PLEASE REVIEW AND UNDERSTAND THE FOLLOWING TERMS & CONDITIONS. These terms & conditions form a legal agreement so please read carefully and if you have any questions please email gjackson@catholiccharitiesks.org or Call 913-433-2081. If inquiring about an item in one of our auctions and your question is already addressed in the description or terms, do not expect a response back due to the amount of calls we address. PREVIEWS for this sale will be by appointment on Saturday Feb. 10th from 9-4 NOTE: If you would like shipper/mover information from us please email gjackson@catholiccharitiesks.org we would be happy to forward our referral/suggestion list along.
• To Bid: You will need to register for our auction online. You must be 18 years of age or older to bid. We will ask for general information and credit card authorization. Again, please read the following terms and conditions carefully as they are a legal binding contract between you (the bidder) and Morning Glory Estate Sales. To register and bid in this auction you must agree to these terms and are bound by them as a bidder. Once you place a bid through our bidding platform, you cannot remove or lower a bid. No bids will be removed once they have been placed. Due diligence is the responsibility of you (the bidder). All sales are final. When the bidding ends on our website and you are the high bidder, you then assume complete responsibility for care of each purchase, including payment, calling for an appointment to pick up and working with 3rd parties for shipping or pick up if applicable. MGES is not responsible for internet malfunctions, loss of connection or system glitches that may prevent you from placing last minute bids, or receiving notices from our company. Don’t wait until the last minute to bid; if the system is busy, your bids may not process within the last seconds of an auction closing. Our auctions feature extended bidding. If a bid is placed on a lot within the last 2 minutes of the auction item, bidding will extend on that lot for 2 minutes past the closing time. That lot will remain open until there are no other bids on that item.
• Buyer’s Premium: A buyer’s premium of 15% is an additional charge above the hammer price to the winning bidder. It is a percentage of their bid and is added to the winning bid amount. The buyer’s premium is 15% on top of the final hammer price. Unless otherwise stated by MGES, the winning bidder is responsible for, and agrees to pay the final hammer price, a buyer’s premium of 15%, and any applicable sales tax charged by liveauctioneers.com
• Condition: Before you place a bid with Morning Glory Estate Sales, we strongly recommend, prospective bidders to examine lots in person prior to placing a bid. MGES staff make every attempt to note any issue(s) with condition or item damages in the lot description, but it is the responsibility of the bidder to determine lot condition prior to bidding. The lack of any note by MGES as to the condition of the lot does not imply that the lot is free of wear and tear. Unless otherwise stated, all lots are sold “AS IS, WHERE IS,” and all sales are final. We will not give refunds for condition or shipping issues.
All items are sold AS IS, WHERE IS, with NO WARRANTY expressed or implied. It is the responsibility of the buyer to determine the condition of the items, based on photos and descriptions, and bid accordingly. All items must be considered used or previously owned. NO REFUNDS WILL BE ISSUED.
MGES staff does not test or verify conditions or completeness of items being offered unless stated otherwise. Buyer has the right to test/inspect items at the preview dates.
• Catalog: MGES reserves the right to add or remove items from the auction; split or combine lots; ad minimum bids or reserve prices. MGES reserves the right to cancel, suspend, extend or reschedule an individual item and/or auction event or to make changes to the auction closing times. Information in catalogs and other advertisements are from sources believed to be reliable; however prospective purchasers are urged to inspect the inventory or property to satisfy themselves as to condition, signatures-markings, model, manufacturer, year, features, mileage, survey, acres, etc. Neither MGES nor our client make any guarantees and are not responsible for listing or advertising inaccuracies or discrepancies.
• Payment: Payment for all purchases is due at the conclusion of the auction via online payment through our online platform with credit card on file (hammer price for each item, buyer’s premium and sales tax will be calculated on invoice if applicable), unless wire transfer is required, (items over 5,ooo) which you will need to start the process ASAP since these may take 24/48 hours to complete. Buyer agrees not to initiate any credit card charge backs for purchases made, and agrees that NO refunds will be given. Payment for any titled item, such as autos, boats, trailers and some ATVs will require a wire transfer of funds in full before being released to the buyer. Payments will not be accepted on site the day of pickup. A valid credit card is required for bidding approval. No other payment method will be allowed, unless wire transfer/cashier check is applicable. At the conclusion of the auction, you hereby authorize MGES to charge the purchase price, buyer’s premium of 15%, and sales tax for your state and local tax rate to the credit card on your profile. You will not be able to pick up or ship your item(s) until it has been paid in full.
• Sales Tax: The winning bidder is responsible to pay applicable state and local sales tax as required by law. Which will be figured after the hammer price and is calculated with buyers premium included as stated by law. Exempt bidders should file a tax exemption form with MGES to have sales tax removed BEFORE BIDDING. please email gjackson@catholiccharitiesks.org to do so.
• Pick-up: BY APPOINTMENT ONLY. Feb. 15, 16, and 17th, unless otherwise agreed upon. Due to grounds we will need to schedule each appointment. You will receive an email invoice from us after the online auction and we will start to schedule appointments on Tuesday Feb. 13th, but it is YOUR RESPONSIBILITY TO RETURN OUR CALLS AND SCHEDULE YOUR PICK UP TIME WITHIN THESE THREE DAYS. Time slots will be limited. So please call as soon as possible to reserve your desired time slot. If you are unable to pick up during the designated pick up time, you must send a representative to pick up for you or forfeit your items. Please do not bid if you can’t pick up during the designated timeline. Pick up times are strict start and end times, you will need to arrive on time to pack and remove all your items within your designated pick-up time. If you have any questions or concerns about pick up please email gjackson@catholiccharitiesks.org BEFORE bidding. You must provide your own packing materials, moving equipment, and adequate manpower to safely and properly remove your items during the specified pick-up time. Large items that NEED FORKLIFTS will have extended date options only.
• Failure to Pick Up: Winning bidders must pick up or have lots picked up by UPS for shipping within our designated timeline above. After the designated timeline above the item/s will be considered abandoned unless other arrangements have been approved by MGES. In the case where the item is forfeited or abandoned the winning bidder will not be compensated in any way or receive any refunds and has released items to MGES for donation to Catholic Charities of Northeast Kansas or back to the Family Estate.
• Shipping: MGES does not have in-house shipping or packing services. We can recommend 3rd party shippers and movers. We have an extensive list for your convenience, please email gjackson@catholiccharitiesks.org to request a list be sent to you for research on prices and pick up availability. You are responsible for arranging for shipment and pick up paying all costs involved. WE ARE UNABLE TO GIVE REFUNDS DUE TO SHIPPING ISSUES SO PLEASE CALL THE LIST OF SUGGESTIONS FOR SHIPPING AND MOVERS BEFORE BIDDING TO MAKE SURE THEY CAN ABIDE BY OUR TIMELINE. Shipping is expensive, many times shipping can exceed the value of the item purchased. Forklifts will be required for some items in certain sales, please see list of 3rd Party vendors that can provide that service for your. MGES will not be responsible for loss or damage of purchased lots handled or shipped, nor for acts and omissions, by 3rd party shippers, whether recommended by us or not.

Please consider the costs involved in shipping items, we have provided a 3rd party UPS store that is very efficient and will pick up and carefully pack your items from our location, their information and USHIP as well as independent contractors that will pick-up, crate, etc.
Morning Glory Estate Sales is not responsible for accidents, thefts, errors or omissions. We reserve the right to refuse service to anyone bidding or selling. Purchaser does herby indemnify and hold harmless MGES and Seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale or by the removal of items purchased. Purchaser assumes all risk and liability resulting from the use of the item(s) sold hereunder; and shall defend, indemnify, and hold harmless MGES and Seller from any liability.
Choice of Law: These Terms and Conditions will be governed by and construed in accordance with the laws of the State of Kansas, without giving effect to its conflict of laws provisions or bidder’s actual state or country of residence. Any claims, legal proceeding or litigation arising in connection with the service will be brought solely in Johnson County, Kansas, and all bidders consents to the jurisdiction of such court. The invalidity or unenforceability of any provisions herein shall not affect the validity or enforceability of any other provision, which shall remain in full force and effect. Circle has the full discretion to waive or modify any and all of the terms and conditions contained herein.

The family of this remarkable estate have lived on the property for over 55 years and are devout Catholics, they have accumulated many treasures through their travels overseas and across the country.
Morning Glory Estate Sales, A Ministry of Catholic Charities of Northeast Kansas is honored to host this "Two Part" Online Auction. We are now on Part Two! Which includes Fine Art, Western and Santa Fe bronzes, traditional and antique furniture including a beautiful Steinway upright piano, antiques, collectibles and home decor.
Nationally recognized sculptors Juan Hamilton and Jesus Moroles are among the most significant sculptural works in the collection. The work by Hamilton, a large polished bronze sculpture, and a work by Moroles, a monumental carved granite fountain, are representative of each of these artists' oeuvre. The granite sculpture by Moroles is especially notable as another example of this fountain belongs to the permanent collection of the Santa Fe, New Mexico Art Museum.

Please be sure to read our terms and conditions, there is a buyers premium of 15% on top of the hammer price, sales tax may apply, and we have a wonderful 3rd party shipper and a list you may request for National movers/craters/forklift operators, etc. PLEASE NOTE: Some bronzes will need to be professionally moved and forklifts will be needed for many.
