GENERAL AUCTION TERMS & CONDITIONS

By registering for and bidding in any auction conducted by Martin Vintage Sales, each bidder acknowledges that they have read, understood, and agree to these Terms & Conditions. Placing a bid constitutes a legally binding agreement to purchase should they become the successful high bidder.

1. AUCTION FORMAT

Martin Vintage Sales conducts a variety of auction formats, including live in-person auctions, online-only auctions, timed auctions, online pre-bidding with a live in-person auction (Hybrid Auctions), and other auction formats as announced.

The auction format, bidding deadlines, Buyer's Premium, payment requirements, pickup schedule, shipping availability, and any auction-specific terms will be published in each individual auction listing and become part of these Terms & Conditions.

For Hybrid Auctions:

• Online bidding through HiBid is PRE-BIDDING ONLY.

• Online bidding closes at the published deadline before the live auction begins.

• The highest online bid becomes the opening bid during the live in-person auction.

• The auctioneer will continue bidding live from the highest online bid.

• If no higher bid is received from the live audience, the highest online bidder will be declared the successful purchaser.

• If live bidding exceeds the online bidder's maximum bid, the live floor bidder becomes the successful purchaser.

• Online bidding DOES NOT continue during the live auction.

Martin Vintage Sales strongly encourages online bidders to enter their maximum bid prior to the close of online bidding. HiBid's automatic bidding system will bid competitively on the bidder's behalf up to, but never exceeding, the bidder's maximum amount.

Martin Vintage Sales reserves the right to postpone, cancel, withdraw, combine, divide, reorder, extend, or reoffer any lot at its sole discretion.

2. REGISTRATION

A valid registration is required before bidding.

Martin Vintage Sales reserves the right to approve, deny, suspend, or revoke bidding privileges at any time.

Bidders may be required to provide valid government-issued identification, a valid credit or debit card, or additional information necessary to verify identity.

False, misleading, or incomplete registration information may result in cancellation of bids and suspension from future auctions.

3. BIDDING

Each bid placed constitutes a legally binding contractual offer to purchase.

Bidders are responsible for understanding the auction format and monitoring their bids.

The auctioneer shall have sole discretion in resolving bidding disputes, determining the successful bidder, reopening bidding, correcting clerical errors, reoffering lots, withdrawing lots, combining lots, or dividing lots.

The auctioneer's decision shall be final.

Martin Vintage Sales is not responsible for missed bids, internet outages, software failures, delayed bids, platform interruptions, browser issues, mobile device issues, or technical failures beyond its control.

4. BUYER'S PREMIUM

A Buyer's Premium applies to all purchases.

The applicable Buyer's Premium will be published within each auction listing.

Applicable sales tax, processing fees, transfer fees, and other charges required by law will be added where applicable.

5. PAYMENT

Payment is due immediately upon completion of the auction unless prior arrangements have been approved by Martin Vintage Sales.

For online purchases, the credit or debit card on file may be charged automatically following the auction.

If the card on file is declined, expired, invalid, or otherwise unable to be processed, Martin Vintage Sales will charge an additional $25 fee for our time in chasing down your form of payment.

Returned checks, declined payments, payment reversals, chargebacks, or fraudulent transactions may result in cancellation of bidding privileges, collection efforts, legal action, and recovery of collection costs where permitted by law.

Title to all purchased property remains with Martin Vintage Sales until payment has been received in full.

6. PICKUP

Pickup dates, times, and locations will be published for each auction.

Buyers are solely responsible for removing purchases during the published pickup period.

Martin Vintage Sales is not responsible for loading purchases.

Buyers should bring sufficient labor, equipment, boxes, packing materials, and transportation necessary to safely remove their purchases.

Any assistance provided by Martin Vintage Sales personnel is offered solely as a courtesy and at the buyer's own risk.

Pickup outside the published schedule is available only with prior approval from Martin Vintage Sales.

7. SHIPPING

Shipping is available only on lots designated as shippable.

Unless otherwise stated, buyers requiring shipping must notify Martin Vintage Sales no later than the published pickup deadline.

If your shipping preference isn’t indicated, your items will automatically be shipped and shipping charges will be charged to your card on file. We do not have the room to store your items for any period of time past the designated pickup days.

Buyers are responsible for all shipping, packaging, handling, insurance, transfer fees, and related expenses.

Martin Vintage Sales reserves the right to determine the shipping carrier, packaging method, insurance requirements, and shipping schedule.

Reasonable processing time should be expected following the auction.

Large, oversized, unusually fragile, or specialty items may require professional packing or shipment through a third-party shipping provider selected by Martin Vintage Sales.

Once a package has been transferred to the shipping carrier, Martin Vintage Sales is not responsible for loss, theft, delay, or damage occurring during transit. Any shipping claims must be filed directly with the carrier or applicable insurance provider.

International shipping is not available.

8. FAILURE TO PICK UP

Items not picked up or shipping arrangements not made by the published pickup deadline, without prior written approval from Martin Vintage Sales, shall be deemed abandoned.

Abandoned property immediately becomes the property of Martin Vintage Sales without refund or credit to the buyer.

Martin Vintage Sales reserves the right to resell, donate, recycle, dispose of, or otherwise handle abandoned property at its sole discretion.

Storage fees may be assessed for approved delayed pickups.

9. CONDITION OF PROPERTY

ALL PROPERTY IS SOLD AS-IS, WHERE-IS, WITH ALL FAULTS.

No warranties or guarantees, expressed or implied, are made regarding any item offered for sale.

Descriptions, photographs, videos, measurements, verbal statements, and catalog information are believed to be accurate but are not guaranteed.

Buyers are solely responsible for determining the condition, authenticity, completeness, age, quality, rarity, functionality, suitability, and value of each item before bidding.

Failure to inspect an item does not relieve the bidder of responsibility.

No refunds, returns, exchanges, credits, adjustments, or chargebacks will be accepted.

10. FIREARMS AND REGULATED ITEMS

All sales involving firearms or regulated items must comply with applicable federal, state, and local laws.

Buyers are solely responsible for determining whether they may legally purchase, possess, receive, transfer, or own any regulated item.

Transfers through a Federal Firearms License (FFL) dealer shall be completed at the buyer's expense where required by law.

Transfer fees, shipping charges, insurance, background checks, and compliance costs are the responsibility of the buyer.

No refunds shall be issued if a buyer cannot legally receive or possess a regulated item.

Firearms will not be shipped where prohibited by law.

11. BIDDER RESPONSIBILITIES

Each bidder is responsible for:

• Reading the auction listing and these Terms & Conditions.

• Reviewing all descriptions and photographs.

• Asking questions before bidding.

• Inspecting property whenever inspections are available.

• Understanding payment requirements.

• Understanding pickup deadlines.

• Requesting shipping before the published deadline.

• Complying with all applicable laws.

Failure to read the Terms & Conditions or auction listing does not relieve the bidder of responsibility.

12. DEFAULT

Failure to pay, complete the purchase, comply with pickup requirements, or otherwise comply with these Terms & Conditions constitutes default.

Martin Vintage Sales may, at its sole discretion:

• Cancel the sale.

• Resell the property.

• Retain deposits where applicable.

• Suspend or permanently revoke bidding privileges.

• Pursue collection efforts.

• Recover damages, attorney's fees where permitted by law, and all other available legal remedies.

13. LIMITATION OF LIABILITY

Martin Vintage Sales, its owners, employees, agents, auctioneers, consignors, and representatives shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from participation in any auction.

Martin Vintage Sales is not responsible for clerical errors, omissions, internet outages, bidding platform interruptions, software failures, catalog inaccuracies, shipping carrier performance, delays, accidents, or events beyond its reasonable control.

Participation in any auction is entirely at the bidder's own risk.

14. RIGHT TO REFUSE SERVICE

Martin Vintage Sales reserves the right to refuse service, refuse registration, reject bids, remove bidders, withdraw lots, combine lots, divide lots, correct clerical errors, resolve bidding disputes, postpone auctions, extend auctions, or cancel auctions at its sole discretion.

15. GOVERNING LAW

These Terms & Conditions shall be governed by and interpreted under the laws of the State of North Carolina.

Any legal action arising from participation in a Martin Vintage Sales auction shall be brought in the appropriate court located within the State of North Carolina unless otherwise required by law.

16. ACCEPTANCE

Participation in any Martin Vintage Sales auction constitutes full acceptance of these Terms & Conditions.

This is a Hybrid Auction, combining online pre-bidding through HiBid with a live in-person auction.


Online Pre-Bidding


Browse the catalog and place your bids through HiBid before the published online bidding deadline.


We encourage all bidders to enter the maximum amount they are willing to pay. HiBid’s automatic bidding feature will bid on your behalf only as needed, up to your maximum bid.



When Online Bidding Closes


At the published closing time, online bidding ends.


The highest HiBid bid for each lot becomes the opening bid when that item is offered during the live auction.



Live In-Person Auction


Each lot is then sold live by the auctioneer.


* If no one attending the live auction bids higher, the HiBid high bidder wins the item.

* If a live bidder exceeds the HiBid bidder’s maximum bid, the live bidder becomes the successful purchaser.

* Online bidding does not continue during the live auction.


Our Recommendation


For your best chance of winning, enter the highest amount you are willing to pay before online bidding closes.


HiBid’s automatic bidding system will represent you during the live auction by bidding competitively on your behalf—up to your maximum bid. If the live bidding does not exceed your maximum, you win the item, often for less than your maximum bid.
