1. About The Evidence Locker
The Evidence Locker provides estate sale, auction, liquidation, and related services to individuals, families, businesses, and estates. Services may include organizing, photographing, cataloging, pricing, advertising, conducting sales, online auctions, coordinating pickup, and assisting with the disposition of remaining merchandise.
2. Estate Sale & Client Services
Clients authorize The Evidence Locker to market and sell approved property on their behalf according to the terms agreed upon in the applicable service agreement.
The Evidence Locker may determine appropriate pricing, promotional strategies, sale methods, and scheduling in consultation with the client.
Clients are responsible for identifying items that are not to be sold and for providing accurate information regarding ownership, condition, restrictions, or known issues involving property.
3. Ownership & Authorization
The client represents that they have the legal authority to consign or sell the property provided to The Evidence Locker.
The Evidence Locker is not responsible for disputes between heirs, family members, creditors, owners, or other parties claiming an interest in property.
If ownership or authorization is disputed, The Evidence Locker may suspend or remove the property from sale until the dispute is resolved.
4. Pricing & Sales
Prices may be established based on market conditions, comparable items, condition, demand, and the sales strategy selected for the particular estate or auction.
Items may be discounted, grouped, bundled, auctioned, or otherwise marketed as appropriate.
Unless otherwise agreed in writing, The Evidence Locker does not guarantee a particular selling price or minimum amount of proceeds.
5. Fees & Commissions
Service fees, commissions, buyer premiums, advertising charges, removal fees, cleaning fees, or other applicable charges will be disclosed in the applicable client agreement or sale terms.
The Evidence Locker may deduct authorized fees and expenses from sale proceeds before distributing the remaining balance to the client.
6. Advertising & Photography
The Evidence Locker may photograph, video, describe, and advertise property for purposes of promoting an estate sale or auction.
By engaging The Evidence Locker, the client authorizes reasonable use of photographs and descriptions of sale merchandise and the sale location for advertising purposes, subject to applicable privacy and legal requirements.
7. Buyer Responsibility
Buyers are responsible for carefully examining items before purchasing whenever inspection is available.
Unless specifically stated otherwise, items are sold AS IS, WHERE IS, with no warranties, guarantees, or representations regarding condition, age, authenticity, functionality, or suitability for a particular purpose.
Buyers should inspect items, read descriptions carefully, and ask questions before purchasing.
8. All Sales Are Final
Unless otherwise specifically stated in writing, all sales are final.
No returns, exchanges, refunds, or cancellations will be accepted because a buyer changes their mind, discovers an issue after purchase, or determines that an item does not meet their expectations.
9. Online Auctions
Online auctions may have specific bidding rules, closing times, buyer premiums, payment requirements, pickup schedules, and other conditions.
A winning bidder is obligated to complete the purchase in accordance with the applicable auction terms.
Failure to pay or pick up purchased items may result in cancellation of the transaction, additional fees, loss of bidding privileges, or other remedies permitted by the applicable terms.
10. Pickup & Removal
Buyers are responsible for removing purchased items during the designated pickup period unless otherwise agreed.
Buyers must provide appropriate vehicles, tools, labor, packing materials, and assistance necessary to safely remove their purchases.
The Evidence Locker may charge additional fees for items that require special handling, storage, delivery, or removal.
11. Unclaimed Property
Items that are not picked up within the stated pickup period may be considered abandoned, subject to the applicable sale terms and law.
The Evidence Locker may charge reasonable storage or handling fees when permitted.
12. Prohibited Conduct
The Evidence Locker reserves the right to refuse service, remove individuals from a sale, cancel transactions, restrict bidding privileges, or take other appropriate action in response to:
* Theft or attempted theft
* Fraudulent activity
* Harassment or threatening behavior
* Damage to property
* Interference with employees, representatives, clients, or other customers
* Manipulation or attempted manipulation of auctions
* Providing false information
* Violation of posted sale or auction rules
13. Liability
To the extent permitted by law, The Evidence Locker is not responsible for injuries, losses, damages, theft, or property damage resulting from a buyer’s failure to use reasonable care or from circumstances outside The Evidence Locker’s reasonable control.
Buyers and visitors enter sale locations at their own risk and should exercise caution around stairs, tools, furniture, electrical equipment, structures, vehicles, and other potentially hazardous conditions.
14. Changes to Terms
The Evidence Locker may modify these Terms & Conditions from time to time. Updated terms may be posted on the company’s website, auction platform, sale materials, or other applicable locations.
The terms applicable to a particular estate sale or auction may contain additional requirements and will control where they conflict with these general terms.
15. Governing Law
These Terms & Conditions shall be interpreted according to the laws applicable in the State of Kansas, unless otherwise required by law.
