Terms and Conditions of Catalogue Auctions
The A.E.G. (American East Auction Gallery-Home of Chandler's Auctions) Auction--pick up dates day of auction for in person bidders, Sunday (March 1) immediately following auction, Monday (March 2) from 2 PM until 6 PM and Tuesday (March 3) 10 AM until 3 PM . All items must be removed by March 3 at 3 PM.
By registering for this auction you agree to the terms and conditions as stated below.
Conditions: Chandler's Auctions and Estate Sales strives to accurately describe the items being sold, but all property offered for sale is strictly AS-IS WHERE-IS with all faults. All sales are final and no refunds are given. The sales records and recordings shall be conclusive. It is the responsibility of the bidder to determine the exact condition and authenticity of each item. No statement in this catalogue or by representatives of C.A.E.S. shall be considered as a warranty or assumption of liability. Oral and written descriptions given by C.A.E.S. staff members in person or electronically are given as a courtesy to a client, are only an opinion, and should not be considered as a guarantee of age, composition, or authenticity. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear or imperfections. A good condition report considers age and use of item with appropriate wear. By bidding, you signify that you have either closely examined the items, have chosen not to examine them, or have hired an independent agent to examine the item(s) for you. Condition reports are available via the online catalog or by contacting The Gallery on First using 336-416-3803 or info@chandlersauction.com Auctioneer: Chandler Eshleman, NCAL#9849. The auctioneer reserves the right to withdraw a lot for any reason he deems appropriate, including any lots that may have a reserve, or if there is a lack of bidding interest or lack of appropriate bids. C.A.E.S. shall always have the right to withdraw any item at any time for any reason and to default any sale in the event of an error or dispute.Terms: Sales are subject to the following terms and conditions of sale: Bidding is available by live in-house bidding, live internet bidding, absentee, and telephone. There is an 18% buyers premium (3% discount for bidders when paying cash or check and bidding live at auction on site), and live internet bidding is available on live platforms with a 23% buyers premium. Fees charged by Live! Platforms are the bidder's responsibility. Payment is due at the end of the auction by cash, certified funds, wire transfer, or approved check. Visa and MasterCard are available for purchases under $1000 and for bidders paying through Live Auctioneers payment service for all purchases. Invoices greater than $1000 require certified funds, check, or wire transfer. Live Auctioneer bidders are invoices through the Live Auctioneer platform and there is a fee for the LA payment system. Bidders paying Chandler's directly by check, wire, or certified funds deduct the LA fee. North Carolina sales tax is applicable. Based on location and type of auction additional taxes may be due or exempt. Online Bids: Live internet bidding is available during the auction. Current bids on the internet will be executed on your behalf during the auction by www.LiveAuctioneers.com. However, C.A.E.S. cannot be held liable for live internet bids that are not sent, received, or executed by the administrator. If you are bidding live, real-time on-line, please bid quickly because there is a time delay in receiving live bids. Multiple on-line platforms are active, so high bid on one site does not guarantee high bid on lot…bids are taken as presented through platforms. To ensure you are the high bidder, bid in person or by phone. Not for Timed Auctions: Absentee and Telephone Bids: Arrangements for absentee and phone bidding can be made by completing and submitting the Absentee Bid Form by 5:00 P.M. the day prior to sale day. This form is available in the gallery as well as via email (info@chandlersauction.com) or on our website (www.chandlersauction.com) Phone reservation contact numbers cannot be changed after 5:00 P.M. the day prior to the sale. Any changes must be made by speaking directly to a representative at the gallery by phone. All bids must be secured with a valid credit card number (Visa/MC). All absentee bids will be executed in a fair, competitive and confidential manner. While
every effort is made to execute and honor absentee and phone bids, C.A.E.S is not responsible for failure to execute a bid and is not liable for any losses incurred as a result of failure to execute absentee bids or failed phone reservations. In the case of identical bids, the first bid received will take precedence. Where appropriate, written bids will be rounded down to the nearest amount consistent with the auctioneers bidding increments. NOTE: It is the bidder’s responsibility to accurately record Lot Number and Bid Amount or Telephone number on any Absentee or On-Line bid form. C.A.E.S. assumes no responsibility or liability in the event a bidder fails to do so. Leaving an absentee or telephone bid indicates the bidder is willing to open the bid at one half the low estimate of the lot. Bids cannot be submitted, altered, or canceled via voicemail. All phone and absentee bids handled by staff in person are executed with a 21% buyer’s premium with discounts of 3% for cash, wire transfer, check, or certified funds payment. Estimated Weights and Measurements: Weights in catalogue description have been estimated through measurement and are to be used as approximate guidelines and not relied on as exact. Unless otherwise stated, all stones have been measured and graded in their settings. Metal weight given for jewelry items with stones is inclusive of stone weight. Buyers are reminded that many colored gemstones have historically been treated to enhance their appearance. Clocks and Watches: No representation or warranty that any clock or watch is in working order is given. There is no guarantee to works or movements. Virtually all clocks and watches have been repaired in the course of their lifetime and may include parts not original to them. Payment: All items purchased in person must be paid for on sale day; phone and absentee winning bids are due within 3 days of auction; Internet winners must pay within 5 days of auction. (Phone/absentee not applicable for timed auctions.) Phone/absentee bidders will have credit card used to secure bid charged if no contact within three days of auction. Charges are the full amount of the invoice with buyer's premium. For items purchased through live online bidding platforms, Chandler's Auctions and Estate Sales will send invoices to all winning bidders via e-mail at the completion of the auction. Bidders are responsible for providing working email address. If paying by check, Chandler's Auctions and Estate Sales reserves the right to hold the item(s) until the check has cleared. Payment can be made by cash, approved certified funds, Visa, and MC. At the auctioneer's discretion, certain lots will be required to be paid for by wire transfer. Winning bidders will be notified of this upon presentation of invoice. Ownership: Ownership of an item is conveyed immediately following the fall of the auctioneer’s hammer. While Chandler's Auctions and Estate Sales try to handle and store all items with great care, C.A.E.S. will have no liability for any loss or damage to an item after the hammer has fallen. Packing and Loading: Packing and loading purchased items is the responsibility of the buyer. Chandler's does not provide boxes, packaging materials, or moving tools of any kind. Any loading assistance provided by any staff of C.A.E.S. is a courtesy, and bidder assumes all responsibility for care of items. Chandler's has no liability for any damage while providing loading assistance and registration for auction signature serves as signed waiver by bidder to release Chandler's from any responsibility should assistance be provided as courtesy. Bidder’s should bring help to load and/or pack auction lots won at auction. Storage: Unless prior arrangements are made, pick-up within set dates is required. Invoices remaining past March 3 @ 3 PM are considered in storage; and items remaining after March 29 are forfeit. Any invoices released after storage date incur storage and handling fees of $10 per lot per day to be paid prior to release of invoice. Bidder is responsible for being aware of terms and conditions when registering to bid as published with the sale for preview. Abandoned Property: Without prior arrangements, any lot(s) remaining after March 29 are considered abandoned and can be resold at auction to off-set the storage fees,
donated, or disposed of as determined necessary by C.A.E.S. Furthermore, C.A.E.S. is not obligated to notify the winning bidder that the abandoned lot(s) will be resold at auction, donated, etc., beyond notices included on invoices and invoice receipts. Packing and Shipping: Chandler's Auctions and Estate Sales does not offer packing and shipping services. Packing and shipping costs and finalization is buyer's responsibility. Buyer’s need to bring loading assistance when picking up furniture and heavy/large items. Legal Fees: Negative feedback and/or publicly posted comments resulting from bidder’s failure to read and/or understand terms & conditions will be handled by legal council with bidder paying all legal fees. Chandler’s is not responsible for bidder’s or shipper’s failure to follow procedures for pick up and collection of items purchased on-line. We make every effort to make public dates and times for pick up prior to auction publication. NCAL# 9849 NCFL#9915
