These Terms may vary by auction. Any auction-specific terms announced, posted, or published for a particular sale shall take precedence over these general Terms.
1. Auctioneer Authority
BB Realty & Auctions LLC acts as agent for the Seller. The Auctioneer reserves the right to:
* Determine bid increments
* Resolve any bidding disputes
* Withdraw or re-offer any item
* Reject any bid or bidder
* Cancel or postpone the auction
The Auctioneer’s decision is final in all matters.
2. Bidder Registration
All bidders must register and receive a bidder number prior to bidding. A valid government-issued photo ID is required. Registration approval is at the sole discretion of the Auctioneer.
Bidders are responsible for all bids placed using their bidder number, whether placed by the Bidder or another party.
3. Bidding & Winning Bids
All bids are binding and may not be retracted. The highest bidder acknowledged by the Auctioneer shall be deemed the Buyer. The Auctioneer’s in-house records shall prevail over any electronic or third-party records in the event of a discrepancy.
4. Buyer’s Premium
A Buyer’s Premium will be added to the final hammer price as follows:
* **Cash Payments**: 15%
* **Credit Card Payments**: 18%
**Heavy Equipment, Vehicles, UTVs, and Zero-Turn Mowers:**
* Winning bids of $36,000 or less: 9%
* Winning bids over $36,000 and under $60,000: 6%
* Winning bids over $60,000: 3%
Buyer’s Premiums are subject to auction-specific adjustments.
5. Payment Terms
All purchases must be paid in full **the day of the auction**, no later than **30 minutes after the final item is sold**, unless otherwise stated.
Accepted forms of payment include:
* Cash
* Credit Cards
* Certified or Cashier’s Checks
* Wire Transfers
Personal checks are accepted **only** for trailers, vehicles, and heavy equipment and must be accompanied by a bank letter of guarantee. Items will not be released until all checks have fully cleared.
A $500 fee will be charged for any returned or NSF checks. Buyers are responsible for all collection costs, including attorney fees.
6. Sales Tax
Sales tax will be collected where required by law unless the Buyer provides valid exemption documentation prior to payment.
7. Item Condition & Inspection
All items are sold **AS IS, WHERE IS**, with no warranties or guarantees of any kind, expressed or implied, including but not limited to condition, fitness, merchantability, year, make, model, or mileage.
Buyers are responsible for conducting their own inspections prior to bidding. No refunds or returns will be permitted for any reason.
8. Descriptions & Errors
All descriptions are believed to be accurate but are not guaranteed. Errors or omissions do not void a sale. Announcements made by the Auctioneer during the auction take precedence over all printed or advertised material.
9. Vehicle & Equipment Provisions
* Test drives are not permitted due to insurance restrictions.
* Vehicles may be moved upon request.
* Titles will be released within 24 hours of confirmed payment.
* Vehicles and heavy equipment will not be released until full payment is received and verified.
10. Removal, Load-Out & Storage
Buyers are responsible for the removal and loading of purchased items. Assistance may be provided at the Auctioneer’s discretion but is not guaranteed.
Items not picked up by **8:30 PM on auction day** will be subject to storage. Items left beyond **48 hours** may be resold or donated at the Auctioneer’s discretion with no refund to the Buyer.
Once an item is sold, the Buyer assumes all responsibility for that item.
11. Risk of Loss
Risk of loss transfers to the Buyer immediately upon being declared the winning bidder.
12. Liability & Safety
BB Realty & Auctions LLC assumes no liability for accidents, injuries, or damages on auction premises.
* No smoking, including e-cigarettes
* No animals allowed except service animals
* Parents must supervise children under 18 at all times
This Auction Company does not carry a liability policy.
13. Military Discount
A 5% discount is offered to active and former military members with a valid ID.
This discount does **not** apply to:
* Real property
* Homes
* Vehicles
* Any item over $500
14. Shipping
If shipping is requested, the Buyer is responsible for all shipping, handling, and insurance costs. A minimum handling fee of $40 applies.
15. Online Bidding – AuctionTime Platform
Certain auctions are conducted using the AuctionTime online bidding platform. By registering and bidding through AuctionTime, the Bidder agrees to AuctionTime’s Terms of Use in addition to these Terms.
BB Realty & Auctions LLC is not responsible for:
* Internet outages
* Platform malfunctions
* Delayed bids
* Inaccurate bid displays
* Technical failures beyond our control
In the event of a dispute, the Auctioneer’s records and final determination shall govern.
16. Default & Non-Payment
Failure to comply with payment terms constitutes default. Remedies may include forfeiture of items, resale without notice, and pursuit of all legal remedies.
17. Dispute Resolution & Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri. Venue for any legal action shall lie exclusively in the Missouri courts.
18. Severability & Modifications
If any provision of these Terms is held invalid, the remaining provisions shall remain in full force and effect. The Auctioneer reserves the right to modify these Terms at any time.
19. Acceptance of Terms
By registering, bidding, or purchasing, the Bidder acknowledges that they have read, understood, and agree to these Terms and Conditions in full.
