Terms & Conditions
***DISCLAIMER***
Piece By Piece Solutions LLC (hereinafter “Piece by Piece”) reserves the right to refuse any individual Bidder/Buyer admission to the auction, to reject bids at any time, and to withdraw any lot at any time from the auction. The terms of this agreement may be modified without notice. Auctions may be recorded for both audio and video for security and quality assurance.


REGISTRATION:
By registering to participate and bid in a Piece by Piece auction, Bidder/Buyer agrees to the Terms and Conditions of Sale as follows: (1) Payments for winning bids must be made by credit card through the Auctioneer Software website upon auction closing. If the Bidder/Buyer fails to pay the invoice prior to the start of auction pick up, Piece By Piece reserves the right to process full payments by using the credit card on file with Auctioneer Software; and (2) Bidder/Buyer agrees that they are available to remove purchased auction items within the stated pick-up time frame for each auction. It is the responsibility of the Bidder/Buyer to arrange moving help for pick-up of furniture and other large items. Participants must be 18 years or older to register and agree that all information provided during the registration process will be true and accurate. Failure to recover items will result in additional removal fees and termination of account.


WARRANTIES & REPRESENTATIONS:
All property is sold AS IS, WHERE-IS, and without recourse. Piece By Piece, for itself and as agent for the seller, makes no warranties or representations of any kind with respect to any Lot. Buyer agrees that in no event shall Piece by Piece be held responsible or liable for the correctness, description, genuineness, authorship, attribution, provenance, period, culture, source, origin, value, or condition of any lot. Nothing said or done by Piece By Piece shall be deemed a warranty of representation or an assumption of liability by Piece By Piece.


Bidders Duty to Inquire and Investigate:
You acknowledge that the Auction Manager is providing you with detailed photos and descriptions of the items listed for sale in this auction. The Auctioneer strongly encourages you to review the photos closely and ask any questions you may have. If you choose not to ask questions or are in doubt about the condition, completeness, or suitability of a given item, please bid accordingly.


BIDDING:
Piece By Piece auctions accept bids in real time from all valid & approved bidders. Do NOT bid if you do not intend to pick-up during the specified dates and times. ALL BIDS ARE CONSIDERED LEGALLY BINDING AND NON-NEGOTIABLE.


Closing:
The Auctioneer’s online auctions are designed to mimic traditional “live” actions. For this reason, this auction will have a staggered, dynamic closing. You must continuously refresh your browser during the closing process to see the most current activity on your items, both prior to placing your bid and after submitting your bid (a) Staggered Closing: This online auction will generally begin to close at a rate of two items per minute, every minute. Items’ closing times will be displayed on the website, but may be extended past their scheduled closing time, as a result of the Auctioneer’s dynamic closing feature. (b) Dynamic Closing: The closing time of an item is generally extended an additional two minutes whenever a bid is placed within the two minutes leading up to an item’s scheduled closing time.



CONDITION:
The condition of an auction item is stated based on our professional opinion and should not be treated as a statement of fact. As such, Piece By Piece is not responsible for any omissions or errors to these statements.



BUYERS PREMIUM:
Buyer agrees to pay Piece By Piece a 20% buyer's premium on each lot won based on winning bid amounts.



Deposit:
In order for the Auctioneer to process your winning bid, we must have a working Visa, MasterCard, Discover, or American Express associated with your account.


SALES TAX:
All purchases are subject to the sales tax rate as stipulated by their city and/or state. If you intend to supply Piece By Piece with a valid tax-exempt certificate, you must do so PRIOR to placing a bid.



PAYMENT & PICKUP POLICY:
ALL SALES ARE FINAL and Non-Negotiable.

Full payment is due upon auction closing. Failure to remove purchased auction items within the stated pick-up time frame for this auction will be considered abandonment and ownership will be transferred to Piece By Piece. There may be additional removal fees for items not recovered.



Indemnification:
You agree to indemnify, defend, and hold harmless the Auctioneer and its employees, officers, owners, affiliates, agents, and representatives from and against any claims, losses, damages, liabilities, judgments, fees, costs, and expenses, including reasonable legal fees and costs, related to, arising from, or associated with you, your agents or representatives – including, but not limited to, personal injury or property damage caused at any sales site or during removal or transportation of items won at auction, any dispute with another bidder, or any violation of these Terms and Conditions.
