1. Acceptance of Terms
By registering as a bidder or placing a bid in any Burgess Auctions LLC firearms auction event, you acknowledge that you have read, understand, and agree to be bound by these Terms and Conditions. These Terms apply to all bidders regardless of the platform through which bids are placed, including bidburgess.com, LiveAuctioneers, HiBid, Proxibid, or any other authorized platform. Auction-specific terms posted on an individual auction listing are incorporated by reference; in the event of a conflict, the auction-specific terms govern.
Bidders are welcome to register and bid on any supported platform. Many bidders prefer registering directly at bidburgess.com, where Burgess Auctions LLC manages the registration, invoicing, and transfer process in-house from start to finish.
2. Bidder Eligibility
You must be at least 21 years of age to bid on handguns and at least 18 years of age to bid on long guns (rifles and shotguns), consistent with federal law. By registering, you represent and warrant that:
? You are legally eligible to purchase firearms under federal, state, and local law
? You are not a prohibited person as defined under 18 U.S.C. ? 922(g)
? You will comply with all applicable federal, state, and local laws governing the purchase, transfer, and possession of firearms
? You will submit to a NICS background check as required by federal law
3. Buyer's Premium
A buyer's premium will be added to the hammer price of each lot and is included in the total purchase price:
? 15% buyer's premium ? in-person bidding at the auction facility
? 20% buyer's premium ? all online bidding, including bidburgess.com, LiveAuctioneers, HiBid, Proxibid, and any other platform
The buyer's premium is non-negotiable and non-refundable except in the case of a verified cataloging error by Burgess Auctions LLC.
4. Cash Discount
A 3% discount on the buyer's premium is available for payment made entirely in cash for in-person purchases only. The cash discount does not apply to online purchases, real estate auctions, or any lot paid by any method other than cash.
5. Payment Terms
Full payment is due on the day of the auction or upon notification of winning bid. Accepted payment methods:
? Cash
? Personal checks from Indiana residents, at Burgess Auctions LLC's sole discretion. Burgess Auctions LLC reserves the right to hold items until personal check funds have cleared, based on the nature of the asset.
? Visa, MasterCard, and Discover (no American Express). No credit card surcharge.
The following assets require payment in certified funds only (cashier's check, cash, or bank wire transfer):
? All gold, silver, and precious metals, unless the buyer is known to Burgess Auctions LLC at its sole discretion
? Any item shipping out of state with a hammer price exceeding $1,500
Burgess Auctions LLC reserves the right to require certified funds on any lot at its sole discretion. Invoices are due within 5 business days of auction close. A $50 fee applies to any returned check, and Burgess Auctions LLC reserves the right to pursue full legal remedy on any dishonored payment.
6. Sales Tax
Indiana buyers will be charged 7% Indiana sales tax unless a valid, current-year Indiana ST-105 Sales Tax Exemption Certificate is on file with Burgess Auctions LLC prior to invoicing.
7. NICS Background Check & FFL Transfer Requirements
All firearm transfers are subject to federal law. Every winning bidder, regardless of state of residence, must complete a NICS background check and all required ATF transfer paperwork before taking possession of a firearm.
In-Person Pickup: Indiana residents and eligible out-of-state buyers (for long guns, where permitted under federal law) may complete the NICS background check and ATF Form 4473 in person at 5 S. Main Street, Carthage, IN 46115, and take possession the same day if approved.
Shipped Firearms: Firearms regulated under the Gun Control Act that are not picked up in person must be shipped FFL-to-FFL to a licensed Federal Firearms Licensee (FFL). Burgess Auctions LLC cannot ship a GCA-regulated firearm directly to a buyer under any circumstances. Black powder firearms and qualifying antique firearms are treated differently ? see Section 9, Firearm Shipping Requirements, for the full process and exceptions.
Failed or Denied Background Check: If a buyer fails or is denied on a NICS background check, the sale is void and the firearm will be relisted. No refund of buyer's premium will be issued. A NICS delay is not a denial; Burgess Auctions LLC will hold the firearm for the federally permitted period before any further action is taken.
8. FFL Submission Deadline ? 7-7-7 Policy
Buyers who require shipment must submit their receiving FFL dealer's information promptly. Burgess Auctions LLC enforces the following escalation policy for unresponsive buyers:
? Day 7: A courtesy phone call and/or email reminder will be made requesting the buyer's FFL information.
? Day 14: A certified letter will be sent as a final notice.
? Day 21: If no FFL information has been received, the firearm will be forfeited and resold. No refund will be issued on the original sale.
There are no refunds if we do not receive your FFL information.
Be responsible ? send your receiving FFL dealer's license information promptly to avoid forfeiture.
9. Firearm Shipping Requirements
Modern Firearms (FFL-to-FFL): All firearms classified under the Gun Control Act ship exclusively from FFL to FFL. Burgess Auctions LLC will not ship a GCA-regulated firearm directly to a buyer. The process:
? 1. Pay your invoice in full prior to initiating the shipping process.
? 2. Select a licensed FFL dealer of your choice to receive the transfer in your state of residence.
? 3. Email a copy of your dealer's current FFL license to firearms.burgessauctionsllc@gmail.com ? include your name and invoice number. The FFL documentation must show the dealer's license is valid and current.
? 4. Please allow up to 14 days from receipt of your FFL dealer's information for processing and shipment.
? 5. You will receive a separate invoice from Shipping Saint for all shipping charges. Your firearm will ship once that invoice is paid in full.
All FFL-to-FFL firearm shipments are fully insured and require an adult signature upon delivery. Burgess Auctions LLC is not responsible for any fees charged by the buyer's receiving FFL dealer.
Black Powder & Qualifying Antique Firearms: Black powder (muzzleloading) firearms and antique firearms meeting the federal definition under 18 U.S.C. ? 921(a)(16) are not classified as ?firearms? under the Gun Control Act and are not subject to FFL-to-FFL transfer or NICS background check requirements. These items may ship directly to the winning buyer once payment is received in full, subject to the following:
? Buyer must provide valid government-issued photo ID confirming they are at least 18 years of age before shipment.
? Burgess Auctions LLC reserves the right, at its sole discretion, to require FFL-to-FFL transfer on any item if there is any question as to its antique or black-powder classification, or if required by the laws of the buyer's state or locality.
? It remains the buyer's sole responsibility to confirm that direct possession of the item is lawful in their state and locality.
All direct shipments, like FFL-to-FFL shipments, are fully insured and require an adult signature upon delivery.
10. State & Jurisdictional Restrictions
Certain states, counties, and municipalities restrict or prohibit the transfer, shipment, or possession of specific firearms, calibers, magazine capacities, and accessories. It is the buyer's sole responsibility to know and comply with all applicable laws in their jurisdiction before bidding.
If Burgess Auctions LLC determines that a firearm cannot lawfully be shipped to a buyer's location or receiving FFL, we will work with the buyer to explore alternatives ? but no refund will be issued on the basis of jurisdictional ineligibility.
11. Inspection, Condition & Warranty
All firearms are sold AS IS, WHERE IS, with no warranties expressed or implied, including no warranty of merchantability or fitness for a particular purpose.
? Preview periods will be posted on each auction listing; bidders are strongly encouraged to inspect items, or have a qualified gunsmith inspect items, prior to bidding.
? Descriptions, photographs, and condition reports are provided as a courtesy only and do not constitute a warranty.
? All sales are final. No returns or refunds will be issued for buyer's remorse, mechanical condition, or any reason other than a verified cataloging error by Burgess Auctions LLC.
12. NFA / Class 3 Items
Items regulated under the National Firearms Act (NFA), including but not limited to suppressors, short-barreled rifles, short-barreled shotguns, and machine guns, require proper ATF documentation and tax stamp approval. All applicable federal, state, and local NFA rules apply, and transfer timelines are governed by ATF processing and are outside the control of Burgess Auctions LLC.
13. Liability
? Bidders assume all risk of injury or loss while attending or participating in any auction, in person or online.
? Burgess Auctions LLC is not responsible for accidents, injuries, or losses occurring at the auction facility.
? By bidding, the buyer agrees to indemnify and hold harmless Burgess Auctions LLC, its agents, and its employees from any claims arising from the purchase, possession, transfer, or use of any firearm sold at auction.
14. Technical Issues
Burgess Auctions LLC is not responsible for internet outages, platform failures, or bidding delays that may occur during live simulcast or online bidding. In the event of a verified technical failure attributable to Burgess Auctions LLC or its bidding platform, Burgess Auctions LLC reserves the right, at its sole discretion, to extend bidding, reopen a lot, or void a sale.
15. Auction Conduct
The auctioneer reserves the right to:
? Reject any bid
? Resolve bidding disputes
? Withdraw any item from sale
? Group or divide lots
The auctioneer's decision is final in all matters relating to the conduct of the auction.
16. Removal & Pickup
Removal dates and times will be posted on each individual auction listing. Items not picked up within the posted removal window, and for which no shipping arrangement has been made, will be subject to storage fees or may be considered abandoned, at Burgess Auctions LLC's sole discretion.
17. General Terms
? All federal, state, and local firearms laws and regulations will be observed.
? Valid government-issued photo identification is required for registration and again at transfer or background check.
? FFL holders bidding under their license must provide a current copy of their FFL prior to bidding.
? Any attempt to transfer a firearm to someone other than the registered winning bidder, or to circumvent NICS or FFL requirements, will result in immediate cancellation of the sale, forfeiture of payment, and a ban from future Burgess Auctions LLC events.
? Catalog errors will be corrected as discovered and do not constitute grounds for refund beyond the corrected error.
? If a bidder registers and bids through a third-party platform (LiveAuctioneers, HiBid, Proxibid, or other), the bidder consents to Burgess Auctions LLC's use of the registration information provided through that platform for purposes of completing the transaction, required legal compliance, and future marketing communications, consistent with our Privacy Policy.
18. Payment & Shipping Policy Summary
This section restates our payment and shipping policy in plain terms for quick reference. In the event of any inconsistency, Sections 5 through 9 above govern.
? Full payment is due on the day of the auction or upon notification of winning bid (cash, certified funds, personal check at our discretion, or Visa/MasterCard/Discover ? no American Express).
? A 3% cash discount applies to in-person purchases paid entirely in cash.
? Modern, GCA-regulated firearms ship FFL-to-FFL only ? we do not ship these directly to buyers.
? Black powder firearms and qualifying federally-defined antique firearms may ship directly to the buyer with valid ID and age verification, once paid in full.
? All shipped items ship fully insured with signature required, and shipping charges are invoiced separately through Shipping Saint.

19. Binding Agreement
