The lots listed in this catalogue will be offered by Serenity Gallerie as owner or as agent for consignor subject to the following terms and conditions. Where Serenity Gallery is agent, the contract is between seller and buyer. The following Conditions of Sale constitute the entire agreement with the purchaser relative to the property listed in this catalogue. By bidding you agree to be bound by these terms.
2. AS IS
All lots are sold "AS IS" and without recourse and neither Serenity Gallerie nor its consignor makes any warranties or representations, express or implied, with respect to such lots, except for the limited warranties. Aftermarket modifications may affect manufacturer service eligibility. Any appraisals provided are by independent third parties and are opinions only. Appraisal values do not represent resale or insurance value. All Art dates and attributions are approximate and opinion only. Measurements are approximate.
Serenity Gallerie nor its consignor makes any express or implied warranty or representation of any kind or nature with respect to fitness for purpose, correctness of the catalogue/listing or other description of the physical condition, size, quality, rarity, importance, medium, material, genuineness, attribution, provenance, period, culture, source, origin, exhibitions, literature or historical significance of any lot sold. 3. WITHDRAWAL
Serenity Gallerie reserves the right to withdraw any lot at any time prior to the commencement of bidding for such lot and shall have no liability whatsoever for such withdrawal.
4. RESERVES
If the auctioneer decides that any opening bid is below the value of the lot offered, the auctioneer may reject that bid and withdraw the lot from sale; and if, having acknowledged an opening bid, he decides that any advance thereafter is insufficient, he may reject that advance. Unless otherwise indicated, all lots are offered subject to a reserve, which is the confidential minimum price below which such lot will not be sold. No reserve will exceed the low estimate of the lot. Reserves are agreed upon with the consignor or, in the absence thereof, in the absolute discretion of Serenity Gallerie.
5. ESTIMATES
Each lot is given a low and high estimate representing that range which, in the opinion of Serenity Gallerie, represents a fair and probable auction value. When possible, the estimate is based on previous auction records of comparable property, condition, rarity, quality and provenances. The estimates are often determined several months before a sale and are therefore subject to change upon further research of the property, or to reflect market conditions or currency fluctuations. Estimates are subject to revision. Actual prices realized for items can fall below or above this range. An estimate of the selling price should not be relied on as a statement that this is the price at which the item will sell or its value for any other purpose. Estimates do not include the buyer's premium.
6. BIDDING
Serenity Gallerie reserves the right, at our complete discretion, to refuse admission or participation in any auction and to reject any bid, as well as the right to refuse to acknowledge any bidder. The highest bidder will be the purchaser. Serenity Gallerie’s sale record shall be conclusive should any dispute arise after the sale.
7. PURCHASER'S RESPONSIBILITY
Title passes upon the fall of the auctioneer's hammer to the highest acknowledged bidder, subject to the conditions of sale set forth herein. Such bidder there upon assumes full risk and responsibility there for (including, without limitation, liability for or damage to frames and glass covering prints, paintings or other works). Although in our discretion we will execute orders or absentee bids or accept telephone bids as a convenience to clients who are not present at auctions, we are not responsible for any errors or omissions in connection therewith.
When making a bid, a bidder is accepting personal liability to pay the purchase price. All bids are subject to a Buyer’s Premium which is in addition to the placed successful bid otherwise defined as the hammer price. The Buyer’s Premium is 20% for online bidding on LiveAuctioneers. All purchases regardless of bidding method are subject to the Buyer's Premium and appropriate Sales Tax.
Prior to the sale, the buyer must provide us with his or her name and permanent address and, if requested, details of the bank from which payment will be made.
The balance of the purchase price, if any, will be paid not later than 5 pm one (1) day following the day of the auction. Such payment shall be made in U.S. dollars by bank wire transfers, money orders and/or cashier’s checks unless other arrangements are made with Serenity Gallerie. All international invoices require payment by wire only.
Any objects offered at this auction which contain materials from a species that is endangered or protected, including, but not limited to, ivory, coral and tortoiseshell, may require a license or certificate prior to exportation from the United States or an individual state and additional certificates or licenses for importation into another state or country. Some materials may not be exported, imported into other states or countries or resold. It is the purchaser's responsibility to be aware of applicable laws and regulations and to obtain any required export or import licenses or certificates and any other required documentation. Further, the purchaser shall be responsible for on-time payment of the full purchase price of the lot, even if the obtaining of any such license is denied or delayed. Serenity Gallerie assumes no liability for failing to identify materials from endangered or protected species or for incorrectly identifying such materials.
8. RETURNS
All property is sold AS IS, WHERE IS, with all faults, and ALL SALES ARE FINAL. Returns may only be made with written authorization of Serenity Gallerie, in Serenity Gallerie’s sole discretion. To request a return, you must provide a written request fully explaining the basis for the return no later than three (3) days after your receipt of the lot. Under no circumstances will any amounts other than the winning bid amount be refunded. A restocking fee of 20% of the full invoice amount may apply. All authorized returns must be received in exactly the same condition as when originally shipped to buyer, or they will be returned to the buyer at the buyer's cost. Any unauthorized returns will be refused. Refusal to accept merchandise delivered by Serenity Gallerie to the bidder constitutes an unauthorized return in direct violation of these general terms and conditions.
9. LIMITED LIABILITY
If for any cause a purchased lot cannot be delivered in as good condition as at the time of sale, or should any purchased lot be stolen or mis-delivered or lost prior to delivery, Serenity Gallerie shall not be liable. We are not responsible for the acts or omissions of carriers or packers of purchased lots, whether or not recommended by us. Packing and handling of purchased lots by us is at the entire risk of the purchaser and Serenity Gallerie will have no liability for any loss or damage to such items.
10. SERENITY GALLERIE EMPLOYEES
Employees of Serenity Gallerie are not prohibited from bidding on property. In the course of their employment, it is possible that they may have access to information not available to the public.
11. WAIVER OF CONDITIONS
Any and all of these conditions may be waived or modified in the sole discretion of Serenity Gallerie.
12. DAMAGES
All measurements and weights are approximate. Serenity Gallerie is not responsible for damage of glass covering paintings, drawings and other works or frames regardless of cause.
13. CONDITIONS OF SALE
If any part of these Conditions of Sale is found by any court to be invalid, illegal or unenforceable, the balance of the conditions shall continue to be valid to the fullest extent permitted by law.
14. RIGHTS AND OBLIGATIONS
The rights and obligations of the parties with respect to these Conditions of Sale and Terms of Guarantee, as well as the purchaser's and our respective rights and obligations hereunder, the conduct of the auction and any matters connected with any of the foregoing, shall be governed and interpreted by the laws of the State of Florida. By bidding at auction, whether present in person or by agent, by written bid, telephone or other means, the buyer shall be deemed to have submitted, for the benefit of Serenity Gallerie, to the exclusive jurisdiction of the federal or state courts located in the state of Florida and county of Pinellas and waives any objection to the jurisdiction and venue of any such court.
15. CONTRACT
By registering for and/or placing a bid in any Serenity Gallerie auction, you acknowledge that you have read, understand, and agree to our Shipping, Payment & Auction Policies.
16. PAYMENT
Serenity Gallerie accepts Live Payments, bank wire transfers, money orders and cashier’s checks. All international invoices require payment by wire only. Please call Serenity Gallerie at: +1 (727) 351-2622, or email us at: admin@serenitygallerie.com for wire instructions. Payment through LiveAuctioneers is preferred. You can pay via any major credit card or Bank Transfer (ACH) by clicking the "Pay Now" button on your LiveAuctioneers invoice. See below for Autopay details. If you choose to pay by credit card, please note that we impose a surcharge of 3.99% on the transaction amount on all credit card transactions.
17. AUTOPAY
If you have not contacted us to arrange payment within seventy-two (72 hours) of the time the invoice is sent, we will charge the credit card you used to register for the auction for the full amount listed on your invoice.
18. SHIPPING
Serenity Gallerie covers shipping as a courtesy to our bidders; this courtesy is not extended to shipments outside of the United States and is subject to change. Serenity Gallerie’s corporate address is in the United States; however, items may ship from multiple locations, including but not limited to the United States, United Kingdom, Europe, and Asia. All shipping is conducted through third-party carriers including but not limited to FedEx, DHL, UPS, USPS, Royal Mail, or other logistics providers. Typical shipment processing time is five (5) to ten (10) business days after payment clears, though delays may occur. If goods are not received within thirty (30) days from shipment date, buyer must promptly notify Serenity Gallerie at admin@serenitygallerie.com. Serenity Gallerie does not retain shipping records beyond sixty (60) days from the shipment date.
19. INTERNATIONAL SHIPMENTS / DUTIES AND TAXES
Items that are shipped internationally may be subject to customs duties, taxes or other fees set by the destination country and are solely the customer’s responsibility. These fees are in addition to the price and shipping cost charged at checkout and are typically collected prior to delivery depending on your destination. It is the customer’s responsibility to ensure that the item(s) can be legally imported into the destination country. Regulations may prohibit importation of items made with exotic materials. International shipping costs will be determined based on item type, weight and destination. Serenity Gallerie will provide liability coverage for property in transit subject to certain exclusions. Signature is required at time of delivery.
20. INSURANCE
If buyer requires insurance, buyer must request and arrange insurance prior to shipment. Shipments processed through LiveAuctioneers may include platform-provided insurance.
21. IN-PERSON PICKUP
Items may not be picked up in person. If you have any questions about shipping, please notify Serenity Gallerie at admin@serenitygallerie.com. Serenity Gallerie is not responsible for VAT, custom duties, brokerage fees, import taxes, or government fees.
22. BUYER'S PREMIUM
When making a bid, a bidder is accepting personal liability to pay the purchase price. All bids are subject to a Buyer’s Premium which is in addition to the placed successful bid otherwise defined as the hammer price. The Buyer’s Premium is 20% for online bidding on LiveAuctioneers. All purchases regardless of bidding method are subject to the Buyer's Premium and appropriate Sales Tax.
23. SALES TAX / TAXES
Applicable sales tax will also be added to the final total. Florida Sales Tax is charged on the hammer price, buyer's premium and any other applicable charges on any property delivered in Florida State, regardless of the state or country in which the purchaser resides or does business. United States Clients: If you are a reseller using a resale certificate to purchase property that is intended for resale, you must register the account associated with the name that appears in the purchaser field of the resale certificate. Serenity Gallerie is unable to upload a certificate to your LiveAuctioneers account on your behalf. The Sales Tax Certificate cannot be uploaded through their mobile app. You will need to access your Account Settings through a desktop. It can take a couple days for your certificate to process, so make sure to add it to your account page as soon as possible. If you're unable to upload any of your documents or you have any questions about sales tax, please send them to payments@liveauctioneers.com for assistance. Serenity Gallerie cannot refund Sales Tax. If you need a Sales Tax refund, notify Serenity Gallerie at admin@serenitygallerie.com and we will provide you with an Assignment of Rights to Refund of Tax (Form DR-26A).
