to handle the transfer into your name and determine the shipping costs.
Fees: We will charge any required shipping and gun transfer fees to the credit card on file once those costs are determined.
8. Governing Law and Disputes
Acceptance of Terms: Registering to bid or placing a bid indicates full understanding and acceptance of these terms. Terms may not be amended except by signed, written agreement.
Governing Law and Jurisdiction: Florida law governs these Conditions of Sale. Participation in this auction implies Bidder consent to the exclusive jurisdiction of the state courts located in Sarasota County, Florida, for any legal matters about both West Coast Auction Company and Gallery 41.
Liability for Damage or Loss: The Company assumes no responsibility for loss or damage occurring while staff members carry, handle, or load items for any individual. Furthermore, the Auction House is not liable for items that are lost or damaged if they are not collected within the timeframe specified in these Terms and Conditions.

1. Standard Shipping, Large Items & General Handling
In-house USPS Flat Rate Shipping: Items small enough to fit securely in standard USPS Flat Rate envelopes or boxes (Small, Medium, or Large) will ship and be billed at no more than the published commercial pricing of USPS Flat Rate postage, plus the cost of any selected insurance, extra fees (e.g., registered mail / certified mail), and a standard materials/handling fee for packing labor and supplies. We may, at our discretion, use a similar service through UPS/FedEx.
Combined Shipping: When possible, we will consolidate multiple lots into a single shipment to reduce shipping costs.
Larger Items: For items that exceed USPS Flat Rate box dimensions, buyers must request a custom quote for packing and shipping options by contacting the buyer?s platform: ray@westcoastauctionco.com or packaging@liveauctioneers.com.
Freight: We do not handle freight in-house. Buyers may request our list of local LTL freight packing and transport services, arrange service independently, or use services provided by LiveAuctioneers if purchased through the platform.
2. Timelines, Storage, & International Shipping
Processing Timeframe: Items are typically packed and shipped within 3-5 business days of cleared payment and receipt of confirmed shipping arrangements.
Storage and Abandonment: Buyers must arrange shipping or freight within 14 days of payment. Items left beyond this period may be subject to storage fees or considered abandoned and forfeited without refund, at the auction house?s discretion.
International Shipping: For international shipments, the buyer is solely responsible for all customs, duties, and import taxes. We are not responsible for delays caused by customs handling.
3. Coins, Active Currency, Stamps, & Bullion
Buyers may select from two shipping options for these items:
Option A: USPS Registered Mail (Insured)
Fully covered up to $50,000 per package via USPS declared value.
Double-boxed construction required.
All outer box seams must be completely sealed with water-activated paper gummed tape to create a tamper-evident seal.
Signature and strict physical chain-of-custody tracking required upon receipt.
Option B: Uninsured Transit (Buyer Waiver)
Shipped via standard trackable carrier services (USPS Ground Advantage/Priority Mail or UPS Ground) without additional carrier/third-party insurance.
Requires a written insurance waiver submitted via email before shipment. By providing this emailed waiver to ray@westcoastauctionco.com, the buyer assumes 100% financial liability for loss, damage, or theft in transit once the carrier accepts the package.
4. Jewelry, Fine Art, & Loose Precious Stones
Primary Carriers: USPS Registered Mail (for fully insured shipments) or standard UPS/USPS carrier services.
Fine Art Crating: Standard fine art shipments that require custom crating are not handled in-house and must be arranged via third-party freight or transport (see Section 1 for Freight details).
Insurance Limits: USPS (Registered Mail): up to $50,000 per shipment. Standard Carrier Services: subject to standard carrier declared value limits unless an insurance waiver is submitted via email direction for uninsured transit.
5. Firearms
All modern firearms are transferred and shipped exclusively through a designated third-party Federal Firearms License (FFL) holder.
Firearms are only transferred to a valid FFL in the buyer?s state of residence, in accordance with federal law.
Exemptions: Pre-1898 antique firearms and designated black powder weapons are exempt from the FFL transfer requirement, as permitted by federal law, and may ship directly to the buyer where local laws permit.
Fees: The buyer is responsible for any transfer fees charged by their receiving FFL dealer.
We do not sell or ship ammunition.
6. Knives & Sharp Instruments
Switchblades and Automatic Knives: Not sold / not shipped.
Standard Knives (Pocket, Fixed-Blade, Kitchen): Permitted via USPS and UPS.
Packaging: Blades must be sheathed or securely wrapped in a double layer of cushioning (e.g., bubble wrap) inside a rigid outer box to prevent puncture or shifting in transit. The outer packaging must not bear any markings indicating the package contains a knife.
7. Delivery, Security Procedures, & Insurance Waivers
Signature Requirements: Direct or Adult Signature Required on all shipments valued over $500.
Address Restrictions: We will not ship high-value items, restricted goods, or shipments using Registered Mail to unverified third-party freight forwarders. Additionally, standard UPS and FedEx services do not deliver to PO Boxes; you must provide a physical street address.
General Insurance Waiver (Ship at Your Own Risk): Buyers may elect to waive shipping insurance on any order. This requires written direction sent to us via email at ray@westcoastauctionco.com. By explicitly waiving coverage via email, the buyer assumes all liability for any loss, theft, or damage that occurs once the package is surrendered to the shipping carrier.
8. Claims
General: West Coast Auction Company is not responsible for any denied claims or damages from the shipping offices or carrier the buyer chooses.
Documentation: We will provide support/documentation when available to assist the buyer with any claims.
Claims Timeframe: Buyers must notify West Coast Auction Company of any lost or damaged packages within 2 business days of the delivery date (or expected delivery date, in the case of loss) to receive documentation support.
Third-party insurance is offered at an additional cost.

4. Jewelry, Fine Art, & Loose Precious Stones
Primary Carriers: USPS Registered Mail (for fully insured shipments) or standard UPS/USPS carrier services.
Fine Art Crating: Standard fine art shipments that require custom crating are not handled in-house and must be arranged via third-party freight or transport (see Section 1 for Freight details).
Insurance Limits: USPS (Registered Mail): up to $50,000 per shipment. Standard Carrier Services: subject to standard carrier declared value limits unless an insurance waiver is submitted via email direction for uninsured transit.
5. Firearms
All modern firearms are transferred and shipped exclusively through a designated third-party Federal Firearms License (FFL) holder.
Firearms are only transferred to a valid FFL in the buyer?s state of residence, in accordance with federal law.
Exemptions: Pre-1898 antique firearms and designated black powder weapons are exempt from the FFL transfer requirement, as permitted by federal law, and may ship directly to the buyer where local laws permit.
Fees: The buyer is responsible for any transfer fees charged by their receiving FFL dealer.
We do not sell or ship ammunition.
6. Knives & Sharp Instruments
Switchblades and Automatic Knives: Not sold / not shipped.
Standard Knives (Pocket, Fixed-Blade, Kitchen): Permitted via USPS and UPS.
Packaging: Blades must be sheathed or securely wrapped in a double layer of cushioning (e.g., bubble wrap) inside a rigid outer box to prevent puncture or shifting in transit. The outer packaging must not bear any markings indicating the package contains a knife.
7. Delivery, Security Procedures, & Insurance Waivers
Signature Requirements: Direct or Adult Signature Required on all shipments valued over $500.
Address Restrictions: We will not ship high-value items, restricted goods, or shipments using Registered Mail to unverified third-party freight forwarders. Additionally, standard UPS and FedEx services do not deliver to PO Boxes; you must provide a physical street address.
General Insurance Waiver (Ship at Your Own Risk): Buyers may elect to waive shipping insurance on any order. This requires written direction sent to us via email at ray@westcoastauctionco.com. By explicitly waiving coverage via email, the buyer assumes all liability for any loss, theft, or damage that occurs once the package is surrendered to the shipping carrier.
8. Claims
General: West Coast Auction Company is not responsible for any denied claims or damages from the shipping offices or carrier the buyer chooses.
Documentation: We will provide support/documentation when available to assist the buyer with any claims.
Claims Timeframe: Buyers must notify West Coast Auction Company of any lost or damaged packages within 2 business days of the delivery date (or expected delivery date, in the case of loss) to receive documentation support.
Third-party insurance is offered at an additional cost.
