# Kahu Paws Trading

## Online Auction Terms & Conditions

Welcome to Kahu Paws Trading. By registering for and participating in our online auctions, you agree to the following Terms and Conditions. Please read them carefully before placing any bids.

### 1. Registration & Eligibility

All bidders must register prior to participating in any auction. By registering, you represent and warrant that:

* You are at least 18 years of age.
* All information provided during registration is accurate, current, and complete.
* You have the legal authority to enter into a binding agreement.
* You agree to comply with all auction Terms and Conditions.

Kahu Paws Trading reserves the right to approve, deny, suspend, or revoke bidder registration at its sole discretion.

### 2. Bidding Agreement

All bids placed through the auction platform constitute a legally binding commitment to purchase the item if you are the successful bidder.

* No bid retractions or cancellations are permitted.
* All bids are time-stamped and recorded by the auction platform.
* The highest accepted bid at the close of the auction will be deemed the winning bid.
* In the event of any dispute regarding bidding activity, Kahu Paws Trading and the auction platform's records shall be considered final and binding.

### 3. Bid Increments & Automatic Bidding

Bids must follow the posted bid increments established for each auction.

The platform may offer maximum (proxy) bidding services. By utilizing proxy bidding, bidders authorize the system to place bids automatically on their behalf up to their specified maximum amount.

### 4. Auction Closing & Timing

All auctions close according to the official clock of the auction platform.

Bidders are solely responsible for monitoring auction closing times. Device clocks and internet delays may vary and are not the responsibility of Kahu Paws Trading.

**Soft Close Rule:** Auction extensions and soft-close procedures are governed by the auction platform. By participating, bidders agree to abide by all timing extensions and platform rules in effect during the auction.

### 5. Buyer's Premium & Taxes

A buyer's premium may be added to the final hammer price as stated in the auction catalog.

Applicable sales tax will be assessed in accordance with federal, state, and local laws unless a valid resale certificate or tax exemption documentation is provided and approved prior to invoicing.

### 6. Item Condition & Descriptions

All items are offered and sold **AS IS, WHERE IS**, with no warranties or guarantees, express or implied.

While Kahu Paws Trading endeavors to provide accurate descriptions, photographs, provenance information, and condition reports:

* Statements regarding age, origin, authenticity, maker, materials, dimensions, and condition represent opinions only.
* Catalog descriptions are provided as a courtesy and should not be considered warranties or guarantees.
* Color variations may occur due to photographic lighting and screen settings.
* Absence of a condition statement does not imply that an item is free from wear, damage, repairs, restoration, or imperfections.

Prospective bidders are encouraged to examine all available photographs and request additional information prior to bidding.

### 7. Authenticity & Attribution

Any attribution regarding artist, maker, culture, tribe, period, origin, or material represents the opinion of Kahu Paws Trading based on available information at the time of cataloging.

Unless specifically stated in writing, no guarantee of authenticity is expressed or implied.

### 8. Returns & Refunds

All sales are final.

No returns, exchanges, cancellations, or refunds will be accepted except in cases where Kahu Paws Trading determines that an item has been materially misrepresented.

Any claim of material misrepresentation must be submitted in writing within seven (7) days of receipt of the item and must include supporting documentation.

Kahu Paws Trading reserves sole discretion in determining the validity of any claim.

### 9. Buyer Responsibility

By placing a bid, the bidder acknowledges that they have reviewed all available descriptions, photographs, and terms related to the offered lot.

Failure to read descriptions, review photographs, request additional information, or understand auction terms does not relieve a bidder of responsibility for purchases made.

### 10. Platform Use & Bidding Conduct

To maintain a fair and transparent auction environment:

* Shill bidding, bid manipulation, fraud, or collusion is strictly prohibited.
* Any attempt to interfere with or manipulate the auction process is prohibited.
* Harassment, abuse, or inappropriate conduct toward staff, consignors, or other bidders will not be tolerated.

Violations may result in suspension, account termination, cancellation of bids, or permanent exclusion from future auctions.

### 11. Technical Issues

Kahu Paws Trading shall not be responsible for:

* Internet outages or connectivity issues.
* Platform delays, interruptions, or software malfunctions.
* Missed bids due to technical failures or user error.
* Communication failures between bidders and the auction platform.

In the event of a system malfunction, discrepancy, or technical issue, Kahu Paws Trading reserves the right to withdraw, postpone, reopen, extend, or cancel any lot or auction at its sole discretion.

The auction platform's records shall be deemed final.

### 12. Limitation of Liability

Kahu Paws Trading, its owners, employees, agents, consignors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from participation in any auction or the purchase, ownership, transportation, or use of any item.

The maximum liability of Kahu Paws Trading shall not exceed the purchase price actually paid for the item in dispute.

### 13. Right to Refuse Service

Kahu Paws Trading reserves the right to:

* Refuse service to any individual or entity.
* Reject or revoke bidding privileges.
* Withdraw lots from sale.
* Cancel or void transactions when deemed necessary.
* Amend auction procedures as circumstances require.

Such actions may be taken at Kahu Paws Trading's sole discretion.

### 14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State in which Kahu Paws Trading conducts business, without regard to conflict-of-law principles.

Any dispute arising from participation in an auction shall be resolved in the appropriate courts having jurisdiction in that state.

### 15. Agreement to Terms

By registering, bidding, participating in, or purchasing from a Kahu Paws Trading auction, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in their entirety.

Participation in any auction constitutes acceptance of these Terms and Conditions.
