3.) RIGHT OF REFUSAL - You agree that Estate Auction Pros, LLC may refuse any bid from and/or refuse to ship to, any person, for any reason, at any time.

You agree to hold the auctioneer harmless for any errors and/or omissions in the item description.

Your bid will be based solely on your own pool of knowledge and research.

All measurements are close approximations.

In some instances, the digital camera flash may alter an item's appearance. This is not an acceptable reason for a return / refund request.

5.) AS-IS, WHERE-IS - All items in this auction are being offered for sale in as found condition with NO effort being made to improve them. You agree that NO warranties or guarantees of any kind have been expressed or implied.

6.) BUYER’S PREMIUM - A 15% buyer’s premium is in effect.

7.) CONVENIENCE FEE - All credit card payments will be subject to a 3% convenience fee.

8.) CREDIT CARD PROCESSING - You agree by reading these auction terms, registering for this on-line auction, providing your credit card information to HiBid.com, and participating in this on-line auction, you are authorizing Estate Auction Pros, LLC to automatically charge your credit card on file with HiBid for your on-line auction purchase(s) when this auction is over.

9.) YOUR CREDIT CARD IS DECLINED, you will receive one automatic notification from HiBid. If you fail to resolve payment within 24 hours from the time your one automatic notification was sent from HiBid, sale is void.

10.) YOU NEED SHIPPING -

Please make sure the item is available for shipping prior to bidding.

Please notify us immediately after receiving your winning bid notice from HiBid that you need shipping.

GOIN' POSTAL is your only shipping option.

There is NO in-house shipping available.

If you have the slightest concern regarding shipping cost, please feel free to call 636-456-1853 for a shipping ESTIMATE prior to bidding.

Estate Auction Pros, LLC will NOT be held liable for any damage during shipment claims, and we will NOT get involved in any shipping disputes.

It is advisable that you have your item(s) shipped insured.

If you fail to contact GOIN' POSTAL and do not make / pay for shipping arrangements within 2 weeks of the auction's end, your purchase will be considered abandoned. You will NOT receive a refund and the item(s) will be resold - NO EXCEPTIONS.

11.) IN-PERSON PICK UP -

You will have to show a government issued photo I.D. (NO exceptions)

Please come prepared and bring your own help and packing material as there will be NO on-site packing materials or help available to load your item(s).

12.) YOU FAIL TO PICK UP -

You fail to pick up your item on the scheduled pick up day and time - AND - you fail to make alternative acquisition arrangements within 24 hours after the scheduled pick up day and time, the result will be:

Your auction purchase(s) will be considered ABANDONED

You will forfeit the legal right to your auction purchase(s)

You will NOT receive a refund

The item(s) will be resold.

13.) NOT LIABLE - You agree that Estate Auction Pros, LLC and Seller(s) will NOT be held liable for any accidental loss that you may incur while bidding on, picking up, transporting, or using your item(s) after the auction - including but not limited to personal bodily injury and property damage.

14.) CHOICE OF LAW, JURISDICTION, and AND VENUE: You agree that any legal disputes will be governed by Missouri law and will be settled in a Saint Charles County Court, in St. Charles, Missouri 63301.

15.) INTERNET BIDDING -

HiBid.com is providing internet bidding as a service to bidder.

Bidder acknowledges and understands that this internet bidding service may or may not function correctly throughout the course of this online auction.

Should the internet service or on-line auction software fail to perform correctly throughout the course of this online auction, under no circumstances shall the bidder have any claim rights against HiBid.com, Estate Auction Pros, LLC, or Seller(s).

16.) WITHDRAW - Estate Auction Pros, LLC reserves the right to withdraw items in this auction for any reason, at any time, with NO prior notification.
