AUCTION TERMS: World Traveler Auction

Registration, bidding, and the property offered

1. Acceptance of terms
By registering for, placing a bid in, or purchasing from this auction, each bidder agrees to these Terms and Conditions, the applicable lot description, and the LiveAuctioneers terms governing use of its platform. If these terms conflict with a specific written statement in a lot description, the lot-specific statement controls for that lot.

2. Eligibility and bidder information
Bidders must provide accurate registration and payment information and must be legally able to enter a binding contract. Chris and Val's Estate Sales (the “Auction House??) may approve, decline, suspend, or revoke bidding privileges when reasonably necessary to protect the auction, consignors, or other bidders.

3. Bids are binding
Every accepted bid is an irrevocable offer to purchase the lot. The highest accepted bid at closing is the hammer price, subject to any reserve and the Auction House's confirmation. A winning bidder may not cancel a purchase because of a change of mind, failure to inspect, shipping cost, or inability to collect the item.

4. Auction administration
The Auction House may reject a bid, determine the successful bidder, resolve a bidding dispute, reopen bidding when appropriate, combine or divide lots, withdraw a lot, correct a catalog error, or cancel a sale before release of the property. The Auction House's reasonable determination is final to the extent permitted by law.

5. Catalog descriptions and condition
Descriptions, photographs, measurements, dates, maker attributions, materials, provenance, and condition statements are opinions offered for identification and convenience. They are not guarantees. Photographs may not show every mark, repair, loss, variation, or defect. Bidders should ask questions and request additional photographs before bidding.

6. As-is, where-is sale
All lots are sold “AS IS, WHERE IS," with all faults and without warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, condition, authenticity, age, authorship, or value, except where a warranty cannot lawfully be excluded. The buyer is responsible for evaluating a lot before bidding.


Price, payment, and collection

7. Estimates and reserves Presale estimates are opinions only and are not promises of market value or selling price. A lot may be offered subject to a confidential reserve. The Auction House may execute bids on behalf of a consignor up to, but not above, the reserve where permitted.

8. Buyer's premium, taxes, and charges

A buyer's premium of 18% will be added to the hammer price of each lot. The buyer must also pay applicable sales or use tax, shipping, packing, handling, insurance, storage, platform charges, and any other disclosed fee. A valid resale certificate must be submitted and accepted before tax may be removed.


9. Payment
Payment in U.S. dollars is due within 10 calendar days after the auction. Accepted payment methods: Visa/Master Card, Discover, American Express. The Auction House may require cleared funds before releasing property and may decline a payment method where permitted by law or platform policy.

10. Nonpayment and other default
If a buyer fails to pay or otherwise breaches these terms, the Auction House may, to the extent permitted by law and platform rules, cancel the sale, retain or recover amounts due, resell the lot publicly or privately, suspend bidding privileges, and recover reasonable costs caused by the default. The buyer remains responsible for any deficiency and recoverable expenses, less any amount recovered on resale.


11. Pickup and removal
Pickup is by appointment at the location provided to winning bidders. All purchases must be removed within 5 calendar days after the auction unless the Auction House agrees otherwise in
writing. Buyers must bring suitable labor, tools, vehicles, and packing materials. The Auction House is not required to disassemble, pack, load, or transport purchases.


12. Shipping
Unless a lot listing expressly states that in-house shipping is available, shipping is the buyer's responsibility and expense. Any shipper is an independent contractor selected by the buyer. The Auction House is not responsible for a carrier's acts, omissions, delays, loss, or damage. International buyers are responsible for customs, duties, taxes, permits, and import restrictions.


Release of property and online bidding

13. Title, risk, storage, and abandoned property
Title and risk of loss pass to the buyer only after payment has cleared and the lot is released to the buyer or the buyer's carrier. Property not collected after reasonable written notice may be moved, resold, donated, or otherwise disposed of as permitted by law, with related costs charged to the buyer.

14. Online bidding and technical issues
Online bidding is provided through LiveAuctioneers. Internet, device, software, or platform failures may delay or prevent a bid. The Auction House does not guarantee uninterrupted access or receipt of every bid and is not liable for a missed bid caused by a technical failure beyond its reasonable control. Bidders should place bids early enough to account for possible delays.

15. Limited remedy
If the Auction House materially misdescribes a lot and a remedy is required by law, the buyer must notify the Auction House promptly, preserve the lot in the condition received, and provide reasonable supporting information. Unless applicable law requires otherwise, the buyer's exclusive remedy is cancellation of the sale and refund of amounts paid to the Auction House for that lot after its return. Shipping, repair, lost profit, and consequential damages are not recoverable from the Auction House.

16. Safety and regulated items
The buyer is responsible for safe handling, installation, use, and legal compliance after release. Electrical, mechanical, lighting, furniture, and similar items may not have been tested and should be inspected by a qualified professional before use. The buyer must satisfy all age, licensing, export, import, and other legal requirements for any regulated lot.


Liability and legal terms

17. Liability
To the fullest extent permitted by law, the Auction House and consignor are not liable for indirect, incidental, special, exemplary, or consequential damages arising from the auction or a lot. Any direct liability of the Auction House concerning a purchased lot will not exceed the amount the buyer paid to the Auction House for that lot.

18. Governing law and venue
These terms and any dispute concerning the auction are governed by Nevada law, without regard to conflict-of-law principles. Any court proceeding must be brought in a state or federal court with jurisdiction in Clark County, Nevada, unless applicable law requires another forum.

19. General provisions
If any part of these terms is unenforceable, the remaining provisions remain effective. A delay in enforcing a right is not a waiver. These terms, the lot description, the invoice, and applicable LiveAuctioneers terms form the entire agreement concerning a purchase. Changes must be made in writing by the Auction House.
