About our sales. BILLY THE KID AUCTION HOUSE LLC, a New Mexico limited liability company, trading as Billy the Kid Auctions and Billy The Kid Online Auctions, operates billythekidauctions.com. We are an online-only auction house in Gallup, New Mexico. We do not hold floor auctions and do not offer local pickup or in-person preview. Every lot is sold through our website and the online platforms we list with.
Buyer's premium. A buyer's premium is added to the final bid price of every lot. The rate that applies to a sale is shown in that sale's listing. Fees charged by the bidding platform, if any, appear on your invoice.
Taxes. Applicable taxes are calculated based on the buyer?s location and added automatically to the platform invoice. They are collected through the same payment process as the rest of the invoice total and remitted by the bidding platform as required by applicable law. If you hold a valid resale or exemption certificate, contact us before the sale closes.
Condition and description. All property is sold AS IS, WHERE IS, and all sales are final except as set out in the paragraph below. We describe each lot as accurately as we can, but we make no warranty, express or implied, as to age, condition, size, quality, rarity, importance, provenance or value. Bidders are responsible for judging condition before bidding, and photographs and condition reports are provided as a courtesy rather than a warranty. No statement by BILLY THE KID AUCTION HOUSE LLC or any of its representatives, spoken or written, creates a warranty.
Material Discrepancies. There is one exception to the rule above. If, after delivery, you believe a lot is not by the artist identified in the catalogue, is not made of the materials described, or has an undisclosed crack or break in the silver or a missing component, notify us within 7 days of the delivery date shown by the carrier and provide photographs of the piece and any marks on it. We will review the information provided.
If our review confirms a material discrepancy of the kind described above, we will cancel the sale, refund the hammer price, buyer?s premium, and shipping you paid, and cover the cost of returning the lot to us. The lot must be returned in the condition in which it was sent. This is the sole remedy available for such a discrepancy and does not apply to a change of mind, a lot that materially matches its description, or wear consistent with age that was visible in the photographs.
Cracks in stones, previous repairs, restringing, and replaced stones are common in old pawn and vintage work and are not treated as undisclosed damage. A cracked stone is often original to the piece, and replacing it can diminish both value and rarity, so we generally leave it as the maker and its wearers left it.
Native American jewelry and artist attribution. We take the attribution of Native American jewelry seriously and use a multi-layer review process for secondary-market pieces. Our inventory is sourced through: (1) Native American artists directly, (2) established relationships with experienced local dealers, and (3) trusted sources who examine and test pieces before they reach us. Each piece is then separately reviewed in-house by experts before being offered for sale.
Depending on the piece, our review may include source and provenance information; hallmarks or signatures; testing and examination of silver, stones, and other materials; fabrication, construction, and workmanship; characteristics associated with particular artists, makers, tribes, or styles; comparison with known work; and indicators of imported, mass-produced, or otherwise misattributed merchandise. Our determinations also draw on years of specialized experience in the Native American jewelry trade, including direct experience with Native artists and jewelry manufacturing.
We evaluate the available evidence as a whole and attribute a piece only to the level we believe the evidence supports. Our attributions reflect our good-faith professional judgment based on the information available to us at the time of sale. If credible information later calls an attribution into question, we will review the matter and, if warranted, correct our records and provide the remedy available under these Terms.
Bidding. We may refuse any bid and reject an opening bid we consider too low. The highest bid we accept when a lot closes wins that lot. Where bids tie or a bid's validity is in doubt, we decide the winner or re-offer the lot, and our decision is final. We are not responsible for bids that fail to reach us because of an internet, platform or device problem.
Title and risk. Title passes to the winning bidder when the lot closes. From that point the buyer is responsible for the full purchase price, premium, tax and shipping. Risk of loss in transit is ours until the lot is delivered to the address you give us: on domestic shipments we insure the parcel and we file any claim. International shipments are the exception. They are not insured, and risk passes to the buyer once the parcel leaves the United States.
Governing law and venue. These terms and any dispute arising out of or relating to a sale are governed by the laws of the State of New Mexico. Any legal action arising out of or relating to a sale must be brought in a court of competent jurisdiction in New Mexico, and each party consents to the jurisdiction of those courts.
Changes. These terms were last updated October 5, 2026. The terms in effect when a sale closes are the ones that apply to that sale.
