Online-only bidding for this auction will close on the date and time indicated above and on WiregrassAuctionGroup.com. All posted times reference Eastern Time. The closing time of each lot is subject to Wiregrass Auction Group’s auto-extend feature. When the time remaining to bid on an item falls below 3 minutes, a new bid placed on that item will reset the bidding clock to 3 minutes. Auto-extend bidding will continue on an item-by-item basis until no further bids are received.
To simplify the bidding process, we encourage bidders to download the Wiregrass Auction Group mobile bidding app, available in the iTunes App Store or on Google Play.
Bidder Registration & Verification
A valid credit or debit card is required to register for this auction. Upon registering, a $500.00 authorization will be placed against the card used for registration. This is not a permanent charge; it is a pre-authorization used to verify bidder identity and the availability of funds. WAG has no control over how long the verification charge remains on your card — that is determined solely by your card company. WAG reserves the right to accept or reject bidder registrations at its sole discretion.
Buyer’s Premium
18% Buyer’s Premium will be added to your bid price for purchases paid by credit card or debit card.
15% Buyer’s Premium will be added to your bid price for purchases paid by cash, cashier’s check, or wire transfer.
No personal or business checks will be accepted.
Georgia sales and use tax of 8% (Thomas County) will be charged on the final purchase price (Hammer Price + Buyer’s Premium). Dealers purchasing for resale may be exempt by providing WAG with a valid Georgia sales tax exemption certificate prior to the close of the auction.
Buyer’s Premium Example (Credit Card):
Bid Price: $100.00
18% Buyer’s Premium: $18.00
Total Purchase Price: $118.00 (subject to 8% Georgia sales and use tax)
Wire Transfer Requirements
Purchases totaling $2,500.00 or more must be paid by wire transfer unless other arrangements acceptable to Wiregrass Auction Group are made prior to the close of the auction.
Pickup of Auction Purchases
NO pickup will be allowed without a PAID IN FULL invoice. Payment can be made online through the Wiregrass Auction Group app, by calling (229) 890-2437, or onsite at the time of pickup.
Pickups will be handled by appointment. Following the auction, a link to schedule a pickup appointment will be sent through Shipping Saint. Customers with appointments take priority; walk-ins will be accommodated as time permits on a first-come, first-served basis.
It is the sole responsibility of the purchaser to pack and remove all items from the auction site. Wiregrass Auction Group will not provide assistance with packing, lifting, or loading. Neither Wiregrass Auction Group nor the Seller will be responsible for any items damaged during load-out. Please bring your own boxes, packing materials, and any equipment necessary to move your purchases.
PART 2 — WIREGRASS STANDARD TERMS AND CONDITIONS
These Standard Terms and Conditions apply to the personal property auction described in Part 1, conducted by Wiregrass Auction Group, Inc. (“Auctioneer” or “WAG”), and constitute a legal, valid, binding, and enforceable contract between Auctioneer and YOU. By registering to bid and/or participating in this auction, YOU acknowledge that YOU have read, understand, and agree to be bound by these terms in their entirety.
Note: Most of these terms are written in plain English so they are easy to understand. Certain sections contain specific legal language required to fully protect all parties. Please read all sections carefully.
If you do not agree to these terms, please DO NOT bid.
1. Definitions
The following terms have these meanings throughout these Bidder Terms and Conditions:
“Absentee Bid” means a bid submitted to Auctioneer by a Bidder for execution during the Auction under terms established by Auctioneer.
“Auction Site” means the physical location where the property is located, where inspections may be made, and/or where pickup occurs, as identified in Part 1.
“Auctioneer / WAG” means Wiregrass Auction Group, Inc.
“Bidder” means any person or entity that registers, bids, buys, or otherwise participates in the Auction.
“Bidder Account” means the online account assigned to a Bidder for participation in the Auction.
“Buyer / Winning Bidder” means the Bidder recognized by Auctioneer as having made the Winning Bid on a Lot.
“Buyer’s Premium” means a non-refundable administrative fee added to the Hammer Price as set forth in Part 1 (18% for credit card payments; 15% for cash, cashier’s check, or wire transfer). The Buyer’s Premium is earned by Auctioneer at the Fall of the Hammer.
“Contract Price” means the Hammer Price plus the Buyer’s Premium. Sales tax is calculated on the Contract Price.
“Fall of the Hammer” means the point at which Auctioneer declares a Lot sold to the Winning Bidder; in an online auction, this occurs electronically at the end of timed or extended bidding.
“Hammer Price” means the high bid amount recognized by Auctioneer at the Fall of the Hammer.
“Lot” means each individual item or grouping of items exposed for sale at one time by Auctioneer.
“Online Auction Platform” means the hardware and software used to conduct the Auction online and facilitate online bidding.
“Reserve / With Reserve” means that property may be withdrawn by Auctioneer, and bids may be rejected, prior to the Fall of the Hammer. Unless specifically and expressly stated otherwise by Auctioneer in writing, all Lots are exposed for sale With Reserve.
“Seller” means the person or entity having title to a Lot and/or the authority to sell and convey title to a Lot.
“Wiregrass” means Wiregrass Auction Group, Inc.
2. Acceptance of Terms and Conditions
This auction is conducted under and in accordance with these Bidder Terms and Conditions, any additional terms posted by Auctioneer at the Auction Site or online, any announcements made by Auctioneer, and applicable law. When applicable, one or more Addenda may be attached to and incorporated into these terms and will be identified in the auction listing. YOUR participation in the auction — whether at the auction site, online, by phone, or through any other means — is conclusive evidence of your full agreement to be bound by all bidder terms and conditions.
3. Bidder Registration and Qualification
A valid credit or debit card is required to be approved for bidding. Upon registering, an authorization of $500.00 will be placed against the credit or debit card used for registration as a pre-authorization to verify bidder identity and the availability of funds; this is not a permanent charge. As part of this process, YOUR card-issuing bank may also place a temporary hold against YOUR card. Wiregrass Auction Group has no control over the amount of any bank hold or how long any hold or authorization remains in effect; those matters are determined solely by YOUR bank or card company. Auctioneer may charge YOUR card for purchases made at the auction. By registering, YOU represent that YOU are at least eighteen (18) years of age and legally able to enter into a contract. If bids are made on behalf of an entity, the entity and the individual making the bid will be jointly and severally liable. Auctioneer may refuse, suspend, or revoke the bidding privileges of any Bidder at any time at Auctioneer’s sole discretion.
4. Nature of the Auction; Reserve
Unless expressly stated otherwise in writing, all auctions conducted by Wiregrass Auction Group are With Reserve. Auctioneer may withdraw any Lot prior to the Fall of the Hammer, even if bids have been received. As detailed in Rule 55-10-.01(3) of the Georgia Auctioneers Commission, any auction sale is presumed to be With Reserve unless property is explicitly put up at Absolute Auction. Pursuant to Rule 55-10-.01(4)(b), Wiregrass Auction Group and its Sellers hereby give notice that bids may be made by the Seller, or on the Seller’s behalf, at any auction with reserve.
5. Bid Increments
Bid increments are established and controlled by Auctioneer and may be adjusted at Auctioneer’s sole discretion at any time during the auction.
6. Absentee Bids and Remote Bidding
At Auctioneer’s discretion, Auctioneer may accept Absentee Bids and bids tendered by remote Bidders. Auctioneer will make reasonable efforts to execute Absentee Bids but will have no liability for the failure to execute any Absentee Bid for any reason. A Lot may be sold to another Bidder for the maximum amount of an Absentee Bid based on a bidding sequence that causes another Bidder to reach that amount first. Auctioneer acts as agent of the Seller only, and receipt or execution of Absentee Bids does not create an agency relationship between Auctioneer and any Absentee Bidder.
7. Online Auction and Online Bidding
How Online Bidding Works.
Online bids may be submitted as a single advancing bid or as a maximum bid, and bidding will advance competitively to the next available increment. If YOU submit a maximum bid and another Bidder has previously submitted a higher maximum bid, YOU will be outbid.
Auto-Extend Feature.
If a bid is placed within 3 minutes of the scheduled closing time on any Lot, the closing time for that Lot will automatically reset to 3 minutes. This continues on an item-by-item basis until no further bids are received within the final 3 minutes, at which point bidding closes.
Restrictions on Use.
YOU agree that YOU will not use any robot, spider, automated device, or manual process to monitor, copy, or interfere with the Online Auction Platform, and YOU will not take any action that imposes an unreasonable load on Auctioneer’s online infrastructure.
Technology Disruptions.
The auction is conducted electronically and relies on hardware and software that may malfunction without warning. Auctioneer will not be responsible for technology disruptions, errors, or failures — including disruptions to bidding or the failure to execute, recognize, or record online bids — whether caused by (i) loss of connectivity or failure of the Online Auction Platform, (ii) failure of a Bidder’s internet connection, computer, or system, or (iii) otherwise. Auctioneer may, but will not be required to, continue, suspend, delay, extend, reschedule, or close the auction because of technology failures, even after bidding has commenced. Under no circumstances will Auctioneer be liable for any failure of the Online Auction Platform Provider or its affiliates, employees, agents, or contractors to perform. The Online Auction Platform and Auctioneer’s website are provided on an “as is” basis without warranties of any kind.
Account Security.
YOU are responsible for monitoring and maintaining the security of YOUR Bidder Account. If YOU know or suspect YOUR account has been compromised, YOU must notify Auctioneer in writing immediately.
8. No Bid Retraction
Once a bid has been acknowledged by Auctioneer or submitted online, YOU may not retract or revoke it without Auctioneer’s express consent. YOUR bid constitutes an irrevocable offer. Bidders that cannot satisfy the terms of the auction should not bid.
9. Responsibility for Bids
YOU are responsible for all bids made using YOUR Bidder Number or Bidder Account. If a Winning Bid is submitted from YOUR account, YOU are the Buyer. If YOUR account is lost, stolen, or compromised, notify Auctioneer immediately; YOU will be liable for all bids tendered prior to giving Auctioneer notice.
10. Conduct of the Auction; Auctioneer’s Authority
Auctioneer will regulate all matters relating to the conduct of the auction, and Auctioneer’s decisions will be final and binding. Auctioneer reserves the right to: (i) add or remove items prior to close of bidding; (ii) split or combine Lots; (iii) add minimum bids or reserve prices; (iv) cancel, suspend, extend, or reschedule any item or the entire auction event; and (v) make changes to closing, inspection, or removal times. Auctioneer may reopen bidding if a bid goes unrecognized or a bidding dispute arises. Auctioneer’s determination of the Winning Bidder will be final and conclusive.
11. Competitive Bidding Integrity
Collusive bidding, bid pooling, fictitious bidding, and any other practices designed to suppress or manipulate competitive bidding are strictly prohibited and may result in criminal penalties under the Sherman Anti-Trust Act and other applicable laws. Wiregrass Auction Group reserves the right to immediately revoke the bidding privileges of any bidder suspected of such conduct and to report the activity to the appropriate authorities.
12. Winning Bidder; Contract of Sale
The Bidder making the Winning Bid on any Lot will be the Buyer of that Lot. No additional writing will be required to evidence the contract of sale for any Lot, regardless of the Contract Price. These Bidder Terms and Conditions, together with Auctioneer’s clerking records identifying the Lot, the Hammer Price, and the Buyer, will be conclusive evidence of the terms of the sale.
13. All Property Sold “As Is, Where Is, With All Faults”
All Lots are sold in their as-is, where-is condition at the time of the auction, with all faults, including any hidden defects of any nature. Neither Auctioneer nor Seller makes any representations, warranties, or guarantees whatsoever, express or implied, regarding the nature, value, source, authenticity, fitness, merchantability, or any other aspect of any Lot. No verbal or written statement by Auctioneer or Seller constitutes a warranty or representation of any kind.
Descriptions of auction items are believed to be correct and are provided in good faith but are matters of opinion and are not guaranteed by the Seller or Wiregrass Auction Group. The absence of a condition report does not imply that an item is free of defects. All items may show normal signs of age and wear. Please contact Wiregrass before the auction with any condition questions. Questions about condition will not be answered after purchase. By bidding, YOU acknowledge that YOU have had a full and fair opportunity to inspect all Lots and that YOU are relying solely on YOUR own inspection and judgment.
14. Description of Lots
Unless otherwise expressly stated in writing, any description of a Lot is based solely on visual impression, is given solely for identification purposes, and does not create any warranty, express or implied, or any representation by Auctioneer or Seller.
15. Inspection; Photographs; Due Diligence
By bidding, YOU acknowledge that YOU have had a full and fair opportunity to inspect the Lot(s) and that YOU are relying solely on YOUR inspection and investigation. YOU further acknowledge that any photographs or images of Lots are adequate for YOUR purposes. If a pre-auction inspection is not available, YOU acknowledge that YOU are knowingly bidding without one, that YOU are not relying on any representations by Auctioneer or Seller, and that YOU assume all associated risks.
16. All Sales Final
All sales are final. No refunds, returns, or exchanges will be permitted for any reason.
17. Announcements
All terms, conditions, and announcements made by Auctioneer in connection with the auction are binding and take precedence over any prior advertisements, listings, or other communications.
18. Buyer’s Premium
Each Lot is subject to a Buyer’s Premium as set forth in Part 1 (18% for credit card payments; 15% for cash, cashier’s check, or wire transfer). The Buyer’s Premium is calculated as a percentage of the Hammer Price, is paid by the Buyer in addition to the Hammer Price, is earned by Auctioneer at the Fall of the Hammer, and will not be refunded under any circumstances. The Buyer’s Premium is added to the Hammer Price to determine the Contract Price for tax purposes.
19. Sales Tax
Georgia sales and use tax of 8% (Thomas County) will be calculated on the Contract Price (Hammer Price plus Buyer’s Premium). Buyers purchasing for resale or otherwise claiming an exemption must provide Auctioneer with a valid Georgia sales tax exemption certificate prior to the close of the auction; certificates provided after the auction closes will not be accepted. It is the Buyer’s sole responsibility to determine whether an exemption applies and to provide the required documentation in advance.
20. Title
If YOU are certified as the Winning Bidder on a Lot, YOU will be contractually obligated to pay the Contract Price. Title and ownership of the Lot will not pass from Seller to YOU until payment is made and clears in full.
21. Titled Vehicles
The three vehicles offered in this auction (Lots 470, 471, and 472) are sold AS-IS, WHERE-IS, with all faults and with no warranty of any kind, express or implied, including as to condition, mileage, operability, or roadworthiness. Odometer readings are not guaranteed. Title will be conveyed to the Buyer only after the full Contract Price has cleared. The Buyer is solely responsible for Georgia Title Ad Valorem Tax (TAVT), registration, titling, and all transfer fees, and for arranging and paying for transport of the vehicle from the Auction Site. Any temporary movement permit or transport arrangement is the Buyer’s responsibility.
22. Payment
Payment in full is due no later than the end of the scheduled load-out period specified in Part 1. Online purchases must be paid by credit card, debit card, cashier’s check, or wire transfer. No personal or business checks will be accepted. Wiregrass Auction Group reserves the right to require verified funds from any bidder at any time, and to charge the purchaser’s card on file for any unpaid purchase amount plus applicable storage fees. Purchases totaling $2,500.00 or more must be paid by wire transfer unless other arrangements acceptable to Auctioneer are made prior to the close of the auction.
23. No Stop Payment Orders; No Chargebacks
YOU agree that YOU will not issue a stop payment order on any payment instrument submitted in connection with the auction, or initiate a credit card or debit card chargeback with respect to any purchase. These Bidder Terms and Conditions will be conclusive evidence of YOUR contractual waiver, and Auctioneer may present them to the applicable bank or card company. Regardless of the outcome of any dispute process, YOU will remain personally liable to Auctioneer for the full Contract Price of all purchases, together with all costs of collection, including reasonable attorneys’ fees.
24. Failure to Pay
If YOU fail to pay for YOUR purchase(s) by the payment deadline, YOU will be deemed to have abandoned any interest in the Lot(s) but will remain liable for the full Contract Price. Unpaid Lots may be retained by Seller, resold at a subsequent auction, or otherwise disposed of. If unpaid Lots are resold, YOU will be liable for any shortfall or deficiency on the resale, the Buyer’s Premium, and all costs of resale, and YOU will not be entitled to any surplus. Failure to pay may result in YOU being banned from all future Wiregrass Auction Group auctions.
25. Returned Checks
Any cashier’s check or other instrument returned unpaid will be subject to a returned item fee of $75.00, and Auctioneer will be entitled to recover all costs and expenses, including attorneys’ fees, incurred in collecting any returned instrument.
26. IRS Form 8300; Cash Reporting Requirements
Federal law requires Wiregrass Auction Group to file IRS Form 8300 for any transaction or series of related transactions in which cash or cash equivalents totaling $10,000.00 or more are received. If YOUR purchases at any single auction total $10,000.00 or more and YOU pay with any combination of such instruments, YOU will be required to provide YOUR full legal name, address, Social Security Number or Tax Identification Number, and date of birth for compliance purposes; failure to provide this information will result in cancellation of YOUR purchase. Federal law also prohibits the structuring of transactions to avoid the $10,000.00 reporting threshold, which is a crime under 31 U.S.C. § 5324. Wiregrass Auction Group is required to report any suspected structuring activity to federal authorities.
27. Pickup, Removal, and Delivery
YOU are solely responsible for the pickup, loading, removal, disassembly, rigging, shipping, and transportation of all Lots purchased by YOU. Wiregrass Auction Group staff will not assist with loading, lifting, or moving items under any circumstances. Please bring adequate help, equipment, and appropriate vehicles to remove YOUR purchases during the scheduled pickup period specified in Part 1. Disassembly and removal must be done in a workmanlike manner, and YOU will indemnify and hold harmless Auctioneer and Seller against any damage caused by YOU or YOUR agents in connection with removal. Any damage to land or buildings caused during removal will be repaired at YOUR expense. YOU must notify Auctioneer in writing, in advance, if any other person will pick up YOUR purchases on YOUR behalf. YOU are responsible for insuring all Lots purchased by YOU from the time of the Fall of the Hammer. Possession and risk of loss pass to YOU at the time of pickup at the Auction Site or delivery to a carrier at the Auction Site.
28. Storage Fees; Abandoned Property
Beginning immediately after the close of the scheduled load-out period, a storage charge of $10.00 per Lot per day will accrue until removal or disposition, and Auctioneer will have a possessory lien against such Lot(s) that may be executed on to satisfy storage charges. Any Lot(s) not picked up within 30 days of the close of the scheduled load-out period will be deemed abandoned to Auctioneer, at which point YOU waive all rights, title, and interest in such Lot(s) and will not be entitled to any proceeds if they are subsequently sold. YOU expressly waive any and all claims for deficiency, recoupment, setoff, conversion, or trover relating to abandoned Lots.
29. Claims After Removal
After a Lot has been removed from the Auction Site by YOU or on YOUR behalf, and/or after the posted removal deadline — regardless of whether the Lot has been physically removed — no claims, returns, adjustments, or rescissions will be allowed for any reason, including any alleged failure of a Lot to correspond with any description, standard, or expectation.
30. Buyer Remedies; No Consequential Damages
To the extent YOU may be entitled to any damages or remedies, YOUR sole and exclusive remedy is a return of the Hammer Price actually paid. Under no circumstances will Auctioneer or Seller be liable for incidental or consequential damages, including lost profits or reduced productivity, and YOU are not entitled to specific performance or other equitable relief.
31. Seller Remedies
If YOU breach YOUR obligations under these Terms and Conditions or under a sale contract with Seller, the Lot(s) may be resold and YOU will be responsible for all damages, including any deficiency or reduction in the Contract Price, along with all incidental damages and costs of resale.
32. Access to Auction Site; Assumption of Risk
YOU assume all risks in connection with YOUR participation in the auction, including risks arising from YOUR presence at the Auction Site, YOUR use of any Online Auction Platform, and the removal, transport, or use of any Lot(s). YOU acknowledge that the Auction Site may be a potentially dangerous environment. YOU enter the Auction Site at YOUR own risk and assume such risks for YOURSELF and anyone accompanying YOU, and YOU assume all liability for property damage and/or personal injury caused by YOU or YOUR representatives.
33. Limitation of Liability
Neither Auctioneer nor Seller will be liable for typographical errors, misprints, loss of merchandise or money, or damage or failure of equipment at the Auction Site or otherwise related to the auction. YOU hereby irrevocably waive any claim for speculative or consequential damages, including, but not limited to, claims for lost profits, loss of opportunity, and loss of goodwill.
34. Indemnification
YOU agree to indemnify and hold harmless Wiregrass Auction Group, Inc. and its employees, agents, officers, owners, and subcontractors from any and all claims, expenses, losses, damages, liabilities, judgments, fees, and costs (including reasonable attorneys’ fees) related to, arising from, or associated with YOUR participation in the auction, including personal injuries, property damage, financial loss, access to or use of any Online Auction Platform, presence at the Auction Site, and/or removal, transport, use, or subsequent sale of any Lot(s).
35. Private Sale
YOU agree not to enter into a private sale for the purchase of any property included in, or scheduled to be included in, the auction — prior to, during, or within ten (10) days after the close of the auction. If YOU purchase any such property in a private sale during that period, Auctioneer will be entitled to an amount equal to Auctioneer’s full commission and Buyer’s Premium, and YOU and Seller will be jointly and severally responsible for payment.
36. Relationship of the Parties
Auctioneer is acting solely as Seller’s agent. Auctioneer does not represent YOU and is not YOUR agent. Unless expressly stated otherwise in writing, Auctioneer is providing services as an independent contractor for Seller only and is not responsible for statements made by other parties.
37. Invoice and Communications from Auctioneer
YOU will be invoiced for YOUR purchases at the conclusion of the auction, by email for remote Bidders. YOU acknowledge and agree that email communications — including invoices, payment instructions, and reminders — may be sent to YOU at any time of day or night, on any day of the week including holidays, and YOU expressly consent to receipt of such communications.
38. Audio and Video Recording; Photographs
The Auction Site may be subject to security surveillance, including video, audio, and photographic recording. As a condition of YOUR presence at the Auction Site, YOU consent to such recordings, and YOU agree that Auctioneer may use any images or recordings in advertising or for other commercial purposes on a royalty-free basis.
39. Mailing List
Auctioneer may use YOUR Bidder Registration information to notify YOU about future auctions and events. YOU may opt out of receiving such notifications at any time by providing written notice to Auctioneer.
40. Auctioneer’s Records
Absent clerical errors, Auctioneer’s records will be final and conclusive with respect to all matters relating to the auction.
41. Governing Law; Jurisdiction; Venue; Waiver of Jury Trial
These Bidder Terms and Conditions will be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict-of-laws rules. All claims, disputes, and other matters between the parties will be brought exclusively in the state or federal courts sitting in and for Thomas County, Georgia; YOU consent to the jurisdiction of and venue in such courts and waive any objection based on inconvenient forum. YOU irrevocably waive the right to a trial by jury.
42. Attorneys’ Fees
If YOU breach YOUR obligations under these Bidder Terms and Conditions, Auctioneer and/or Seller will be entitled to recover all costs and expenses, including reasonable attorneys’ fees, incurred in enforcing their respective rights.
43. Waiver
Certain provisions of these Bidder Terms and Conditions are for the exclusive benefit of Auctioneer and/or Seller and create no rights in favor of any other persons, including competing bidders. Auctioneer and/or Seller may, globally or on a case-by-case basis, waive any provisions intended for their benefit without being required to do so.
ACCEPTANCE OF BIDDER TERMS AND CONDITIONS
By registering to bid and/or participating in this auction conducted by Wiregrass Auction Group, YOU acknowledge that YOU have had a full and fair opportunity to review these Bidder Terms and Conditions, that YOU have read and understand them, and that YOU accept and agree to be bound by them in their entirety.
