Emporium Live Auction Terms & Conditions
A welcoming, transparent, and community-focused auction experience.
1. Registration
All bidders must register with valid contact and payment information prior to bidding. Emporium reserves the right to refuse or revoke bidding privileges at any time.
2. As-Is Condition
All items are sold AS IS, WHERE IS with no guarantees, warranties, refunds, or exchanges. Descriptions, photos, measurements, and condition notes are provided as a courtesy and reflect our honest opinion, but are not guarantees of authenticity, age, provenance, condition, or functionality. We encourage bidders to inspect items in person whenever possible.
3. Bidding
By placing a bid, you are entering into a binding agreement to purchase the item if you are the winning bidder. Emporium reserves the right to reject bids, withdraw lots, resolve disputes, or reopen bidding in the event of technical or clerical issues.
4. Buyer’s Premium
A buyer’s premium of 10% will be added to the final hammer price of each lot. Applicable sales tax and processing fees may also apply
5. Payment
Invoices are due upon receipt unless otherwise stated. Accepted payment methods will be listed on the auction platform. Cards on file may be charged for unpaid invoices.
6. Pickup & Removal
All purchases must be picked up during the scheduled pickup times listed for the auction. Items not removed within the designated timeframe may incur storage fees or be considered abandoned without refund. Buyers are responsible for bringing appropriate help, packing materials, and transportation.
7. Shipping
Shipping is available on select items unless otherwise noted. Shipping and handling costs are the responsibility of the buyer and are separate from the auction invoice. Emporium may use trusted third-party shipping providers. Emporium is not responsible for delays, loss, or damage caused during shipping.
8. Final Sale
All sales are final. No returns, refunds, chargebacks, or cancellations will be accepted.
9. Technology & Platform Issues
Emporium is not responsible for internet interruptions, bidding platform outages, delayed bids, or technical malfunctions that may affect bidding activity.
10. Auctioneer Discretion
The auctioneer has final discretion in determining bidding increments, resolving disputes, and determining the winning bidder.
11. Limitation of Liability
By participating in the auction, bidders agree that Emporium, its staff, consignors, and representatives shall not be held liable for damages, injuries, losses, or claims arising from participation in the auction, pickup, or use of purchased items.
12. Acceptance of Terms
By registering or placing a bid, bidders acknowledge that they have read and accepted all terms and conditions of the sale.
