TERMS of SALE REAL ESTATE: A 12% Buyer's Premium shall be added to the highest bid and become the final contract price. A $5000 deposit in the form of Cash or Cashier's Check will be required on the day of sale in order to bid. An additional deposit to reflect 10% of the bid amount to be delivered to the office of the Auctioneer within 5 business days. Deposit funds shall be held in escrow by McArtor & Co. Balance to be paid in cash at settlement, which shall take place within 30 days. If payment of the deposit or balance does not take place within the specified time, the deposit shall be forfeited and the property may be resold at the risk and expense of the purchaser. Interest to be charged on the unpaid purchase money, at the rate of 1.2% per annum, from date of contract to date of settlement. All adjustments, including taxes, all other public charges and assessments payable on a monthly or annual basis, and sanitary and/or metropolitan district charges, if any, to be adjusted for the current year to date of contract and assumed thereafter by the purchaser. The property will be sold in “AS IS” condition, and subject to easements, agreements, restrictions or covenants of record affecting same, if any. Purchaser assumes the risk of loss from the date of contract forward. If the Seller is unable to convey good and marketable title, the purchaser’s sole remedy in law or equity shall be limited to the refund of the deposit. Upon refund of the deposit this sale shall be null and void and of no effect, and the purchaser shall have no further claim against the Seller or Auctioneers. Recordation costs, transfer taxes and all costs incidental to settlement to be paid by the purchaser except where otherwise mandated by local, State or Federal law. Time is of the essence. Broker co-op available. If bidder is represented by a MD licensed real estate agent/broker. Agent must register bidder up to 48 hours prior to the auction and accompany the bidder at auction. 2% Broker Co-op offered. Reference Libre 1334, Folio 733. Any personal property remaining at the property at the time of settlement will transfer to the buyer.

TERMS of SALE PERSONAL PROPERTY: All items are offered for sale as one entirety from the estate. By bidding, all bidders agree to the following terms and conditions: AS-IS / WHERE-IS: All personal property is sold AS-IS, WHERE-IS, with no warranties or guarantees expressed or implied. It is the bidder’s responsibility to inspect the property prior to bidding. No refunds or adjustments will be made for any reason. BUYER’S PREMIUM: A 10% Buyer’s Premium will be added to the final bid price to determine the total purchase price. PAYMENT TERMS: Payment is due in full immediately at the conclusion of the auction. Cash only. No checks, credit cards, wire transfers, or electronic payments will be accepted. REMOVAL OF PROPERTY All purchased property must be removed within two (2) days of the auction. Removal must be scheduled with the Auctioneer immediately following the sale. Failure to remove items within the allotted time may result in forfeiture of the property without refund. ENTIRETY SALE The personal property is being sold as a single lot (entirety). No individual items will be separated or sold. RISK OF LOSS All risk of loss or damage transfers to the Buyer immediately upon acceptance of the winning bid. DEFAULT Any Buyer who fails to comply with the terms of sale will be considered in default and may forfeit all rights to the property without refund. AUCTIONEER’S DISCRETION The Auctioneer reserves the right to reject any bid, resolve bidding disputes, and enforce all terms of sale. Collusion is a felony and will not be tolerated. The age, sizes, type, condition and descriptions of personal property are estimated. It is the bidders responsibility to do all research necessary to determine value.

TERMS OF SALE FOR VEHICLE: Car sold strictly 'as-is'. Car appears to run and is being offered with clean title and no liens. There is a 10% buyers premium added to the bid price to become the final purchase price. It is the buyers responsibility to have the vehicle State Inspected if required in your state and have the vehicle registered.
