1. All Sales Final
All property is sold AS IS, WHERE IS, without warranty of any kind. There are no returns, refunds, exchanges, or credits.
2. Condition of Items
All descriptions, whether in catalog, online, or verbal, are provided as a service to the bidder and do not constitute a warranty.
o Buyers are responsible for examining items in person, by photograph, or via additional condition reports prior to bidding.
o No guarantees are made as to the accuracy, completeness, or authenticity of descriptions, condition reports, or attributions.
3. Title & Risk of Loss
Title passes to the highest bidder upon the auctioneer's declaration of sold. All risk of loss, damage, or theft transfers to the buyer at that moment, regardless of payment or delivery status.
4. Disputes
In the event of a dispute between bidders, the auctioneer shall have sole discretion to determine the winning bidder or to re-offer the lot. The auctioneer's decision is final and binding.
5. Auctioneer's Rights
Stevens Auction Co. reserves the right to:
o Refuse any bid;
o Withdraw any lot prior to or during the sale;
o Combine or divide lots;
o Alter the order of the sale.
6. Pickup & Storage
o All purchases must be picked up within 15 calendar days of the auction.
o Items not picked up within this period are subject to a storage fee of $10 per item, per day. Any items left over 60 days will be considered abandoned and Stevens Auction will re-sale at the next appropriate auction at its sole discretion.
o Buyer is responsible for any storage, handling, and shipping costs.
7. Shipping
Stevens Auction Co. does not pack or ship items.
o Packing/shipping is the buyer's sole responsibility.
o Assistance may be offered as a courtesy, but is at the buyer's risk. Stevens Auction Co. assumes no liability for damage or loss in shipping.
8. Liability Limitation
Stevens Auction Co.'s total liability to any buyer shall not exceed the purchase price paid for the item(s) in dispute.
9. Absentee, Online & Telephone Bidding
These services are offered as a convenience and Stevens Auction Co. is not responsible for errors, omissions, missed bids, or technical failures.
10. Estimates
Any estimates provided are opinions only and are not predictions of actual hammer price.
11. Winning Lots & Amounts
By bidding with Stevens Auction Company, you consent for Stevens Auction Company to use any information, including price and details, about any Lot won for advertising purposes post auction.
12. No Warranties regarding condition and Lot information, including dimensions.
Stevens Auction Company makes no warranties or guarantees, express or implied, about the accuracy of any Lot. Bidders have the duty to inspect in person prior to bidding on any Lot.
13. Abandonment of Property
If any item or property is left at Stevens Auction Company after 45 days, the property is deemed abandoned and may be resold at Stevens Auction Company's discretion. All efforts should be made with Stevens Auction Company immediately after the auction to ensure property, including storage and shipping, is arranged.
14. Legal Venue
Any dispute arising between Stevens Auction Co. and any bidder shall be resolved in the courts of Monroe County, Mississippi.
15. Binding Agreement
Registration to bid constitutes acceptance of all terms and conditions herein.
