An auction is fun if you know the rules. Please note that registering to bid at the auction is an agreement between the purchaser and Bennett Auctions. The buyer agrees to the following terms and conditions. Each auction may have unique terms and conditions but will usually be the following. It is the buyer's responsibility to be aware of all terms of the auction.
The right to allow or not allow a bidder to register is solely reserved by Bennett Auctions. A valid driver's license or state issued identification is required in order to register. By agreeing to register the buyer is accepting all terms of the auction as may be provided in writing or verbally announced by auctioneer.
Please inspect all items prior to bidding. Remember, everything is sold "as is, where is" with no guaranty or warranty expressed or implied of condition, description, or authenticity. Bidders must rely entirely on their own inspection prior to bidding.
The bidder is responsible for knowing which item he/she is bidding on. If a bidder is unsure, please ask staff or refrain from bidding. Once a bidder has won the item, he/she has entered into a contract and is expected to pay for items won before leaving the premises.
All items are subject to state sales tax, unless stated by the Auctioneer. Buyers with a valid resale certificate exempting sales tax will not be required to pay sales tax.
The auctioneer reserves the right to accept bids in any increment he/she deems appropriate. There is no obligation from the auctioneer to accept a reduced or "cut" bid from a bidder. The auctioneer reserves the right at his/her sole discretion to remove an item if a reasonable bid has not been received and accepted at the time of offering.
The highest bidder will be the buyer. If any dispute arises between two or more bidders, the Auctioneer reserves the right to make a final decision regarding the sale as final. The auctioneer may also decide to open the bidding again. The decision of the auctioneer shall be final and absolute.
The record of sale kept by the auctioneer and clerk will be absolute and final in all disputes. Auctions may be video or audio recorded.
All items are subject to a 15% buyer's premium, unless otherwise stated by the Auctioneer.
Bennett Auction Sales is not responsible to "guard" items sold during the auction. The buyer is solely responsible for all purchased items immediately following the winning bid.
To make room for the next auction, all purchases are required to be picked up by specified date and time unless other arrangements have been made with Bennett Auctions. Any items not picked up by the posted date and time will be forfeited with no return of monies paid.
Sellers cannot bid on their own merchandise. All bills must be paid in full the day of the sale regardless of pick up date. All purchases must be paid for within 30 minutes of the conclusion of the last item sold at the auction.
If paying by personal check, it must be able to be ACH or electronically collected. The name and address on the check must match the purchaser's driver's license name and address. Additionally, buyer must sign a check security agreement or provide a Bank Letter of Guarantee.
