CONDUCT OF THE AUCTION: For auctions conducted Onsite with Live Webcast Bidding, the auctioneer accepts both onsite and online bids beginning at the posted auction date and time.
TERMS OF SALE: Winning bidder will pay the entire purchase price (bid amount plus buyer’s premium) upon conclusion of the bidding. Buyer will sign Purchase and Sale Agreement (PSA) for real estate which includes Bill of Sale for personal property, and must submit entire purchase price in the form of certified funds or wire transfer to the escrow agent. If winning bidder is online, they will be emailed the PSA and Bill of Sale to sign and return, and wiring instructions for escrow agent. The funds are non-refundable.
Closing on the real estate must occur no later than 5 business days (July 30, 2014) or sooner from the auction date unless extended in writing by mutual consent of the parties. Buyer shall execute an Auction Purchase and Sale Agreement for the property immediately after being declared the successful bidder by Auctioneer. All remaining personal property will transfer with the Real Estate. A bulk Bill of Sale will be attached to the PSA. The form Auction PSA and Bill of Sale is available at our website and at the auction site prior to the auction. The Auction PSA which Buyer must sign at the auction contains an acknowledgment that Buyer has inspected the property prior to the auction, is relying solely on his/her inspection, and is purchasing the property As Is with all faults and without reliance on any warranty of any kind whatsoever. NO CHANGES WILL BE MADE TO SAID AUCTION PSA OR ANY EXHIBITS ATTACHED THERETO, AND BUYER WILL BE OBLIGATED TO EXECUTE AND DELIVER SAID AUCTION PSA ON AUCTION DAY. Provided, however, Seller reserves the right to modify or amend said Auction PSA, to complete blank sections, to attach appropriate exhibits, and to comply with state and local laws as may be enacted or amended from time to time. All payments (i.e., Earnest Money, Closing Funds) must be in the form of cash, cashiers check or wire transfer only. No personal property may be removed until Buyer has closed on the real estate.
BUYER'S PREMIUM: Property will be sold with a ten (10%) percent buyer's premium. The bid amount plus buyer's premium equals the final purchase price. For example: A $100,000 bid, plus the 10% ($10,000) buyer's premium, equals the $110,000 final purchase price.
FINANCING: Please note that financing is NOT a contingency of this transaction. Because financing is NOT a contingency, all potential bidders must make certain in advance that they are capable of obtaining the necessary financing to close the transaction.
PLATS/SKETCHES/DRAWINGS AND PHOTOS: Are not to be relied on. Existing legal descriptions are not guaranteed for complete accuracy. All acreage and dimensions are approximate and could be subject to change upon an actual field survey. All stakes, signs or flags indicating boundaries or location are for general location purposes only and are not to be construed as precise property corners.
AUCTION POWER OF ATTORNEY: For interested bidders who cannot attend the auction but would like to have a representative bid at the auction on their behalf, an Auction Power of Attorney can be obtained by contacting the Auction Information Office at (770) 980-9565.
EASEMENTS: All property sold is subject to recorded easements which include existing roads and planned roads, power line and other utility easements, ingress and egress easements, and other easements of record.
PRE-AUCTION OFFERS: Must be on cash terms, and must be submitted to Auctioneers no later than 48 hours prior to bid deadline.
KEYS: Neither Auctioneer nor Seller warrant key availability on any property. If available, keys will be provided at closing. However, Buyer is strongly advised to re-key the property immediately after closing.
BUYER'S NOTE: Auctioneer reserves the right to add or delete property from this auction or to alter the order of sale from that published herein. Auctioneer reserves the right to convert the bidding platform from an online to an onsite bidding platform if no bidders register and submit required bid deposit by the online bidding deadline. Personal on-site inspection of the property is strongly recommended. Failure to inspect property prior to auction does not relieve purchaser of contractual obligations of purchase. Property sells As Is - Where Is with no warranties expressed or implied.
No personal property can be removed until escrow agent or Auctioneer has acknowledged receipt of cash or cash equivalent for the entire purchase price. No fixtures (ie windows, timber, etc) can be removed until the real estate has closed. Neither Seller nor Auctioneer can assume any liability for assets after the auction PSA and Bill of Sale have been executed.
Real property is to be conveyed by Warranty Deed. Only the following sale closing costs will be paid by seller: (1) Commissions or brokerage fees to auctioneer as set forth in separate agreement with auctioneer, and as established in these Terms and Conditions; (2) reasonable title corrective expenses, in Seller’s sole determination; and (3) Prorated property taxes and back taxes due, if any. All other closing costs, including but not limited to surveys, title Insurance, loan closing costs, and purchaser’s attorney fees are at the expense of the Buyer.

There is no obligation on the part of the Seller to accept any backup bids in the event the high bid falls through.
CLOSING: Closing must occur at the offices of Security 1st Title, 105 Scott Avenue, Fort Scott, KS 66701, unless noted otherwise, Buyer to pay all closing fees charged by Security 1st Title.

Information provided by Seller & County Records:
Built in 1894, the church was closed and sold to the Preservation Society in 1994. In 2007, the Seller purchased the property with plans to make it his home. He had a new roof installed and began work before his plans changed. When he stopped his project, he boarded up all the beautiful stained glass windows to protect them. The nine 6’ x 13’ large windows are originally from Ireland and set in beautiful slider oak frames. Plus, there are also 2 large round and 6 smaller windows.
The brick building is 42’ x 75’ with old growth timber throughout. There are twelve 8” x 16” x 50’ black walnut beams, 2” x 18” pine floor joists covered with 3,000 sq. ft. of pine flooring. The vaulted, barrel ceiling is patterned tin. The wainscoting appears to be finished pine. Choir Loft is approximately 20’ x 40’. The lot size is 185’ x 150’.
Taxes for 2013 were $285.38
