Terms & Conditions
Auction Update (8/14): We sold everything outside on Friday, but we only got through the very front of the store inside, so most of the items inside the store remain to be sold on Saturday, including the fixtures. We will have the same hot dog vendor again on Saturday. We look forward to seeing you again (or for the first time) on Saturday.
General Terms: All items are sold “AS IS”, “WHERE IS”, with no warranties or guaranties expressed or implied. We recommend that all prospective buyers attend the presale exhibition and examine the merchandise to their own satisfaction. Written and oral descriptions are the opinion of the auction company and should not be construed as a guarantee of any kind in regard to the authenticity, age or condition of any lot being sold. Buyers are responsible for their purchases when the auctioneer says, “Sold”. The last bid at an auction is an oral contract and is legally binding. All sales are final, and the auctioneer’s decision is final. Sunflower Auction is not responsible for accidents. The auctioneer is acting as an agent of the seller. Statements made sale day take precedence over printed materials. Bidding on an item indicates a buyer’s acceptance of these terms.
Presale Exhibition: August 14 & 15 at 8AM each day.
Item Removal: All merchandise must be paid for before it is removed from the premises. All inventory must be removed the day of the sale. Fixtures must be removed within one week after the sale. The orange pallet racks inside the building stay with the building and are not for sale.
Payment: Cash, Visa, MasterCard, Discover (no checks). Fast checkout line for cash (no coins, cash invoices will be rounded down to the next lower whole dollar).
Combined Buyer’s Premium & Sales Tax: 10%
Parking: Please park in the regular parking lot on the north side of the building. There are two entrances/exits onto Highway 40. Please do not block the exits or park along Highway 40. There will be overflow/large vehicle parking on the east and south sides of the building. Please drive along the east side of the building and look for the designated parking area(s). Orange cones will mark a loading zone at the front doors of the building. Please keep this area clear unless you are immediately loading your vehicle.
Food: There may be one or more third-party food vendors on site to provide food service. There are also numerous restaurants close by along Highway 40 and east on Noland Road.
Restrooms: There is one public restroom inside the building, and one or more portable restrooms may be available outside the building.
Order of Sale: This will be an uncatalogued auction, meaning there is no numbered catalog available or set order to the sale. Items will be held up and sold in quick succession in a large auction ring set up at the front of the building. This is where the majority of the items will be sold. Seating will not be available at this auction. We will walk the outside items, most likely on Friday to allow adequate time for removal. We will walk any remaining items inside the building that can’t be brought to the auction ring on Saturday afternoon. This will include the gondola shelving and any remaining fixtures.
Absentee Bids: Absentee bids may be executed on behalf of buyers who cannot attend the sale in person in a competitive manner as if they were present. The auctioneer does permit auction staff to bid on a limited number of items, just like any other bidder, provided they are buying with personal funds and the items are for personal use.
Auction Update (8/13): We have been unable to secure a food vendor for the auction, so food and drink will be on your own, but there are numerous restaurants close by. Regarding the order of the sale, on Friday we intend to sell inside for the first couple hours, then head out to sell everything outside, then head back inside to finish the day. Saturday will be all inside, with the fixtures selling last. The building is air conditioned, but we'll need to keep the doors closed as much as possible. The women's restroom is located inside the building, and the men's portable toilets are located outside the building. We will be using different bidder numbers each day, so if you are coming back on Saturday, please bring your Friday bidder card to exchange it for a new bidder number on Saturday. This will speed up the registration process on Saturday, thanks. We look forward to seeing you on Friday.
COVID-19 Policy: We will follow the Eastern Jackson County Recovery Plan Version 2.5 (https://www.jacksongov.org/1191/Eastern-Jackson-County-Recovery-Overview). Per the plan, masks and social distancing are required both inside and outside the building. Please bring your own mask. We reserve the right to refuse entry and/or refuse a bidder number to anyone not wearing a mask. Please do not come to the auction if you are feeling sick. Please be courteous to those around you and spread out as much as possible during the auction. It is our goal to keep everyone safe and healthy and to set a positive example of how to conduct a proper auction during this time.
