Palmer?s Auction Co. LLC ? Auction Terms and Conditions
Acceptance of Terms:
By registering for or bidding in a Palmer?s Auction Co. LLC (?PAC?) auction, bidders acknowledge that they have reviewed and agree to these terms and the applicable lot descriptions. Please ask questions and request any necessary information before bidding.
New Payment Policy ? Effective 10/20/26:
For auctions held on or after 10/20/26, each invoice must be paid in full within 10 calendar days after its original issue date. This requirement applies separately to the initial purchase invoice and any subsequently issued shipping invoice. An invoice reminder does not restart the payment period.
In-House Packing and Shipping:
PAC offers in-house packing and shipping for lots identified as eligible for shipping. We use UPS and USPS. Shipping is not free and is charged separately from the purchase price unless expressly included on the invoice.
Bidders must confirm shipping availability before bidding on furniture, oversized, unusually fragile, or restricted items. Pickup-only lots will be identified in their listings. Do not assume an item qualifies for in-house shipping solely because other items in the auction do.
If you are not local, PAC will assume shipping is needed unless you contact us to arrange pickup. Selecting a shipping option does not override a lot?s pickup-only designation.
Shipping Charges and Handling Fee:
Bidders are responsible for the applicable shipping-label cost plus PAC?s $15 supply and handling fee. The shipping-label charge appears as the ?SHIPPING? line on the invoice.
One $15 supply and handling fee applies per bidder, per auction, for items packed and shipped together. This fee is not charged per item. Any additional charges for buyer-requested separate shipments or special packing must be disclosed to and approved by the bidder before those services are provided.
PAC does not offer free shipping. If a listing or checkout display shows free shipping or conflicts with these terms, contact PAC before bidding or completing shipping arrangements so the discrepancy can be clarified.
Packing Timeline:
Please allow 7?14 business days after payment of the initial purchase invoice for packing and preparation of the shipping invoice. This period does not include carrier transit time.
Items will not be shipped until all applicable purchase, tax, shipping, and handling charges have been paid in full.
Shipping Selection and Separate Invoices:
If you select ?Manage My Own Shipping? and request PAC?s in-house shipping service, PAC will pack your eligible items and arrange shipment.
For PAC-arranged shipping, bidders will generally receive:
An initial invoice for the purchased items, buyer?s premium, and applicable taxes.
A separate or revised invoice adding shipping and handling after packing is complete.
The initial purchase charges are due within 10 calendar days after the initial invoice date. Newly added shipping and handling charges are due within 10 calendar days after the date they are first invoiced. Adding shipping charges to a revised invoice does not extend the original payment deadline for the purchased items.
If you purchase shipping through a LiveAuctioneers shipping service, the applicable shipping-service terms and charges also apply. PAC?s $15 supply and handling fee remains payable and will be identified on the applicable invoice.
Third-Party Couriers and Pickup Services:
PAC does not maintain public business hours. Bidders may not send a courier, freight company, or other third party to collect items without PAC?s prior written approval and a scheduled appointment.
Selecting ?Manage My Own Shipping? does not, by itself, authorize third-party collection. Confirm any proposed third-party pickup arrangement with PAC before bidding.
Shipping Address:
Bidders are responsible for ensuring that their shipping address is correct in LiveAuctioneers before shipment is arranged.
If an address is incorrect, the bidder must update it through LiveAuctioneers in accordance with its procedures and notify PAC promptly. PAC cannot update a bidder?s LiveAuctioneers account address on the bidder?s behalf.
Any additional shipping costs caused by an incorrect address, requested address change, or returned shipment must be resolved before reshipment.
Buyer?s Premium and Card Fees:
A 20% buyer?s premium will be added to the successful hammer price of each item.
PAC does not add a credit-card processing surcharge. PAC absorbs its card-processing fees. Any separate fee charged directly by a platform or third-party service is governed by that provider?s terms.
Sales Tax:
Applicable sales tax will be included on the invoice. Bidders claiming a tax exemption must submit the required documentation through the applicable LiveAuctioneers process before payment and allow time for review. A request for a tax adjustment does not automatically extend a payment deadline; contact PAC promptly if an invoice requires correction.
Automatic Payments:
PAC uses LiveAuctioneers Standard Autopay. Outstanding bidder payments are scheduled for automatic charging after 72 hours of invoicing, subject to the platform?s payment procedures.
Bidders are responsible for ensuring payment is successfully processed. A declined card, failed automatic payment, or unsuccessful payment attempt does not extend the invoice deadline.
Payment Deadline:
All invoiced charges must be paid in full by 11:59 p.m. Eastern Time on the 10th calendar day after the applicable invoice?s original issue date.
Payment in full includes all applicable item charges, buyer?s premium, taxes, shipping, and handling. Each separately issued shipping invoice has its own 10-calendar-day payment period.
No items will be released for pickup or shipment until all applicable charges have been paid in full. PAC does not grant payment-deadline extensions.
Nonpayment, Default, and Cancellation:
If any invoice remains unpaid or only partially paid after its payment deadline, the bidder will be in default. PAC may withhold release of the items, cancel the transaction, and pursue available remedies, including resale, subject to applicable law and any required notice.
Amounts already paid may be applied toward reasonable costs and recoverable damages arising from the buyer?s default, to the extent permitted by applicable law. Any remaining balance will be handled as required by law.
An unpaid shipping invoice is subject to this policy even if the initial purchase invoice has been paid. Payment of the purchase price alone does not entitle the bidder to shipment without payment of applicable shipping and handling charges.
Future Bidding Restrictions and Nonpayment Disputes:
Bidders who fail to complete payment will be blocked from bidding in future PAC auctions.
PAC will submit a nonpayment dispute through LiveAuctioneers in accordance with the platform?s procedures. Any additional restrictions or actions affecting the bidder?s LiveAuctioneers account are determined by LiveAuctioneers.
Local Pickup:
Local pickup is listed in each auctions details. PAC does not maintain public business hours.
Fully paid items designated for local pickup must be collected within 10 calendar days after the auction ends unless PAC approves a different pickup date in writing before the deadline.
An approved pickup extension does not extend any invoice payment deadline.
Uncollected Items:
If fully paid items are not collected by the pickup deadline and no alternate arrangement has been approved in writing, PAC may issue a final written notice to the contact information provided by the bidder.
The notice will identify the items, state the final collection deadline, and explain PAC?s intended next steps. If the bidder does not respond or collect the items by that deadline, PAC may pursue available remedies, including resale or other disposition, subject to applicable law and any required procedures.
Payments and any resale proceeds will be accounted for as required by law. Reasonable costs and recoverable damages may be deducted only to the extent permitted by law.
Bidders who fail to collect their purchases may be blocked from future PAC auctions.
Item Condition and Final Sales:
All items are sold AS IS, WHERE IS. All sales are final except where otherwise required by applicable law.
Items may show wear, repairs, alterations, missing components, or other signs of age and use. Review all photographs and descriptions carefully and request additional information before bidding.
The absence of a condition statement does not mean an item is free of defects. Unless expressly stated in the lot description, items have not been tested for operation.
Descriptions, photographs, and any condition reports should be considered together. If information appears inconsistent or unclear, contact PAC before bidding.
Authenticity, Attribution, and Provenance:
Review the specific wording of each lot description concerning maker, artist, signature, age, origin, authenticity, and provenance. Do not assume that every lot includes authentication, a certificate, or documented ownership history.
Any certificates, supporting documents, or express guarantees included with a lot will be identified in its description. Request clarification before bidding if an attribution or authenticity statement is important to your purchasing decision.
Shipping Damage and Delivery Problems:
Inspect shipments promptly upon delivery. Report damage, missing contents, or other delivery problems to PAC immediately.
Retain the purchased item, shipping carton, shipping label, and all packing materials. Provide photographs of:
The damaged item or affected contents.
The exterior shipping carton.
The shipping label.
The interior packaging and packing materials.
Do not discard packaging or return an item until you receive instructions from PAC or the applicable shipping-service provider.
Carrier, insurer, and shipping-service reporting deadlines apply. Bidders using a LiveAuctioneers shipping service must also follow that service?s claim procedures and deadlines. Reporting a problem does not guarantee claim approval or reimbursement.
Questions and Communications:
Please contact PAC through the contact information provided in the auction listing or invoice. Include your name, auction date, invoice number, and relevant lot numbers so we can assist you efficiently.
Requests for pickup changes, shipping changes, or other arrangements must be approved by PAC in writing. Sending a request does not constitute approval or extend a deadline.
Thank you for bidding with Palmer?s Auction Co. LLC. We appreciate your business!
