Terms & Conditions of Sale for P.K. GALLERY
PLEASE READ THESE CONDITIONS OF SALE AND THE SALE PARTICULARS
CAREFULLY BEFORE PLACING ANY BID ON A LOT. BY REGISTERING TO BID
AND/OR BY BIDDING AT AUCTION YOU AGREE TO THESE TERMS AND
CONDITIONS AND THEY WILL BECOME CONTRACTUALLY BINDING ON YOU.
A. PRE-SALE
A1. Description of Lots
Our description of any lot, any condition report and any other statements made by us
(whether in writing and or orally) about any lot, including about its nature, artist, period,
condition, materials, approximate dimensions, weights, provenance, and any other characteristics are our
opinion and not to be relied upon as a statement of fact.
We do not carry out in-depth research of the sort carried out by professional scientists,
historians and or scholars.
A1.1S - Dimensions & Weights
All dimensions, measurements, stone weights, item weights, and other specifications provided in any lot description, catalogue entry, condition report, or other communication are approximate only and are provided as a convenience to prospective bidders. Variations may occur due to the method of measurement, mounting, setting, restoration, alteration, or nature of the object. It is the bidder's responsibility to satisfy themselves as to the dimensions, weights, and specifications of any lot prior to bidding.
A1.2S - Attribution, Makers, Brands & Authorship
Any reference in a lot title, description, catalogue entry, condition report, or other written or oral communication to a maker, manufacturer, designer, artist, workshop, retailer, brand, signature, hallmark, stamp, label, serial number, model, or other attribution represents the opinion of P.K. GALLERY and shall not be relied upon as a statement of fact or guarantee of authenticity unless expressly accompanied by a certificate of authenticity, expert opinion, maker's documentation, laboratory report, or other supporting documentation specifically referenced in the catalogue and included with the lot.
Unless expressly stated otherwise, all such references are provided solely for cataloguing purposes and do not constitute a guarantee or warranty as to authenticity, authorship, origin, age, period, manufacture, attribution, provenance, or any other characteristic of a lot.
Prospective bidders are encouraged to carefully review all photographs, request additional information or condition reports, and satisfy themselves as to the authenticity and attribution of any lot prior to bidding.
P.K. GALLERY reserves the right to amend, supplement, or revise any lot title, description, attribution, catalogue entry, or condition report at any time prior to the commencement of live bidding.
A1.3S - Fashion & Costume Jewelry
Lots containing fashion or costume jewelry are sold strictly "as is," with all existing faults, wear, repairs, alterations, and imperfections. Due to the age and fragile nature of many costume jewelry mountings and components, all such sales are final.
Fashion and costume jewelry lots may be offered with general estimate ranges allowing for speculative bidding at the buyer's discretion. Prospective bidders are encouraged to review all photographs carefully and request additional information prior to bidding.
A1.4S - Restricted Species & Lots made of protected species.
Lots made of or including (regardless of the percentage) endangered and other protected species of wildlife are indicated in the description under additional catalogue notes in the Sale Particulars. These materials include, but are not limited to, ivory, tortoiseshell, crocodile skin, rhinoceros horn, whalebone, certain species of coral, and some hardwoods. Several countries refuse to allow you to import property containing these materials, and some other countries require a license from the relevant regulatory agencies in the countries of exportation as well as importation. As a result you should check the relevant customs laws and regulations before bidding on any lot containing wildlife material if you plan to import the lot into another country.
Furthermore, lots containing and or made of the above cited materials may require a license or certificate prior to exportation from the United States or an individual state and additional certificates or licenses for importation into another state or country. Some materials may not be exported, imported into other states or countries or resold. It is the purchaser's sole responsibility to be aware of all and any applicable laws & regulations as well as to obtain any required export or import licenses or certificates and any other required documentation.
In accordance with international wildlife trade regulations, certain bows and instruments in this sale may incorporate small amounts of protected materials such as ivory, tortoiseshell, or whalebone.
These materials were commonly used in the manufacture of historical musical instruments and bows prior to modern conservation regulations and are present only as minor, integral components (commonly referred to as de minimis).
Based on stylistic features, construction methods, and known provenance, these items are believed to pre-date applicable restrictions and qualify as antiques or as musical instruments containing legally permissible de minimis quantities of protected material.
Prospective purchasers should note:
Export, import, and interstate transport may be subject to permits and regulatory approval.
Requirements vary by country and jurisdiction.
The responsibility for obtaining any necessary permits rests solely with the purchaser.
P.K. Gallery will provide reasonable assistance in supplying documentation; however, compliance with all applicable laws remains the responsibility of the buyer.
The purchaser shall be responsible for on-time payment of the full purchase price of the lot, even if the obtaining of any such license is denied or delayed. P.K. GALLERY assumes no liability for failing to identify materials from endangered or protected species or for incorrectly identifying such materials.** All Clients must arrange for an in-person and or third-party agent collection of such lots. **
A2. Item Photographs
Lot photographs are provided for identification purposes only and form part of the overall description of the lot. While P.K. GALLERY makes reasonable efforts to photograph property accurately, color, tone, scale, and appearance may vary due to lighting, monitor calibration, photography techniques, and the reflective, translucent, or varied nature of certain materials.
Photographs should not be relied upon as an exact representation of any lot, and prospective bidders are encouraged to request additional photographs or information prior to bidding.
A3. Condition
The condition of lots can vary widely due to factors such as age, previous damage,
repair and wear and tear, and or restoration. The nature of items (Vintage, Antique, Old
& Pre-owned) means that they will rarely be in a perfect condition without flaw.
Ultimately Lots are sold as is, without any representation or warranty or assumption of
liability of any kind as to condition by P.K. GALLERY.
(b) Any attempt to reference a lot(s) condition (Written or Orally) in a lot description or
condition report will not amount to a full description of lot condition, and images may not
show the condition of a lot clearly. Colors and shades may appear differently on the
screen as to how they appear upon physical inspection. Condition reports are available
upon request to help you evaluate the lot condition. Condition reports are provided free
of charge as a convenience to our bidders and are for guidance only. They offer our
opinion but they may not refer to all faults of a lot, inherent defects, restoration,
alteration or adaptation because our staff are not professional restorers or conservators.
For that reason, they are not in any way an alternative to taking your own professional
advice. It is solely your responsibility to ensure that you have requested, received and
considered any condition report.
A4. Estimates
Estimates are provided upon our professional opinion based on the condition, rarity,
quality and occasionally provenance of lots as well as hammer prices recently paid at
auction for similar items. Estimates can and will change. Neither you, nor anyone else,
may rely on any estimate as a guarantee and or prediction of the actual selling price of
a lot or its value for any other purposes such as resale. Estimates do not include any
buyer's premium or any applicable taxes.
