ESTATE SALE TERMS & CONDITIONS

�� ESTATE SALE INFORMATION
Locations will be provided the day before each sale.
Please check the sale listing for the exact dates, times, location, and any special instructions.

�� PAYMENT METHODS
Fresh Start Cleanouts accepts:
Cash
Cash App
Venmo
Credit / Debit Card
Tap to Pay – A 2.6%+$0.15 service fee will apply to tap to pay purchases.
Manual Card Entry – A 3.5%+$0.15 service fee will apply to purchases where manual card information is necessary.
Payment must be made at the time of purchase unless otherwise approved by Fresh Start Cleanouts.
All sales are final.

��️ PLEASE BRING YOUR OWN SUPPLIES
Customers are responsible for bringing any supplies they may need, including:
Bags
Boxes
Packing materials
Moving blankets
Tie-downs/ratchet straps
Tools for disassembly
Any other materials needed to safely transport purchased items
Fresh Start Cleanouts does not guarantee that bags, boxes, packing materials, or tools will be available.

�� LOADING & REMOVAL
Customers are responsible for loading and transporting their purchases.
Please bring sufficient help to move large, heavy, or bulky items.
Fresh Start Cleanouts employees may not be available to assist with loading.
Any item requiring disassembly or removal must be removed by the purchaser unless otherwise agreed upon in advance.
Customers are responsible for ensuring that purchased items can safely fit in their vehicle or trailer.

⚠️ SAFETY
Customers enter the property at their own risk.
Fresh Start Cleanouts is not responsible for accidents, injuries, falls, damage to personal property, or injuries resulting from the removal or loading of purchased merchandise.
Please use caution when entering garages, basements, attics, sheds, outbuildings, stairways, or other areas of the property.
Children must remain under the supervision of an accompanying adult.

�� CONDITION OF ITEMS
All merchandise is sold AS-IS, WHERE-IS, with no warranties or guarantees, expressed or implied.
Fresh Start Cleanouts makes every reasonable effort to describe items accurately and provide photographs when applicable. However, descriptions, measurements, photographs, and condition assessments are provided for informational purposes only.
All measurements are approximate.
Photographs are intended to provide additional information but may not accurately represent the color, size, condition, or appearance of an item.
Customers are encouraged to personally inspect items before purchasing whenever possible.

�� ALL SALES ARE FINAL
ALL SALES ARE FINAL.
Fresh Start Cleanouts does not accept returns, exchanges, refunds, or cancellations after a purchase has been completed.
By purchasing an item, the customer acknowledges that they have had the opportunity to inspect the item and accepts the item’s condition.

��️ PRICING & NEGOTIATION
Prices are determined by Fresh Start Cleanouts.
Where negotiation is permitted, Fresh Start Cleanouts may accept reasonable offers at its discretion.
An accepted offer constitutes a completed sale.
Prices and discounts may change during the course of a sale at the discretion of Fresh Start Cleanouts.

�� DISCOUNTS
Any advertised discounts apply only to qualifying merchandise and during the stated discount period.
Unless specifically stated otherwise, discounts do not apply to:
Items specifically excluded from the sale discount
Items marked as firm/fixed price
Special items or bundles
Any $10 Bag or other specially designated promotional item
Fresh Start Cleanouts reserves the right to establish, modify, or exclude items from promotional discounts.

�� $10 BAG
When a $10 Bag promotion is offered, the bag is sold for a fixed price of $10.00.
The $10 Bag price is not subject to additional percentage discounts unless specifically stated by Fresh Start Cleanouts.

�� PICKUP / REMOVAL DEADLINES
All purchases must be removed during the designated sale or pickup period unless prior arrangements have been made with Fresh Start Cleanouts.
Failure to remove purchased merchandise within the required time may result in the merchandise being considered abandoned. Abandoned items may be placed back on sale.
Fresh Start Cleanouts reserves the right to charge additional fees or dispose of abandoned merchandise when necessary.

�� PROPERTY ACCESS
Customers may only enter areas designated as open to the public.
Certain rooms, closets, buildings, storage areas, or portions of the property may be restricted.
Customers must follow all posted instructions and directions from Fresh Start Cleanouts staff.

�� NO EARLY SHOPPING
Unless specifically announced by Fresh Start Cleanouts, there will be:
NO EARLY SHOPPING, NO EARLY PRICING, AND NO PRE-SALES.
Customers must wait until the advertised sale opening time.

�� CUSTOMER CAPACITY
For safety reasons, Fresh Start Cleanouts may limit the number of customers permitted inside the property at one time.
Customers may be asked to wait outside until space becomes available.

�� PAYMENT DISPUTES
Once payment has been accepted and the customer has received the purchased merchandise, the transaction is considered complete.
Customers are responsible for verifying their purchases and payment totals before leaving.

�� DIGITAL SALES / APP PURCHASES
When purchases are made through the Fresh Start Cleanouts application, the customer agrees to the purchase price displayed or accepted through the application.
A completed digital transaction constitutes a purchase and is subject to these Terms & Conditions.
Customers are responsible for maintaining access to their account and ensuring that their contact and payment information is accurate.

⚠️ TECHNICAL ISSUES
Fresh Start Cleanouts is not responsible for temporary interruptions, technical failures, internet outages, payment-processing failures, application errors, or other circumstances outside of its reasonable control.
If a technical problem affects a sale or transaction, Fresh Start Cleanouts may pause, extend, modify, or otherwise adjust the sale as reasonably necessary.

�� PHOTOGRAPHS & DESCRIPTIONS
Photographs and descriptions are provided to help customers evaluate merchandise.
Customers understand that photographs may not show every defect, imperfection, alteration, repair, or characteristic of an item.
When possible, customers should inspect items personally before purchasing.

�� AGREEMENT TO TERMS
By entering the sale, purchasing an item, submitting an offer, or completing a transaction through Fresh Start Cleanouts, you acknowledge that you have read, understand, and agree to these Terms & Conditions.
Fresh Start Cleanouts reserves the right to refuse a sale, limit purchases, remove customers from the property, or modify sale procedures when necessary to protect customers, employees, property, or merchandise.
