BUYERS PREMIUMS:
• 16.5% Total Online Buyer Premium: A 13.5% buyer’s premium applies to all purchases, plus an additional 3% internet fee. Total Online Buyer Premium is 16.5%.
ADDITIONAL FEES:
• 9% Local Sales Tax: A 9% local sales tax applies to all purchases. Sales tax is calculated on the bid/hammer price plus the buyer’s premium. To be exempt from sales tax, proper exemption forms must be received by our office by October 2, 2026.
• 3% Credit Card Fee on All Purchases: Buyers paying by credit card will be charged an additional 3% fee. Bidder agrees that under no circumstances will he/she initiate a chargeback on his/her credit card. NO credit card purchases over $10,000.
• $25 Wire Transfer Fee Per Transfer: Buyers paying by wire transfer will be charged a $25 fee for each transfer.
• $60 Title Fee Per Item: A $60 title fee applies to each titled item. Titles will not be processed on auction day. Van Byars Auctions will provide the purchaser with the proper documentation needed to transfer the title at the purchaser’s county office. The purchaser is responsible for transferring the title at the county level. Title documentation from Van Byars Auctions will be sent via certified mail. Van Byars Auctions is not responsible for titles that are lost, damaged, or stolen.
• $10 Bill of Sale Fee Per Item: A $10 bill of sale fee applies to each item requiring a bill of sale.
ADDITIONAL TERMS & CONDITIONS:
By registering to bid or placing a bid, you agree to be bound by these Terms & Conditions, as well as any additional terms announced at the auction or posted by Proxibid.com.
All internet bids carry the same legal and binding effect as if you were physically present at the auction. Statements made by the auctioneer on sale day take precedence over all printed or online material. While all information is believed to be accurate, there are no guarantees - expressed or implied.
1. AS-IS, WHERE-IS – ALL SALES FINAL
• All property is sold “AS IS, WHERE IS.” No returns, refunds, or exchanges. No exceptions. All Sales Final. Bidder acknowledges and understands that no items may be returned after purchase.
• Buyers are responsible for determining condition, age, authenticity, value, or any other factor before bidding. Please read all descriptions and view all photos.
• Public inspection is available - bidders are encouraged to examine items in person when possible. We try our best to accurately describe the items in the auction, however, it is ultimately the responsibility of you, the buyer, to make yourself aware of the condition of any and all items you may have interest in.
• Van Byars Auctions may provide descriptions in advertising, online, or at the auction, but these are for reference only and not a warranty or guarantee.
• In no event shall Van Byars Auctions. be liable for implied warranties of merchantability or fitness for a particular purpose.
2. OFF-SITE & ONLINE BIDDING
• Bidders participating remotely acknowledge they may not have the same ability to inspect items as on-site bidders.
• The auction company will make every effort to provide accurate descriptions, but is not responsible for errors or omissions unless a material and intentional misrepresentation has occurred. Please read all descriptions and view all photos. We try our best to accurately describe the items in the auction, however, it is ultimately the responsibility of you, the buyer, to make yourself aware of the condition of any and all items you may have interest in.
• Van Byars Auctions provides internet pre-auction and live internet bidding as a service to our customers. Under no circumstances will Van Byars Auctions be held responsible for internet outages, bidding software malfunctions, missed bids, delays in transmission, or any other technical issues. The auctioneer is not liable for any failure of the internet or bidding platform to function properly. We strongly recommend you do not bid using a mobile device.
• To ensure your bid is recognized, consider using the proxy-bid feature and submit your maximum bid at least 24 hours before the auction.
• As a registered bidder you are responsible for each and every bid and your account, all bids placed on your account will be binding.
3. AUCTIONEER’S RIGHTS
Van Byars Auctions reserves the right to:
• Withdraw or re-catalog any items.
• Accept or reject any bid.
• Resolve any disputes at their sole discretion.
4. MILEAGE NOTE
• Mileage provided by the City of Columbus. Please check photos and lot descriptions, which will be updated the week of the auction. As a buyer, it is your responsibility to verify miles.
5. VEHICLE IDENTIFICATION NUMBER (VIN) NOTE
• On rolling stock, lot descriptions are described using a VIN decoder. Please verify for yourself all details included but not limited to model, trim level, and all usability, etc.
6. TITLE REGISTRATION PROCESS
• Titles will not be processed on auction day. The auction company will provide any successful purchaser all proper documentation needed for title transfer at purchaser’s county office. You, as the purchaser, will be transferring title at the county level. Documentation from Van Byars Auctions will be sent via certified mail. Van Byars Auctions is NOT responsible if title is lost, damaged, or stolen.
7. TITLE REGISTRATION / BILL OF SALE DETAILS
• Any and all vehicle titles and/or bills of sale shall be issued and registered exclusively in the name and address provided by the purchaser at the time of registration. Payment shall be made by the registered purchaser only, and not by any other individual or entity. No changes, substitutions, or alterations to the name or address will be permitted after registration. The auctioneer reserves the right to void any sale and/or retain deposits in the event the purchaser fails to comply with these requirements. The purchaser shall be solely responsible and liable for the accuracy of all information provided at the time of registration, and neither the auctioneer nor the seller shall bear any responsibility for errors, omissions, or misrepresentations supplied by the purchaser.
8. TITLE AD VALOREM TAX (TAVT)
• Effective February 2013, pursuant to Georgia Department of Revenue regulations, all purchasers of new or used motor vehicles are required to pay a one-time Title Ad Valorem Tax (“TAVT”) based on the fair market value of the vehicle. Purchasers are solely responsible for the payment of all applicable taxes, fees, and charges. These fees will not be charged by Van Byars Auctions, these fees will be charged at the county level.
9. VEHICLE EMISSIONS COUNTIES
• PLEASE BE AWARE: MUSCOGEE COUNTY IS NOT AN EMMISSON COUNTY, AND NO ITEMS IN THIS AUCTION HAVE BEEN TESTED FOR EMISSIONS. We will not, do not, and can not guarantee any item in the auction will pass emissions.
PICKUP & ITEM REMOVAL:
We recommend that all items be removed from the auction site on the day of the event.
All items must be removed by Wednesday, October 7 by 2PM, NO EXCEPTIONS. Any items not removed by this deadline will be considered abandoned, and ownership will revert to the auction company for resale at a later date.
SHIPPING INSTRUCTIONS:
Van Byars Auctions DOES NOT SHIP.
The buyer is solely responsible for the removal of all purchased items, including all associated costs, logistics, arrangements, liabilities, and risks. This includes packing, crating, strapping, loading, and securing items for transport.
Van Byars Auctions may be able to assist with handling or loading for an additional fee, but does not provide shipping services.
All purchased items must be removed by 2:00 PM EST on Wednesday, October 7, 2026. Items not removed by this deadline will be considered forfeited, with no refunds issued.
