1. Acceptance of Terms
By registering as a bidder or placing a bid in this Burgess Auctions LLC simulcast auction, you acknowledge that you have read, understand, and agree to be bound by these Terms and Conditions. These Terms apply to all bidders regardless of the platform through which bids are placed, including bids.burgessauctions.com, LiveAuctioneers, or any other authorized platform. Announcements made from the auction floor or posted in the online catalog take precedence over these written terms in the event of a conflict.
Bidders are welcome to register and bid on any supported platform.
2. Auction Format
This auction runs in two parts. From 10:00 AM to 12:00 PM, we host a Live Discovery Session ? in-person only, with no internet bidding available. At 12:00 PM, simulcast bidding opens for the full catalog, conducted simultaneously in-person at our Knightstown facility and online. In-person and online bids are accepted equally during the simulcast portion, and the highest bid wins regardless of source.
In-Person: Register on-site the day of the auction and receive a bidder number.
Online: Register and bid through bids.burgessauctions.com or LiveAuctioneers. Maintain a valid payment method on file to bid.
3. Registration
All bidders must register and agree to these Terms before bidding.
Online bidders must maintain valid, current payment information on their account.
Multiple bidder accounts per individual are not permitted.
Burgess Auctions LLC reserves the right to deny or revoke bidding privileges at its sole discretion.
4. Buyer's Premium
A buyer's premium is added to the hammer price of each lot and included in the total purchase price:
Bidding Method Buyer's Premium
In-person (auction floor) 15%
Online ? bids.burgessauctions.com, LiveAuctioneers, or any other platform 20%
The buyer's premium is non-negotiable and non-refundable except in the case of a verified cataloging error by Burgess Auctions LLC.
5. Cash Discount
A 3% discount on the buyer's premium is available for payment made entirely in cash. This discount may be combined with the prompt-payment discount described in Section 6.
6. Payment Terms
Full payment is due immediately upon notification of a winning bid. Invoices are issued Sunday or Monday following the auction, after reconciliation across all bidding platforms.
Accepted payment methods:
Cash
Personal checks from Indiana residents, at Burgess Auctions LLC's sole discretion. Burgess Auctions LLC reserves the right to hold items until personal check funds have cleared.
Visa, MasterCard, and Discover (no American Express). No credit card surcharge.
Certified funds only (cashier's check, cash, or bank wire transfer) are required for:
All gold, silver, or precious metal lots, unless the buyer is known to Burgess Auctions LLC at its sole discretion
Any item shipping out of state with a hammer price exceeding $1,500
Burgess Auctions LLC reserves the right to require certified funds on any lot at its sole discretion. Invoices are due within 5 business days of auction close. A $50 fee applies to any returned check, and Burgess Auctions LLC reserves the right to pursue full legal remedy on any dishonored payment.
Prompt-Payment Discount: A 1% discount on the buyer's premium is available for paying your invoice in full within 24 hours of issuance. This discount may be combined with the cash discount in Section 5.
7. Sales Tax
Indiana sales tax will be collected on all taxable purchases picked up at Burgess Auctions LLC's facility or shipped to an address within Indiana, unless a valid sales tax exemption is on file prior to invoicing.
Purchases shipped by Burgess Auctions LLC to an address outside Indiana are sourced to the state where the purchaser receives the property. Burgess Auctions LLC does not currently have a sales tax collection obligation in other states and therefore does not collect sales tax on such shipments, except where collection is otherwise required by law or handled by the bidding platform or marketplace through which the purchase was made. Out-of-state purchasers may be responsible for use tax or other applicable taxes in their state.
Tax-exempt purchasers must provide valid exemption documentation prior to invoicing. Burgess Auctions LLC reserves the right to reject exemption documentation that is incomplete, invalid, or not applicable to the transaction.
8. Item Condition & Descriptions
All lots are sold AS IS, WHERE IS, with no warranties or guarantees expressed or implied. Photos and catalog descriptions are provided for reference only; bidders are responsible for their own due diligence and are encouraged to inspect items in person during the scheduled preview.
Note on specialty categories in this sale: Clock lots are described as "running" or "works" only where verified prior to cataloging and are not guaranteed to remain in working order after sale. Maker attributions on furniture, art, and automobilia (including signatures and manufacturer markings) are based on marks, documentation, or visual inspection and are not backed by independent authentication or appraisal unless explicitly stated in the lot description.
9. Internet & Technology
Burgess Auctions LLC is not responsible for internet connectivity issues, platform outages, server delays, or other technical difficulties that prevent online bidding, and no adjustments will be made for missed bids resulting from such issues. Online bidders should test their connection and device prior to the auction and refresh their screen regularly during bidding.
10. Bidding Priority & Disputes
In-person and online bids are accepted with equal priority during the simulcast portion of the auction. In the event of a dispute between bidders on any lot, the auctioneer's decision is final. The auctioneer reserves the right to reject any bid, withdraw any lot, and reopen bidding on any lot.
11. Announcements
Any announcements made from the auction block, or posted updates to the online catalog, take precedence over these printed Terms and over any prior marketing materials.
12. Item Pickup & Shipping
In-Person Buyers: Items become your responsibility at the fall of the hammer and must be removed the day of sale unless prior arrangements have been made.
Online Buyers: Items must be picked up within 7 days of auction close at our Knightstown facility during posted hours, or shipping can be arranged as described below.
Shipping Saint ? Our Shipping Partner: Burgess Auctions LLC does not pack fine furniture or framed art in-house; these lots are packed and shipped exclusively through our shipping partner, Shipping Saint. Shipping Saint collects all paid orders from our Knightstown facility every Wednesday ? invoices paid before Wednesday's pickup ship that week; invoices paid after Wednesday wait for the following week's pickup, and so on until payment is received in time.
Note on Furniture, Art & Glass: These lots require professional packing due to their size or fragility. Please review each lot's description for any special packing or handling notes, and see each platform's shipping options for details.
Shipping cost is billed separately based on the size, weight, and fragility of the item(s) won. Burgess Auctions LLC is not responsible for items once transferred to Shipping Saint or any other carrier. Some lots in this sale ? including the large furniture pieces and framed oil paintings ? may require special handling or freight shipping outside standard service; contact us before the auction closes to discuss options and estimated costs.
13. Liability Waiver
All persons attending the auction, whether bidding or observing, do so at their own risk. Burgess Auctions LLC is not liable for accidents, theft, injury, or property damage occurring on the premises. Online bidders acknowledge that they have not physically inspected the lots they are bidding on and accept all risk associated with an online purchase, including risk related to condition, authenticity, and attribution as described in Section 8.
14. Non-Payment & Account Suspension
Failure to pay an invoice within the terms stated in Section 6, or failure to remove or arrange shipment of purchased items within the timeframe stated in Section 12, may result in suspension of bidding privileges across all Burgess Auctions LLC platforms, cancellation of the sale, and forfeiture of any deposit made. Burgess Auctions LLC reserves the right to pursue full legal remedy to collect payment, including collection costs and reasonable attorney fees, and may resell the item at the buyer's expense. Repeated non-payment may result in a permanent ban from future Burgess Auctions LLC sales on any platform.
15. Governing Law
These Terms and Conditions are governed by the laws of the State of Indiana, without regard to conflict of law principles. Any disputes arising from this auction shall be resolved in the state or federal courts located in Henry County, Indiana. Participation in this auction, on any platform, constitutes consent to jurisdiction and venue in Henry County, Indiana.
