TERMS & CONDITIONS OF SALE
By registering, bidding, or purchasing items in this auction, the bidder ("Buyer") explicitly agrees to be legally bound by the following terms, conditions, and policies of the Auction House.
1. ALL SALES ARE FINAL ("AS-IS, WHERE-IS")
General Condition: All lots are sold "AS-IS, WHERE-IS" with all faults, imperfections, and descriptions. No warranties or representations of any kind, express or implied, are made by the Auction House.
Jewelry Disclosures: Silver jewelry items are cataloged to the best of our technical ability according to visible hallmarks (e.g., .925, Sterling, maker's marks). Carat weights, stone counts, and measurements are approximate.
Art Glass Disclosures: Detailed condition reports will note significant cracks, chips, or repairs. However, minor manufacturing variations inherent to hand-blown glass (including air bubbles, pontil scars, or slight asymmetrical variations) are standard characteristics of the medium and are not considered defects.
Buyer Responsibility: It is the Buyer's sole responsibility to preview items online and request a detailed condition report prior to bidding. Buyer's remorse, minor condition variances, or shipping costs do not constitute valid grounds for returns, refunds, cancellations, or credit card disputes.
2. INVOICING & PAYMENT DEADLINES
Invoicing: Digital invoices will be sent via email within twenty-four (24) hours of the auction's conclusion.
Deadline: Payment in full is strictly due within five (5) calendar days of the invoice date.
3. BUYER?S PREMIUM & TAXES
Buyer's Premium: A 25% Buyer's Premium will be added to the hammer price of each lot won and is considered part of the total contract purchase price.
Sales Tax: Applicable state and local sales taxes will be collected based on the Buyer's shipping destination, as mandated by state marketplace facilitator laws, unless a valid resale tax certificate is filed and approved by LiveAuctioneers prior to payment submission.
4. ACCEPTED PAYMENT METHODS & AUTO-PAY
Live Payments: All invoices must be processed securely through the LiveAuctioneers Live Payments system. Accepted methods include Credit/Debit Cards (Visa, MasterCard, Discover, American Express) and ACH Bank Transfers.
Automatic Charge Policy (Auto-Pay): By registering for this auction, the Buyer authorizes the Auction House to automatically charge the credit card on file with LiveAuctioneers for the full invoice amount if payment has not been manually submitted within seventy-two (72) hours (3 days) of the auction's closing.
5. HIGH-VALUE SECURITY CAP (FRAUD PREVENTION)
To protect against credit card fraud on fine estate jewelry and highly collectible art glass:
Domestic Invoices over $5,000 USD must be paid via Bank Wire Transfer or ACH Bank Transfer.
International Invoices over $2,000 USD must be paid via Bank Wire Transfer only.
Credit cards will not be accepted for invoices exceeding these thresholds. Wire instructions will be attached automatically to qualifying high-value invoices.
6. SHIPPING, PACKING & DELIVERY TERMS
Buyer?s Expense: Shipping, specialized packing, and insurance costs are entirely separate expenses and are the sole responsibility of the Buyer. Items will not be released to a carrier until the primary merchandise invoice is paid in full.
Fragile Packing (Art Glass): Art glass requires professional handling, custom structural boxes, double-boxing, and heavy bubble wrapping to guarantee safe transit. Packing material and labor fees will reflect this necessary level of care.
Fulfillment Options:
- Option A: LiveShipping. If a lot is eligible, a shipping quote will display directly on your invoice. Paying this authorizes LiveAuctioneers to generate the label and dispatch the carrier.
- Option B: In-House Shipping. For small jewelry items and select small glass pieces, the Auction House may offer in-house packing via USPS Priority Mail or FedEx, billed via a separate secondary invoice.
- Option C: Third-Party Shippers. For oversized, extraordinarily fragile, or high-value glass art, buyers must contract an independent local packing and shipping service (e.g., local UPS Store or fine art handler).
Release Timeline: Please allow 7 to 14 business days following payment clearance for items to be securely packed and shipped (or released to your contracted third-party carrier).
7. INSURANCE, DAMAGES & LIABILITY LIMITATION
Insurance: All shipments must be fully insured for the final purchase price (hammer price plus buyer?s premium).
Transfer of Liability: Once merchandise is handed over to the shipping carrier (USPS, FedEx, UPS, or a third-party handler), the Auction House relinquishes all physical and financial responsibility. The Auction House is not liable for carrier delays, lost packages, or items damaged in transit.
Damage Claims: In the rare event of damage during transit, the Buyer must retain all original packing materials and shipping boxes exactly as received and file a damage claim directly with the carrier. The Auction House will provide any necessary invoicing documentation to assist you.
8. INTERNATIONAL BUYERS
International shipping is evaluated on a case-by-case basis and must be approved prior to bidding. International Buyers are entirely responsible for all customs duties, taxes, VAT, clearance fees, and compliance with import regulations. We will not alter customs declarations or undervalue items on commercial invoices.
9. BIDDING DISPUTES & RUNNING OF THE SALE
The Auctioneer holds the ultimate authority regarding the acceptance of bids, the advance of bidding increments, and the resolution of any bidding disputes. In the event of a technical disruption, platform lag, or disputed tie-bid, the Auctioneer reserves the right to reopen the bidding or withdraw the lot entirely.
10. NON-PAYMENT & ABANDONED PROPERTY CONSEQUENCES
Non-Payment Default: Any invoice remaining completely unpaid seven (7) calendar days after the auction date will be considered in default. At that time, the Auction House reserves the right to void the sale, retain the merchandise, and report the non-paying bidder to LiveAuctioneers. This results in a permanent dispute strike, a severe drop in the buyer's platform rating, and a block from participating in future auctions across the network.
Abandoned Property: Any property paid for but remaining at our facility without shipping arrangements or pickup confirmation 14 (14) calendar days after the auction date.
