Terms & Conditions of Sale for P.K. GALLERY

PLEASE READ THESE CONDITIONS OF SALE AND THE SALE PARTICULARS

CAREFULLY BEFORE PLACING ANY BID ON A LOT. BY REGISTERING TO BID

AND/OR BY BIDDING AT AUCTION YOU AGREE TO THESE TERMS AND

CONDITIONS AND THEY WILL BECOME CONTRACTUALLY BINDING ON YOU.

A. PRE-SALE

A1. Description of Lots

Our description of any lot, any condition report and any other statements made by us

(whether in writing and or orally) about any lot, including about its nature, artist, period,

condition, materials, approximate dimensions & weight and or provenance are our

opinion and not to be relied upon as a statement of fact.

We do not carry out in-depth research of the sort carried out by professional scientists,

historians and or scholars.

All dimensions and weights are approximate only.

A1.1S - All Jewelry related Dimensions including Stone Carat weight, size and weight are all approximate. All Descriptions are subject to change and edits by P.K. GALLERY Prior to Live Bidding to ultimately further accommodate bidders.

A1.2S - All Instrument Related Dimensions, condition and Descriptions (Such as makers/labels/stamps, age and or materials are not to be taken as statements of facts unless paperwork and or certificates from leading experts are specifically cited / photographed and or mentioned in the listing.

** All instruments are sold without guarantees unless otherwise specifically stated. **

A1.3S - Fashion & Costume JewelryLots containing Fashion & Costume Jewelry will be sold "as is" meaning the lots will ultimately be sold with existing faults and imperfections. Given the fragile nature of Fashion & Costume Jewelry and their mountings, all sales will be final with no exceptions.

Fashion & Costume Jewelry lots may be offered with a general estimate price range allowing for speculative bidding at buyer's discretion.

All lot specifications such as Titles and description containing material(s), maker(s), age, dimensions and weight are all approximate and of our opinion. All Descriptions are subject to change and edits by P.K. GALLERY Prior to Live Bidding to ultimately further accommodate bidders.

A1.4S - Restricted Species & Lots made of protected species.

Lots made of or including (regardless of the percentage) endangered and other protected species of wildlife are indicated in the description under additional catalogue notes in the Sale Particulars. These material include, and not limited to, ivory, tortoiseshell, crocodile skin, rhinoceros horn, whalebone, certain species of coral, as well as some hardwoods. Several countries refuse to allow you to import property containing these materials, and some other countries require a license from the relevant regulatory agencies in the countries of exportation as well as importation. As a result you should check the relevant customs laws and regulations before bidding on any lot containing wildlife material if you plan to import the lot into another country.

Furthermore, lots containing and or made of the above cited materials may require a license or certificate prior to exportation from the United States or an individual state and additional certificates or licenses for importation into another state or country. Some materials may not be exported, imported into other states or countries or resold. It is the purchaser's sole responsibility to be aware of all and any applicable laws & regulations as well as to obtain any required export or import licenses or certificates and any other required documentation.

In accordance with international wildlife trade regulations, certain bows and instruments in this sale may incorporate small amounts of protected materials such as ivory, tortoiseshell, or whalebone.

These materials were commonly used in the manufacture of historical musical instruments and bows prior to modern conservation regulations and are present only as minor, integral components (commonly referred to as de minimis).

Based on stylistic features, construction methods, and known provenance, these items are believed to pre-date applicable restrictions and qualify as antiques or as musical instruments containing legally permissible de minimis quantities of protected material.

Prospective purchasers should note:

Export, import, and interstate transport may be subject to permits and regulatory approval.
Requirements vary by country and jurisdiction.
The responsibility for obtaining any necessary permits rests solely with the purchaser.
P.K. Gallery will provide reasonable assistance in supplying documentation; however, compliance with all applicable laws remains the responsibility of the buyer.

The purchaser shall be responsible for on-time payment of the full purchase price of the lot, even if the obtaining of any such license is denied or delayed.P.K. GALLERY assumes no liability for failing to identify materials from endangered or protected species or for incorrectly identifying such materials.** All Clients must arrange for an in-person and or third-party agent collection of such lots. **

A2. Item Photographs

Our Lot Photographs are taken from our view and to the best of our ability to carefully

and accurately depict items. Nonetheless Color, Tones and Visual Size Representation

of items may not be exact given the varying materials of the lots and their reaction to

particular lighting.

Our Photographs are not to be taken as an exact representation of lots.

A3. Condition

The condition of lots can vary widely due to factors such as age, previous damage,

repair and wear and tear, and or restoration. The nature of items (Vintage, Antique, Old

& Pre-owned) means that they will rarely be in a perfect condition without flaw.

Ultimately Lots are sold as is, without any representation or warranty or assumption of

liability of any kind as to condition by P.K. GALLERY.

(b) Any attempt to reference a lot(s) condition (Written or Orally) in a lot description or

condition report will not amount to a full description of lot condition, and images may not

show the condition of a lot clearly. Colors and shades may appear differently on the

screen as to how they appear upon physical inspection. Condition reports are available

upon request to help you evaluate the lot condition. Condition reports are provided free

of charge as a convenience to our bidders and are for guidance only. They offer our

opinion but they may not refer to all faults of a lot, inherent defects, restoration,

alteration or adaptation because our staff are not professional restorers or conservators.

For that reason, they are not in any way an alternative to taking your own professional

advice. It is solely your responsibility to ensure that you have requested, received and

considered any condition report.

A4. Estimates

Estimates are provided upon our professional opinion based on the condition, rarity,

quality and occasionally provenance of lots as well as hammer prices recently paid at

auction for similar items. Estimates can and will change. Neither you, nor anyone else,

may rely on any estimate as a guarantee and or prediction of the actual selling price of

a lot or its value for any other purposes such as resale. Estimates do not include any

buyer's premium or any applicable taxes.
