Terms and Conditions of Sale
1. Property Sold "As Is": All property is sold "as is" without any express or implied warranties, including merchantability, fitness for a particular purpose, or descriptions regarding physical condition, provenance, or estimated value.
2. Inspection: Property is available for inspection by appointment only. Bidders are responsible for inspecting items prior to bidding to determine condition and any restoration.
3. Withdrawal: We reserve the right to withdraw any property before or during a sale without liability.
4. Right to Reject Bids: The auctioneer reserves the right to reject any opening or subsequent bids and may withdraw or pass on a lot at their discretion.
5. Reserves: Lots may be subject to a confidential minimum reserve price. Howard and Thomas or its affiliates may also have a financial interest in certain lots.
6. Bidding Procedure: The auctioneer has sole discretion over bidding advances and disputes. Our sale record is final.
7. Absentee Bidding: These services are provided as a convenience; we are not responsible for errors, omissions, or failure to execute such bids.
8. Title and Risk: Title passes at the fall of the hammer. The successful bidder assumes all risk and responsibility for the lot and must pay the full purchase price immediately unless otherwise agreed in writing. Packing and transport are at the purchaser's sole risk and expense.
9. Buyer’s Premium and Tax: A 25% buyer’s premium will be added to the hammer price. Unless exempt, all Kentucky purchases are subject to a 6% local sales or use tax.
10. Payment: Payments may be made via credit card, cash, or check. Items may be held until funds clear. A $35 fee applies to returned checks.
11. Removal: Purchased items must be removed within 14 days. After 14 days, a storage fee of $5.00 per lot, per day will apply. Items left beyond 30 days without arrangements will be considered abandoned.
12. Default: In the event of non-compliance, we reserve the right to pursue legal remedies, including holding the purchaser liable for the full price, canceling the sale, or reselling the property at the purchaser’s expense.
13. Liability: Our liability is limited to the actual purchase price paid.
14. Governing Law: These conditions are governed by the laws of the State of Kentucky. All disputes shall be resolved in the state or federal courts of Kentucky, and the purchaser waives the right to a jury trial.
