NobleSpirit Auction Terms & Conditions of Sale
LiveAuctioneers | Effective October 26, 2026

NobleSpirit 234 South Main Street Concord, New Hampshire 03301 Telephone: (603) 568-4369 Email: consignment@noblespirit.com Website: www.noblespirit.com

1. General Conditions of Sale
These Terms and Conditions of Sale ("Terms") govern all purchases made through auctions conducted by NobleSpirit ("NobleSpirit," "we," "us," or "our") on LiveAuctioneers.

By registering, placing a bid, or purchasing an item, each bidder and purchaser ("Buyer") acknowledges that they have read, understood, and agreed to these Terms, in addition to the applicable LiveAuctioneers terms and conditions.

NobleSpirit acts either as the seller or as an agent on behalf of consignors. All transactions are subject to these Terms, applicable law, and any additional notices or conditions expressly stated in an individual auction or lot description.

NobleSpirit reserves the right to amend auction details before bidding begins, withdraw lots, correct cataloging errors, and reject bids or bidder registrations when reasonably necessary to protect the integrity of the auction.

2. Bidder Registration and Responsibilities
All bidders must be at least eighteen (18) years of age and legally capable of entering into binding contracts.

NobleSpirit reserves the right to request identification, proof of funds, references, or other verification before approving bidding privileges, particularly for high-value transactions.

Bidders are responsible for all bids placed through their registered accounts, including bids submitted by authorized representatives.

All bids are binding offers to purchase. A winning bid, once accepted by the auctioneer, creates a binding obligation to purchase.

Requests to withdraw or cancel a bid must be submitted before the applicable lot closes and may be denied. Winning bidders may not cancel purchases because of a change of mind, failure to review the lot description, or misunderstanding of these Terms.

3. Buyer's Premium and Purchase Price
A buyer's premium of 18% of the final hammer price will be added to each successful bid, unless a different premium is expressly published for the applicable auction.

The total purchase price consists of:

The final hammer price;
The applicable buyer's premium;
Any legally required sales or use tax; and
Shipping, insurance, handling, and other disclosed charges, where applicable.
Buyers are responsible for reviewing the applicable buyer's premium and all associated charges before bidding.

4. Payment Terms
Payment in full is due within five (5) calendar days after the invoice is issued, unless otherwise agreed in writing.

Accepted payment methods may include credit or debit cards, bank wire transfers, ACH payments, or other methods approved by NobleSpirit and supported by the applicable payment processor.

NobleSpirit reserves the right to require a bank wire transfer or another verified payment method for high-value purchases, international transactions, or transactions presenting elevated fraud risk.

All payments must be made in United States dollars (USD).

Where LiveAuctioneers payment services are used, payment processing is also subject to the applicable LiveAuctioneers payment terms.

NobleSpirit may withhold shipment or release of merchandise until payment has been received, verified, and cleared. No Buyer is entitled to possession of purchased merchandise until all payment obligations have been satisfied.

5. Failure to Pay
Failure to remit payment within the required period constitutes a breach of the purchase agreement.

In the event of nonpayment, NobleSpirit reserves the right, subject to applicable law, to:

Cancel the transaction;
Suspend or revoke future bidding privileges;
Report the nonpayment to LiveAuctioneers;
Offer the merchandise to another bidder or resell it; and
Seek recovery of reasonably incurred losses, resale deficiencies, and associated collection expenses to the extent permitted by law.
Cancellation of a transaction for nonpayment does not automatically release the defaulting Buyer from liabilities arising from a breach of these Terms.

NobleSpirit reserves all other remedies available under applicable law.

6. Catalog Descriptions and Condition
NobleSpirit endeavors to provide accurate and informative descriptions of all property offered for sale.

Catalog descriptions, photographs, measurements, provenance information, condition reports, and other representations are prepared in good faith using information reasonably available to NobleSpirit.

However, except for express written guarantees, descriptions and condition assessments are statements of opinion, not warranties of every characteristic of an item.

All property is offered in its existing condition, "AS IS, WHERE IS," subject to the express authenticity provisions of these Terms and any warranties that cannot lawfully be excluded.

Buyers are responsible for reviewing all available photographs, descriptions, and supplemental information before bidding.

Condition reports may not identify every defect, restoration, alteration, repair, or sign of wear. The absence of a reference to a particular condition issue does not mean that the issue does not exist.

Vintage Technology, Electronics, and Mechanical Items: Unless a lot description expressly states that an item has been tested and is functional, vintage computers, video game hardware and software, electronics, and other mechanical items are sold untested, and no representation is made as to working condition, completeness, or compatibility.

NobleSpirit encourages prospective Buyers to request additional photographs, clarification, or condition information before placing bids.

7. Authenticity and Attribution
NobleSpirit is committed to accurately representing the collectibles it offers for sale.

Except as expressly stated in an individual lot description, authenticity determinations and attributions are based on NobleSpirit's good-faith professional assessment and the information available to it.

Philatelic Material: NobleSpirit stands behind the authenticity of stamps and covers expressly represented as genuine, subject to the certification procedures and limitations described below.

Buyers who intend to obtain a certificate of authenticity or expert opinion from a recognized philatelic expertizing organization must notify NobleSpirit in writing at the time of purchase.

Upon accepting such a request, NobleSpirit and the Buyer will agree in writing on the expertizing organization, the submission requirements, and the deadline for obtaining a determination (the "Certification Period").

If the agreed-upon expertizing organization determines within the Certification Period that an eligible item is not genuine, NobleSpirit will review the written findings and, upon verification and return of the item in its original condition, provide an appropriate remedy, including rescission and refund where warranted.

Coins, Paper Money, Sports and Trading Cards, Comics, and Other Certified Collectibles: Items encapsulated or certified by recognized third-party grading services are sold with reference to the grades, designations, and opinions assigned by those services. Such grades and designations are third-party opinions and are not independently guaranteed by NobleSpirit unless expressly stated.

Differences in grading opinion, subsequent changes in grading standards, or unsuccessful attempts to obtain a higher grade do not, by themselves, establish grounds for a return.

Autographs and Signed Material: Where a lot is accompanied by a certificate or letter of authenticity from a third-party authentication service, that certificate represents the opinion of the issuing service. Unless expressly stated in the lot description, NobleSpirit does not independently guarantee the authenticity of signatures beyond the representations made in the listing.

Other Categories: Allegations of material misattribution or inauthenticity concerning any other category of collectible will be evaluated using credible, independently verifiable evidence and the specific representations made in the applicable listing.

Nothing in this section limits any express warranty, statutory right, or remedy that cannot lawfully be excluded.

8. Returns, Refunds, and Claims
Except as expressly provided in these Terms, agreed in writing, or required by applicable law, all auction sales are final.

Returns are not accepted for buyer's remorse, market fluctuations, speculative purchases, or subjective differences of opinion concerning grading, appearance, or desirability.

Buyers must notify NobleSpirit in writing within seven (7) calendar days of confirmed delivery of any alleged material discrepancy, shipping damage, or other issue concerning the merchandise, except where a longer period applies under a Certification Period or applicable law.

All returns must be authorized by NobleSpirit before the merchandise is shipped back.

Returned merchandise must be in substantially the same condition as delivered, including original certification holders, accompanying documentation, and original components.

Items may not be altered, repaired, cleaned, removed from third-party grading holders, or otherwise materially modified before a claim is resolved without NobleSpirit's written authorization.

Approved refunds will be issued to the original payment method where practicable and will include any amounts required by applicable law or by the terms of an express guarantee.

Nothing in these Terms excludes liability for fraud, intentional misrepresentation, or any other liability that cannot lawfully be disclaimed.

9. Shipping, Handling, and Insurance
NobleSpirit ships eligible merchandise, subject to the nature, size, value, and destination of each purchase and applicable legal requirements.

Unless expressly stated otherwise, shipping, handling, and insurance charges are the responsibility of the Buyer and are in addition to the hammer price and buyer's premium.

Shipping methods and carriers are selected based on the characteristics and value of the merchandise, applicable carrier restrictions, and other reasonable considerations. Items containing batteries or other regulated materials may be subject to additional carrier restrictions.

NobleSpirit may require signature confirmation, additional identification, insured shipping, or other security measures for high-value purchases.

Merchandise will ordinarily be shipped only after all required payments have cleared.

Buyers must promptly report apparent shipping damage, shortages, or delivery irregularities and must keep all shipping materials and packaging until the matter is resolved.

Responsibility for loss or damage in transit will be determined under applicable law and the terms of any applicable shipping or insurance agreement.

NobleSpirit may require additional time to arrange safe transportation for unusually valuable, fragile, oversized, or specialized merchandise.

10. International Purchases
International Buyers are responsible for determining whether merchandise may legally be imported into their destination country.

Any customs duties, import taxes, brokerage fees, clearance charges, or other governmental assessments are the Buyer's responsibility.

NobleSpirit will not misrepresent merchandise descriptions or declared values on customs documents.

Certain property, including ancient artifacts and other cultural property, historical documents, precious metals, jewelry, and other regulated collectibles, may be subject to export or import restrictions.

NobleSpirit reserves the right to decline shipment to destinations where delivery would violate applicable law, carrier restrictions, or reasonable security requirements.

International Buyers are encouraged to contact NobleSpirit before bidding to confirm shipping availability.

11. Sales Tax
Applicable sales or use taxes will be collected where required by law.

Buyers claiming tax-exempt status must provide valid documentation, in a form acceptable to NobleSpirit or the applicable payment platform, before invoicing where required.

NobleSpirit is not responsible for taxes, duties, or assessments independently owed by Buyers in their own jurisdictions.

12. Reserves, Estimates, and Bidding Disputes
Certain lots may be subject to confidential reserve prices or published minimum bids.

Pre-sale estimates are expressions of professional opinion and do not guarantee future selling prices, investment performance, or market value.

NobleSpirit reserves the right, consistent with applicable law and disclosed auction procedures, to reject bids, resolve bidding disputes, reopen bidding where appropriate, or withdraw lots before a sale is completed.

In the event of a bidding dispute, the auctioneer's determination controls the administration of the auction, subject to applicable law and platform requirements.

NobleSpirit prohibits fraudulent bidding, bid manipulation, and any undisclosed conduct intended to artificially influence auction results.

13. Errors and Omissions
NobleSpirit reserves the right to correct typographical, photographic, descriptive, or administrative errors identified before a sale is completed.

If a material cataloging error, title defect, or other substantial irregularity is discovered after the sale, NobleSpirit may seek a mutually acceptable resolution, including rescission of the transaction where legally appropriate.

Neither an inadvertent cataloging mistake nor a technological interruption automatically creates a right to purchase merchandise at an erroneous price.

14. Technology and Platform Interruptions
NobleSpirit uses LiveAuctioneers and other technologies to facilitate remote participation.

Internet connectivity, transmission delays, software interruptions, and other technical issues may affect the bidding process.

NobleSpirit does not guarantee continuous or uninterrupted access to online bidding services.

To the extent permitted by law, NobleSpirit is not responsible for bids that are not received, transmitted, or processed because of technical difficulties outside its reasonable control.

Bidders are encouraged to place absentee bids well before an auction's closing time.

15. Title and Transfer of Property
Title to purchased merchandise passes in accordance with applicable law and these Terms, subject to receipt of the required payment and any valid security interest or other lawful restriction.

NobleSpirit is not obligated to release merchandise before funds have cleared.

The Buyer is responsible for providing accurate billing, shipping, and contact information.

16. Limitation of Liability
To the maximum extent permitted by applicable law, NobleSpirit's liability for any claim arising from the sale of an individual lot will not exceed the amount actually paid to NobleSpirit for that lot, except where a greater remedy is required by law.

NobleSpirit is not liable for speculative investment losses, changes in market value, lost profits, or indirect or consequential damages, except to the extent such liability cannot lawfully be excluded.

These limitations do not apply to fraud, intentional misconduct, or other liabilities that cannot legally be limited.

17. Governing Law and Dispute Resolution
These Terms and the transactions governed by them will be interpreted in accordance with the laws of the State of New Hampshire, without regard to conflict-of-law principles, except where other mandatory laws apply.

Buyers agree to make a good-faith effort to resolve any disagreement directly with NobleSpirit before initiating formal proceedings.

Subject to applicable laws concerning jurisdiction and venue, disputes arising under these Terms will be brought before a court of competent jurisdiction in New Hampshire.

Nothing in this section deprives a Buyer of rights or protections that cannot legally be waived.

18. Severability and Entire Agreement
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

These Terms, together with any auction-specific notices, lot-specific written conditions, and incorporated LiveAuctioneers requirements, constitute the entire agreement governing auction purchases from NobleSpirit.

Any modification or exception must be confirmed in writing by an authorized representative of NobleSpirit.

No failure by NobleSpirit to enforce any provision constitutes a waiver of that provision or of any other right.

19. Contact and Customer Service
NobleSpirit strives to conduct its auctions professionally, transparently, and fairly.

We welcome questions about descriptions, authenticity, bidding procedures, invoices, payment arrangements, and shipping. Prospective Buyers are strongly encouraged to contact us before bidding if any aspect of a lot or of these Terms requires clarification.

Few individuals can claim a place in video game history quite like Roger Hector. A pioneering designer, artist, producer, and creative executive, Hector began his career at Atari in 1976, when the conventions of video game design were still being invented.
